    After presenting an overview of individual performance-based pay in the public sector in the United States, England and France, the authors provide a synthesis of studies on merit pay. The question raised is this : Why do so many states persist in adopting and maintaining merit-based compensation despite similar limitations to those identified in the private sector, in addition to added constraints specific to the public sector ? To explain this paradox, the authors adopt the perspective of conventionalist and institutional theory.

    This study proposes a reflection on the mechanism of reparation provided by the Rome Statute of the International Criminal Court. Ten years after its creation, the Court has rendered its first judgment in the Lubanga case. In March 2012, the Trial Chamber has found the accused guilty of war crimes. It invited the parties and the participants to submit their submissions on the principles that the Court should apply in determining the reparation and the procedure to follow. The reparations phase is imminent. In light of past ad hoc trial experiences for former Yugoslavia, Rwanda, and the Extraordinary Chambers in the Courts of Cambodia, the author frames the role of victims in the international criminal trial (I). She analyzes the complex notions of the Rome Statute's substantive law, especially ones related to the beneficiaries and the debtors of the reparations, applicable principles, accepted forms of reparation and the individual and/or collective character of the reparation order (II). She then proceeds with the examination of questions linked to the procedure and management of evidence (III). The author concludes her study by tackling the stakes of implementing reparations and the important role that the Trust Fund for Victims could play at this decisive stage (IV).

    SummaryIn its development on a world-wide scale, capitalism has always been other than and more than wage-earners the world capitalist sphere has always included non-salaried sectors integrated nonetheless to a great extent into capitalism. It is this world capitalist system which, both in its complexity and its unity, must be considered as the unit of analysis. It is, among other things, the unit of analysis as to the question of the transition of capitalism to socialism. By examining this problem of transition on as clear as possible a methodological basis, we are able to put forward the following proposition: the Russian Revolution of 1917, and analogous changes which took place elsewhere in its aftermath, set in motion in the field of world capitalism a process of transition from capitalism to socialism, by substituting the relationship living work-dead work for the relationship dead work-dead work.

    This paper proposes to see industrial relations as a synthesis of production, distribution, and rule-making Systems (PDR Systems) rather than to regard these three Systems as independent forces. This PDR System theory focuses on the actors' strategic choices for the PDR Systems, that is, subsystems of industrial relations System, and their interaction mechanisms. The contents and interactions of the PDR Systems determine the performance levels of the organization, i.e., productivity, flexibility, innovation, fairness, and satisfaction. This model can be used to analyze nonunion workplaces as well as unionized settings by embracing collective bargaining as a subsystem of the rule-making System. The general framework of the model is illustrated by using data from a Korean automobile company, which is particularly well suited for this purpose since it reflects different combinations of different PDR practices over its history. This model demonstrates that the best practice of future industrial relations will be established by the PDR Systems in which the creative humanware is maximized and actors spontaneously cooperate.

    Changes in the music industry caused by the digital revolution have forced musicians to master new skills that go beyond their artistic talents. One of these skills is personal brand development and management. This article presents a framework for analyzing a musician's brand. This tool, composed of five distinct sections—social context, artistic environment, artistic statement, personal environment, and personal statement—makes it possible to analyze a musician's authenticity and artistic legitimacy.
