After a century of attempts to establish a uniform system for maritime transportation liability, it is somewhat paradoxical that this matter now is sometimes governed by the Rules of the Hague, by the Rules of the Hague-Visby or by the Rules of Hamburg. The author demonstrates how intent to set up a unique international legal framework splintered into a multitude of legal systems that compete with one another for the maritime transportation liability, at the expense of goods owners. Each system continues to impose a ceiling on maritime transportation liability, yet most of them still grant maritime carriers with various exonerating circumstances.

School actors mandated to monitor homeschooling are at the crossroads of normative, political and educational conflicts. They solve them by various practices: mutual understanding, agreement on disagreement, search for the child's interest and creativity, but also, negligence, abuse of power, protection of their professionality, incontestability and distrust. The reflexive governance theory offers a genetic training approach in order to support local actors' participation ininstitutional reflexivity rather than to a form of resistance. Homeschooling supervisors from four Quebec school boards participated in a research-training process aimed, on the one hand, at experimenting an accompanied self-training framework; on the other hand, at modeling the learning process of participation in institutional reflexivity. At the end of the process, participants realized pragmatic learning and genetic learning, having shifted from a mandated executant posture to that of change agent. The learning process components and their conditions of success are described.

This article is an overview of the legal framework governing the protection of the confidentialityof personal information (genetics) exchanged during an insurance contract subscription.The exchange of data and information is imperative to all insurance operations.The aim of this article is to catalogue and then examine all of the most relevant legislativeprovisions with respect to the framing of exchange of personal information. This is donewith a specific perspective on the rising era of networking and computerization. It beginsby broaching the legal framework in practice in Quebec then follows with the examinationof existing rules in France. In each case, we pass from general rules intended toensure the protection of privacy to the specific rules governing privacy in insurance.
