    AbstractThis article proposes a discussion about the aboriginal sovereignty. Thus, we will mention some Latin-American investigators, whose works study the rights of aboriginal people, their circumstances, and determinants. From these papers, we will propose to reflect about the occidental state law, characterized by the juridical monism, which was first mentioned by Hans Kelsen. We will discuss the analysis of the state law, and the possibilities of both the creation of a multicultural estate and the imposition of a juridical pluralism. We will develop our arguments by saying that any society has a particular form of law, which implies, in the social and cultural aspect, an affirmation. Finally, we will study the work of Antonio Carlos Souza Lima to discuss the effects of the tutelage of the aboriginal people of Brazil.
