The purpose of this article is to indicate how the decisions of the Trail Smelter Arbitral Tribunal, rendered in 1938 and 1941, have made a contribution to the development of international law, including, in particular, the emerging international legal rules relating to transboundary air pollution. Of particular importance was the Tribunal's enunciation of the principle of the international liability of a pollution-source state. The influence of the Trail Smelter case is examined in the light of the Corfu ChannelCase, the Nuclear Test Ban Treaty (1963), the Helsinki Rules (1966), the Stockholm Principles (1972), the Nuclear Test Cases (1973-74), the OECD Principles concerning Transfrontier Pollution (1974 and 1976), and the Joint Statement on Transboundary Air Quality by Canada and the United States (1979).Two of the most difficult problems for solution in the case of transboundary pollution are: (1) equal access and non-discrimination with respect to remedies, and (2) liability and compensation. Canadian law has certain gaps in this regard. These and other problems of transboundary pollution pose a challenge for the 1980s and the TrailSmelter principle could make a contribution to their solution.

The Central African Economic and Monetary Community (CÉMAC) was founded in 1994, almost at the same period during which the World Trade Organisation (WTO) was founded. The aim of the CÉMAC was to intensify regional trade amongst its Member States. This regional organisation has elaborated a community customs law that deals with the sharing of competences between the institutions of the community and the Member States. It also organises the customs clearance procedure and the rules of customs dispute settlement. It is proven that the customs rules of CÉMAC meet the WTO rules on customs valuation. But the overall implementation of customs rules by the customs administrations of the Member States is not uniform. This lack of uniformity does not meet provisions of the GATT 1994.

Following a description of the codification process of civil law in Catalonia, the author turns her attention towards the legal transposition of certain institutions found under the Civil Code of Québec into the new Catalan Civil Code. Integration under the Catalan Civil Code remains somewhat incomplete considering the specific institutions or philosophical grounds that inspire them and, doubtless to say, remains limited in most cases since such importing adapts itself to the Catalan legislator's vision. The author focuses specifically on the adoption of the preliminary provision as well as a perspective for implementing the trust and the administration of the property of others. In the field of the law of persons, she emphasizes that other borrowings would be advantageous.

This study aims to examine the habits and preferences of adolescents and young adults (13-25 years old) of First Nations (FN) of Québec in relation to information and communication technologies (ICTs). It was carried out as part of an evaluation of the feasibility of using ICT interventions for the promotion of sexual and reproductive health (SRH) among young First Nations of Quebec. A questionnaire was designed for an electronic survey completed by a total of 192 participants. Over 60 % of respondents have regular access to technologies most often mentioned in the literature on interventions using ICT for the promotion of SRH and the prevention of STIs/HIV/AIDS among adolescents. However, they prefer the Internet as a channel for receiving information on SRH.

AbstractThis paper addresses the question of the distinctiveness of Canadian research methods by looking first at the broad pattern of methods used in empirical articles published in leading Canadian journals from the 1960s, how these have changed over time, and how they have differed between francophone and anglophone Canada. Issues of US influence raised by the earlier Canadianisation debate are also addressed. It is found that for the more recent period gender differences which cut across these ‘national' divisions have been the more salient. The net effect is that the total Canadian pattern has something in common with that recorded for other countries, although at a more detailed level there are specifically Canadian or québécois effects. Reasons for the similarities and differences are discussed.

SummaryThe article presents the results of a research on the trajectories of immigrant students' academic success in Montreal and Sherbrooke. The majority of these students attended a welcoming class. Using interviews as the chosen research method, case studies were conducted to analyze the point of view of the student, parent, and teacher on a student's school experiences. Thus, twenty-four cases emphasized various levels of mobilization contributing to each trajectory of academic success. Furthermore, a typology of success situations according to family profiles was modeled in three categories : success-continuity, success-promotion, family success. Transversal aspects of the typology are presented.
