The article goes back to the first disclosure case to have been handled by the Public Protector after the adoption of the “Act to facilitate the disclosure of wrongdoings relating to public bodies”: the Louis Robert affair. Approaching the case from the perspective of the construction of social problems, the article shows that it is not one, but two public problems: that of the interference of the private sector in public research and that of the protection of whistleblowers against reprisals. After a review of the different solutions proposed to the two problems, we highlight the determining role of the media before offering some thoughts on “Bill 53 An Act to enact the Act respecting protection against reprisals related to the disclosure of wrongdoings and to amend other legislative provisions”, adopted in May 2024.
