ABSTRACTThis article is a social analysis of incest based on judicial archives. Two hundred and seventeen cases, including one hundred and thirty-one trials leading to ninety-five convictions, have been uncovered in the correspondance of the Attorney-General of the province and in the archives of the judicial districts of Québec, Montmagny, la Beauce and La Malbaie. More than two thirds of the cases involve incest between father and daughter. Rural isolation and the economic dependence of the family on the father made many families keep these affairs a secret, although the victims did have the support of their relatives, neighbours, and the parish priest. These court documents reveal the brutal nature of the power relations between men and women at the heart of the traditional family.

The biopic, or biographical and fictional film, begins in Québec around the year 2000. The genre tells the story of the life of famous people, artists, sportsmen, political activists, for example. Three themes emerge from the analysis of these films: the insertion of characters in social movements, nationalist for men and feminist for women, the figure of the victim and transmission. These are essentially thesis films that illustrate various paths leading to individual and collective autonomy. Several mechanisms are used to reinforce the truth effect of these films that are nonetheless « freely inspired » by the lives of these people, thus contributing to the construction of a collective memory, a national history.

The author attempts to demonstrate the difficulty of applying the new test provided by s. 244(4) of the Criminal Code and concerning the sincerity of the accused's belief in a case of sexual aggression. Even if the judges of the Supreme Court of Canada, in two recent decisions (Bulmer and Robertson), reaffirmed the principle of Pappajohn that an honest and sincere mistake of fact to the existence of the victim's consent can constitute a defence to a criminal charge, we must give an explanation why the legislator changed the law by introducing this partly subjective and partly objective test. The author think that this new test creates much confusion ; it will be very difficult for judges to explain it adequately to the jury and for jury members to understand its real meaning. In conclusion, the author believes that once again the legislator created an ambiguous situation because he did not dare to impose a clearly objective test.

There exists a number of readings of Histoire d'Oby Pauline Réage (alias Dominique Aury), but a few are truly appreciative of the fact that this difficult text is a literary masterpiece. Feminist criticism in particularhas attacked this " scandalous " novel and in fact the surface theme of the story — portraying as it does a woman who chains herself to men who make of her a sex-slave — does appear to nourish legitimate suspicion about the presumed mysogynist nature of the novel.I propose however to read this text from a critical perspective which, although initiated by one or two commentators, marks a new approach to the novel's content and form. I concentrate particularly upon the text's narrative voice and seek to demonstrate that the actorial domination of the narration is in fact a metaphor for the actor O's dominance in the diegesis. This approach, of course, runs counter to feminist interprétations of Histoire d'O.

In his work, Lévinas sets out to analyse the ambiguity in others' presence, at times ontological, at times ethical. It is his belief that being is negative and changes others and that good exists only beyond being. Although it is impossible to recreate Lévinas' take on Céline, select few references do allow us to glimpse at the former's endorsement of the latter's cynical outlook on the universe and his “anti-humanism” as depicted in Voyage au bout de la nuit. Firstly, we shall attempt to confirm Céline's influence on Lévinas in this regard. Then, we shall analyse this influence by comparing selected works. Lastly, should we be proven right, we shall show that Lévinas' call on Céline is consistent with his general views on literature. We shall conclude with the possibility that both the author and the philosopher may have shared somewhat similar views on the nature of ethics.
