Les grands objectifs et les lignes de force de la réforme

Résumé

On reproche au Code civil du Bas-Canada de reposer essentiellement sur une théorie de l'autonomie de la volonté qui permettrait au fort d'écraser le faible et sur une théorie de la responsabilité fondée sur la faute, qui laisse la victime sans indemnisation lorsque le préjudice ne résulte pas d'un comportement fautif de l'auteur. Pour remédier à certaines injustices, le législateur eut recours à l'adoption de règles particulières, souvent imperatives. Que peut-on faire à l'aube d'un nouveau code, pour tenter de mieux équilibrer les rapports individuels ?

De l'Avant-projet, semblent se dégager deux lignes de force : d'une part, la consolidation de la théorie générale, par la codification de principes déjà reconnus et par la mise en relief d'armes inexploitées ou explicitées; d'autre part, l'accentuation de l'esprit protectionniste dans les contrats nommés. Jusqu'où le législateur peut-il aller dans le désir de protéger certaines catégories de personnes et comment peut-il y parvenir ?

Abstract

The Civil Code of Lower Canada has been criticized for being based essentially on a theory of freedom of choice possibly allowing the strong to dominate the weak and a theory of liability based on fault leaving a victim without indemnification when harm does not result from faulty behaviour on the part of its author. In order to remedy certain injustices, the legislator has resorted to the adoption of specific and often imperative rules. What may be done on this eve of a new code to attempt striking an improved balance in individual relations ?

Two major themes appear to stand out in the preliminary Draft : on the one hand, the consolidation of the general theory, via the codification of already recognized principles and by emphasis of hithertofore unused and explicated means and, on the other, by accentuating the protectionist spirit in nominate contracts. How far can the legislator go in seeking to protect certain categories of individuals and how is this to be done ?
