La transmission du patrimoine au Canada (xviie-xviiie siècle) : qui sont les défavorisés ?

Les modalités de la transmission du patrimoine chez les paysans canadiens des XVIIe et XVIIIe siècles sont maintenant biens connues. Elles vont du partage strictement égalitaire à la donation du bien foncier familial à un seul héritier, moyennant des dédommagements plus ou moins importants pour les autres enfants. Il convient toutefois de distinguer entre les façons de transmettre et l'équité entre les héritiers. Mesurer celle-ci est une tâche complexe qui requiert l'examen de multiples facteurs. Cet article propose d'en explorer un, soit la façon dont le successeur, par rachat de parts successorales ou par donation avec paiement de légitimes, s'acquittait de ses dettes envers les cohéritiers. Il appert que, de ce point de vue, ces derniers étaient grandement défavorisés. En effet, comparées à d'autres transactions foncières, celles qui étaient reliées à la transmission et qui avaient lieu entre apparentés faisaient plus rarement l'objet d'un paiement total au moment de la signature de l'acte. Par ailleurs, les délais de paiement accordés étaient alors plus généreux et les acquéreurs avaient plus tendance à différer le paiement final après la fin de ceux-ci. On peut donc en conclure que le financement du rachat de la terre familiale était en grande partie assuré par les cohéritiers qui ne s'y installaient pas. Cela remet en cause l'idée que la colonisation des nouvelles terres se faisait au détriment des exploitations plus anciennes.

ABSTRACT

The modalities of the transmission of inheritance among Canadian pea-sants in the seventeenth and eighteenth centuries are now well known. They ranged from a strictly egalitarian division of the family land among the children to its transmission by deed of gift to a sole heir, in return for some measure of compensation for the others. It is, however, necessary to distinguish between the formal arrangements ofthe inheritance process and the result, that is, the respect, in the event, ofthe principle of equity among co-heirs. It is not easy to measure the degree of equity, as several factors must be taken into account. This article examines one of them: the way in which the principal heir reimbursed the co-heirs whose portions he (for he was invariably a son or son-in-law) had purchased or whom he owed a compensatory payment (légitime) by the terms of a deed of gift. It would seem that co-heirs in such a situation were at a considerable disadvantage. Compared to the normal run of land sales, those among relatives and forming part ofthe inheritance process were less likely to be settled in totality when the deed was signed. Co-heirs granted longer delays of payment and, once these expired, were more likely to have to wait still longer for reimbursement. The article concludes that co-heirs who ceded their portion ofthe family farm to one of their siblings, in principle in return for some sort of compensatory payment, involuntarily eased the principal heir's financial burden. The finding qualifies the widespread impression that in a pioneer society such as this, the developed older farm was an efficient launching pad for co-heirs obliged to try their luck elsewhere.
