Abstract
COMPENSATION TO VICTIMS OF CRIMINAL OFFENCES
The system of composition, which was developed during the Middle Ages, especially under Germanic penal law, represents not only an abatement of the system of collective vengeance characteristic of this era, but also the first step towards the principle of compensation to victims of criminal offences.
With the development and consolidation of a strong central power, the State asked for a share of these transactions either in the form of sanction or as a price for its intervention. W^hen at last the central government obtained the full and exclusive right to inflict punishment and when private justice gave way to public justice, the State's share of compensation increased progressively and took the form of fines, while the victim's share gradually diminished and withdrew little by little from the penal system to become civil compensation for damages.
Nevertheless, the total separation between public action, whose aim is to ensure punishment, and civil action, whose main object is to secure compensation to the victim, did not materialize until very recently. This principle of total separation, which was adopted by the classical school
of criminal law, resulted in a complete overlooking of the victim's right to compensation, in daily legal practice.
New solutions were therefore proposed to remedy this deficiency in the penal systems, the most original and daring being those to be found in the Spanish Penal Codes of 1822 and 1848 which compel the State to compensate victims of criminal offences when the wrong-doers or other responsible persons are unable to do so.
This idea of compensation by the State to victims of crime, although taken lip and elaborated several years later by Bentham and the Italian Positivist School, had absolutely no repercussions as far as practice was concerned. It was only in the second half of the XXth Century that an Englishwoman, Margaret Fry, drew the attention to this problem. Inspired by her compatriot Bentham, Margaret Fry proclaimed that compensation for harm caused to victims of criminal violence should be assumed by the State.
This was the starting point of a considerable development in the study of compensation to the victim. During the last ten years, not only were many papers and conferences devoted to the subject, but also many legislations adopted the progressive solution of conferring upon the State the task of compensating the victim of criminal offences.
In most contemporary penal legislations, the dissociation between public and civil action has resulted in relegating the subject of compensation solely to the civil domain.
A certain number of penal systems (France, Belgium, Germany, etc.), while accepting in principle the civil character of this matter, nevertheless offer the injured party the possibility of bringing his action for damages before criminal courts.
A last group of systems (Spain, Italy, Switzerland) treat this problem within the framework of the criminal code, although in most cases they do nothing but repeat analogous paragraphs of the civil code.
Upon examining these different methods of coping with the problem of compensating the victim for damages caused by criminal violence, we find that certain reforms were put into effect but that they chiefly hinge upon one preliminary question ~— the means available to the victim for bringing his case before the criminal courts and of engaging in the criminal procedure, to obtain recognition of his rights by the Court.
However, it often happens that once the sentence has been passed, the victim is obliged to act on his own to recover the sum of the indemnity. Modern penal law, progressive and innovating as it is in certain respects, often neglects the victim of crime.
Certain solutions were proposed and even introduced into positive penal legislations, in view of securing for the injured party, as much as possible, the recovery of the compensation decided upon by the courts in his favour, especially in cases where the offender is destitute.
Among such solutions, one should stress legal solidarity between co-delinquents, priority accorded to the compensation debt, accessory imprisonment, compulsory work in prison and in liberty, compulsory insurance and the creation of a compensation fund. Similar proposals tend to consider compensation to the victim as an indispensable condition for the obtainment of certain privileges (pardon, parole, probation, legal rehabilitation, etc.).
Due to the insufficiency of the classical systems and of the solutions destinated to secure compensation of the victim by the offender, one again began to wonder whether the State should not undertake the charge of repairing damages caused by crime.
The main argument offered in favour of this system is the State's failure in preventing crime and in protecting its citiiens against felonious acts.
Despite the numerous criticisms concerning the essentially judicial composition of the courts in charge of the application of the system as well as of the procedure to be followed, the infractions to be compensated, the amount to be paid and the total cost of the system, some countries have recognized the right of the victim to be compensated and consequently adopted measures to enforce this principle (New Zealand, 1963; Great
Britain, 1964; States of California and New York, 1966; the Canadian province of Saskatchewan, 1967).

LA INDEMNIZACION A LAS VlCTIMAS DE INFRACCIONES CRIMINALES
El sistema de composiciones pecuniarias, una de las instituciones fundamentales del derecho germanico medieval, constituye no solamente un limite a la venganza de la sangre caracteristica de esta epoca sino tambien un primer esbozo del principio de indemnizacion a las victimas de infracciones penales.
A medida que su poder se afirma y desarrolla, el Estado va a exigir que una parte de estas transacciones le sea reservada, en concepto de pena o como precio de su intervencion. Dicha parte aumentara progresivamente, transformandose en multa, mientras que la de la victima disminuira paula-tinamente y, separandose poco a poco del sistema penal, se convertira en la indemnizacion civil por los danos causados.
Sin embargo, la separacion total entre la accion publica, cuyo objeto consiste en la imposicien de una pena, y la accion civil, cuya finalidad esencial es decidir sobre la indemnizacion que la victima debera recibir, no se ha efectuado sino en una epoca bastante reciente. Este principio de separacion total, adoptado por la escuela clasica de derecho penal, ha pro-ducido como consecuencia directa el olvido completo de la reparacion a la victima en la practica judicial diaria.
Para remediar esta insuficiencia de los sistemas penales se han propuesto diversas soluciones, la mas original y audaz de las cuales ha sido encon-trada con prioridad sobre las demas legislaciones por el derecho espaflol en los Codigos penales de 1822 y 1848, en donde se reconoce la obligacion del Estado de indemnizar a las victimas de infracciones criminales cuando los autores y demas personas responsables carezcan de medios para llevarla a cabo.
Esta idea de reparacion por el Estado, aunque aceptada y expuesta unos afios mas tarde por Bentham y la escuela positivista italiana, no tuvo ninguna repercusion practica y habra que esperar la segunda mitad del siglo veinte para que otra inglesa, Margaret Fry, aborde de nuevo este problema. Inspirandose en su compatriota Bentham, Margaret Fry sugiere que la reparacion del perjuicio causado a las victimas de violencias criminales sea asumida por el Estado.
En adelante, el estudio de la indemnizacion a la victima va a desar-rollarse considerablemente y durante los ultimos diez afios, numerosos articulos y coloquios le han sido dedicados. Finalmente, diversos paises han introducido en sus sistemas penales la solucion progresista consistente en dejar a cargo del Estado la obligacion de ofrecer reparacion a la victima del delito.
En la mayoria de las legislaciones penales contemporaneas, la diso-ciacion entre las acciones publica y civil ha producido como resultado la relegacion de esta materia al dominio puramente civil.
Cierto numero de sistemas (frances, belga, aleman), aunque aceptando el caracter eminentemente civil de la reparacion, ofrecen sin embargo a la persona perjudicada la posibilidad de presentar su accion ante los tribunales represivos.
Un ultimo grupo de legislaciones regula este problema en las disposiciones del Codigo penal (Espana, Italia, Suiza), pese a que en la mayoria de los casos dichas disposiciones no hacen mas que reproducir preceptos analogos del Codigo civil.
Al examinar estas diversas formas de abordar el problema de la reparacion del dano causado por la infraccion, es evidente que ciertas reformas han sido realizadas en este dominio. Dichas reformas se refieren especialmente a una cuestion previa, los medios puestos a la disposicion de la victima bien para poner en marcha la justicia bien para obtener el reconocimiento de su derecho a ser indemnizada.
Sucede a menudo sin embargo que una vez pronunciada la condena, la victima queda abandonada a si misma y ha de entablar un pleito largo y costoso para obtener reparacion del perjuicio sufrido. El derecho penal moderno, progresista e innovador en determinados aspectos, nada o casi nada ha hecho para hacer efectiva una justa reparacion de los danos del delito.
Diversas soluciones han sido propuestas e incluso incorporadas en los textos legales de varios paises con la finalidad de asegurar el resarcimiento de los danos del delito, especialmente en los casos de insolvabilidad del culpable. Merecen ser destacadas la solidaridad legal entre codelincuentes, el privilegio concedido a la reparacion del dano causado sobre las demas responsabilidades pecuniarias, el encarcelamiento subsidiario, el trabajo obligatorio (en libertad o en la prision), el sistema de seguro obligatorio y la creacion de cajas de socorro para procurar auxilio a las victimas no indemnizadas, asi como el exigir la reparacion del perjuicio causado como condicion previa e indispensable para la obtencion de ciertos beneficios penologicos (indulto, probacion, libertad condicional, rehabilitacion, etc).
Ante la insuficiencia de los sistemas clasicos y de los medios puestos en accion por ellos con objeto de obtener del delincuente la reparacion del dano producido, la doctrina mas reciente insiste en la obligacion del Estado de asumir esta carga.
Pese a las numerosas criticas y reticencias manifestadas por lo que se refiere a la composicion esencialmente juridica del tribunal encargado de examinar las demandas de reparacion, asi como al procedimiento seguido o a seguir, a las infracciones susceptibles de indemnizacion, a las cantidades que han de pagarse y al coste total del sistema, diversos paises han reconocido la legitimidad del derecho de la victima a ser indemnizada y han adoptado en consecuencia las medidas necesarias para hacer efectivo este principio (Nueva Zelanda, 1963; Gran Bretana, 1964; estados de California y Nueva York, 1966; provincia canadiense de Saskatchewan, 1967).

ENTSCHADIGUNG DER OPFER KRIMINELLER HANDLUNGEN
Das Kompositionssystem, das besonders im Mittelalter durch das Germanische urtumliche Recht entwickelt wurde, ist die Darstellung einer der ersten Formen des Entschadigungsprinzips gegenuber der Opfer krimineller Handlungen, sowie der Milderung der kollektiven Rache, die fur dieses Zeitalter so karakteristisch war.
Mit der Entwicklung und Verstarkung der zentralen Macht erforderte der Staat den Vorbehalt einiger Rechte, sei es das Recht zur Bestrafung, sei es das Recht zur Einschreitung. Als schliesslich die zentralisierte Macht das volle Bestrafungsrecht an sich nahm, und als die offentliche Justiz der Privatjustiz vorging, vergrosserte sich progressiv der Anteil des Staates, der zur Geldbuse wurde, wahrend der Anteil des Opfers sich verminderte, sich nach und nach vom Strafrecht abloste, um schliesslich als privatrechtliche Entschadigung zu erscheinen.
Die vollstandige Trennung der burgerlichen Rechtsklage — deren Hauptziel die Bestrafung ist -— von der Privatrechtsklage — deren Hauptobject die Entschadigung des Opfers ist — hat sich nichtsdestoweniger erst vor kurzem vollzogen. Das oben erwahnte, und durch die klassische Strafrechtschule ausgearbeitete Prinzip der vollkommenen Trennung, hat die vollstandige Aufhebung des Entschadigungsrechtes des Opfers zur direkten Folge gehabt.
Zur Korrektur dieser Unzulanglichkeit des Strafrechtsystems sind einige neue Losungen vorgeschlagen worden. Die originellste und kuhnste darunter findet man zum erstenmal im Spanischen Strafgesetzbuch von 1822 und von 1848, laut deren der Staat sich verpflichtet, das Opfer zu entschadigen, wenn der Tater und die anderen Schuldbeteiligten nicht dazu imstande sind.
Dieser Begriff der staatlichen Wiedergutmachung, obwohl er spater von Bentham und der Italienischen, positivistischen Schule umfassend ausgearbeitet wurde, fand uberhaupt keine praktische Anwendung. Man musste bis zur zweiten Halfte des 20. Jahrhunderts warten, damit sich eine Englanderin,
Margaret Fry, nochmals mit diesem Problem befasste. Von ihrem Landsmann Bentham beeinflusst, schlug Margaret Fry vor, dass der Staat fur Schaden, die durch kriminelle Gewalt verursacht werden, die Verantwortung ubernehme.
Von nun an wurde das Problem der Entschadigung des Opfers sehr intensiv studiert. Wahrend der letzten zehn Jahre sind ihm nicht nur eine grosse Anzahl von wissenschaftlichen Artikeln und Unterhandlungen gewidmet worden, sondern auch verschiedene Gesetzgebungen haben die fortschrittliche Losung gewahlt, namlich, dass der Staat fur die Wiedergutmachung verantwortlich gehalten wird.
Heutzutage findet man in den meisten Gesetzgebungen eine Zweis-purigkeit zwischen der offentlichen Rechtsklage und der Zivilrechtsklage, so dass das Problem der Entschadigung einzig auf das Bereich des Zivilrechtes verwiesen worden ist.
Einige Strafrechtsysteme (Frankreich, Belgien, Deutschland, usw.), obwohl sie zugeben, dass solche Angelegenheiten vor allem zum Zivilrecht gehoren, bieten nichtsdestoweniger der beschadigten Partei die Moglichkeit, vor dem Strafgericht eine Entschadigung zu verlangen.
Eine letzte Gruppe von Strafrechtsystemen (Spanien, Italien, Schweiz) versetzt dieses Problem auf das Gebiet des Kriminalgesetzes, obwohl in den meisten Fallen die Massnahmen nur Wiederholungen des Zivilgesetzes sind.
Wenn man sieht auf wieviele verschiedene Arten dieses Problem des Schadenersatzes gelost werden kann, stellt man fest, dass jene Reformen, die in dieser Hinsicht vollzogen worden sind, vor allem auf ein fundamentales Problem hinweisen, namlich auf das der Mittel, die dem Opfer zur Verfugung stehen, um das Strafgesetz in Beschlag nehmen zu konnen, sowie auf jenes der Anerkennung seiner Rechte vor dem Gericht, nachdem die Klage gebracht worden ist.
Es kommt namlich vor, dass das Opfer, nachdem das Urteil gesprochen worden ist, mit seinen eigenen Mitteln dem Schadenersatz nachgehen muss. Das moderne Strafrecht, das in bestimmten Angelegenheiten progressiv und neuernd ist, vernachlassigt oft das Opfer.
Es sind einige Massnahmen vorgeschlagen, und sogar in den positiveren Strafrechtsgebungen eingeleitet worden, damit der beschadigten Partei soweit wie moglich ein Schadenersatz garantiert werden kann, vor allem im Falle, dass der Schuldige zahlungsunfahig ist.
Einige dieser Massnahmen sind die gegenseitige, rechtliche Verantwortlichkeit der Mitangeklagten, die Prioritat, die der Bezahlung des Schadenersatzgeldes uber andere Schulden gegeben wird, die subsidiarische Gefangnisstrafe, Zwang zur Arbeit (entweder im Gefangnis oder auswarts), obligatorische Versicherungssysteme, und die Grundung einer Indemnitatskasse. Es ist ausserdem noch vorgeschlagen worden, dass der Schadenersatz eine unentbehrliche Vorbedingung zur Erlangung bestimmter Vorteile sein sollte (Begnadigung, bedingte Freilassung, Bewahrungsfrist, Rehabilitation, usw.)
Insofern als dass die klassischen Systeme und die angewandten Mittel sich als ungenugend bewiesen haben, um die Bezahlung des Schadenersatzes an das Opfer seitens des Missetaters zu garantieren, hat man die Frage in Betracht genommen, ob der Staat nicht diese Verantwortung auf sich nehmen sollte. Das Hauptargument fur solch eine Massnahme stutzt sich auf die Unfahigkeit des Staates, dem Verbrechen vorzubeugen und den Burger vor Missetatern zu beschutzen.
Trotz zahlreicher Kritiken und zuruckhaltender Einstellung in Bezug auf die vorwiegend rechtliche Zusammenstellung des Gerichtes, welches sich mit Schadenersatzklagen befasst, in Bezug auf die Prozedur, auf die Natur der Missetaten fur deren Folgen Schadenersatz verlangt werden kann; auf den Betrag der Summen, die bezahlt werden sollen, und auf die Gesamtkosten des Systems haben einige Staaten es erkannt, dass das Recht des Verletzten zum Schadenersatz gut begrundet ist und haben folglich Massnahmen erfasst, um dieses Prinzip auszufuhren (Neuseeland in 1963, Gross-Britannien in 1964, die Amerikanischen Staaten von New York und Californien in 1966, und die Kanadische Provinz Saskatchewan in 1967).
