Starting with self-reported delinquency, we follow its course within the system of social regulations practised by the public, the police and the courts.The data concern self-reported delinquency (measured by the questionnaire of Nye and Short on self-reported delinquency), delinquency officially known to the police, and the decisions taken by the police and judges with regard to delinquent acts. These data were gathered in five districts in Montreal, representing five social strata.The analysis of the stigma of delinquency showed that there is more chance of working-class subjects entering the juvenile justice system, above all where acquisitive and rebellious delinquency is concerned, especially in relation to the community, the family and sex. Among the middle and upper classes the stigma of delinquency is attached more to aggression and rebellion connected with automobiles and vandalism.As to the origins of social reaction ¦— the way in which an adolescent is admitted to the juvenile justice system .— the citizen reports offences against his person and property, while the police record offences against public order and morals.At the police level, the adolescent is returned to his home if it is a question of rebellion committed by a group between the ages of 12 and 15, whereas he is taken to court if his offence, reported by the citizen, is repeated and of a more serious nature. In the case of those taken to court, the adolescent is detained if he is a recidivist, and receives a summons if it is his first offence.The judges favor special measures in the case of rebelliousness, and no action at all (postponement sine die) in the case of aggression or theft by adolescents of the working class. A recidivist will be institutionalized for a serious infraction and treated within the community in the case of a less serious offence. Re-education in the community is given if the adolescent has been detained, and a fine if he has received a summons.The results clearly show that the characteristics of the delinquent acts are more important than the socioeconomic milieu in determining whatdecisions are taken. However, the socioeconomic milieu does influence admission into the juvenile justice system, as well as judicial reaction. Working-class subjects are given less attention than those from the middle and upper classes, postponement sine die is more often used in the working-class milieu, and fines, re-education within the community and institu-tionalization are more often applied to subjects of the middle and upper classes. Moreover, the margin of discretionary powers in decision making is, on the whole, rather narrow, which means that in the majority of cases, decisions can be explained by no other factors than the characteristics of the delinquent acts. This discretionary margin in decision making is narrow, both at the police and judicial levels, when a choice between particular measures must be made ; on the other hand, there is some leeway, since the judge must choose between postponement sine die and a particular measure. Finally, the course of the offence within the juvenile justice system reinforces the previous decisions through a process of amplification, which, as a consequence, penalizes working-class subjects to some extent.In short, delinquency is an adolescent phenomenon in general, but only a minority of infractions enter and continue to circulate within the juvenile justice system. The criteria for decision making are indeed socio-economic, but more often relate to the past history of the delinquent and the nature of his offence. AB - DELINCUENCIA JUVENIL Y REACCIÔN SOCIALEl objeto de esta investigaciôn es estudiar tanto el proceso de la reacciôn social contra la delincuencia juvenil como los criterios de decision utilizados por los agentes encargados del control social para estigmatizar a los adolescentes delincuentes. Partiendo de la delincuencia revelada y oficial, se trata de seguir el camino de esta delincuencia a través del sistema de regulaciôn social ejercido por el pûblico, la policia y los tribunales.Los datos se refieren a la delincuencia revelada (medida por el cuestio-nario de delincuencia revelada de Nye y Short), la delincuencia conocida por la policïa, es decir, la delincuencia oficial, y las decisiones de policîas y jueces sobre los hechos delictuosos. Estos datos han sido recogidos en cinco barrios de Montreal que corresponden a cinco nivelés de la estrati-ficaciôn social.El anâlisis estigmâtico de la delincuencia ha probado que las personas del medio obrero tienen mâs probabilidades de entrar en el sistema de la justicia juvenil, sobre todo si se trata de la delincuencia adquisitiva y rebelde y, en particular, de la delincuencia comunitaria, familiar y sexual. En los medios favorecidos, la agresiôn y la rebeliôn, que se exteriorizan por medio del automôbil y del vandalismo, son las formas de delincuencia mâs estigmatizadas.En cuanto al origen de la reacciôn social, es decir, al modo de entrar en el sistema de la justicia juvenil, el simple ciudadano denuncia los delitos contra su propia persona o bienes, mientras que el policia constata los delitos contra el ôrden y la moral pûblica.Por lo que se refiere a la reacciôn policiaca, el adolescente es con-fiado a su domicilio cuando se trata de delincuencia de rebeliôn cometida en grupo por jôvenes de 12 a 15 anos ; en cambio, son sometidos a los tribunales para menores los jôvenes reincidentes que cometen delitos graves denunciados por los ciudadanos. Por lo que respecta a la manera de pre-sentar al adolescente ante el tribunal, hay detenciôn si es reincidente y simple citaciôn cuando se trata de un primer delito.La reacciôn judicial aplica medidas particulares en los casos de rebeliôn y ninguna medida (aplazamiento sine die) cuando se trata de agresiôn o robo de adolescentes de medio obrero. Se impone la instituciona-lizaciôn a los reincidentes que cometen infracciones graves y las medidas en medio abierto en los casos levés. Finalmente, se aplican medidas dereeducación en medio abierto si el adolescente ha sido detenido y multa si comparece mediante citación.Los resultados de la investigación demuestran claramente que las características de los hechos delictuosos son más importantes que el medio socio-económico de los autores para determinar la decisión que deba tomarse en cada caso. Sin embargo, dicho medio socio-económico influye tanto en la manera de entrar en el circuito de la justicia juvenil como en la forma de la reacción judicial. Los jóvenes de medio obrero son tratados con menos cuidado que los procedentes de medio elevado ; el aplazamiento sine die es aplicado con mayor frecuencia al medio obrero, mientras que la multa, la reeducación en medio libre y el encarcelamiento reciben una mayor utilización por lo que se refiere a los jóvenes de alto nivel socioeconómico. Por otra parte, el porcentage de decisiones discrecionales es en general bastante débil, lo cual quiere decir que en la mayoría de los casos las decisiones tomadas solo pueden explicarse por los factores relativos a las características de los hechos delictivos.Por lo que respecta a la acción policíaca y judicial, este margen de decisiones discrecionales es débil cuando se trata de escoger entre medidas particulares ; en cambio, dicho margen es más amplio cuando el juez escoge entre el aplazamiento sine die y una medida particular. Finalmente, la progresión del delito en el sistema de la justicia juvenil confirma las decisiones anteriores por un proceso de amplificación, lo cual tiene como consecuencia el penalizar en cierta manera a los jóvenes procedentes de medio obrero.En conclusión, la delincuencia es un fenómeno generalizado propio a la adolescencia. Sin embargo, solo una minoría de delitos entran y circulan continuamente en el sistema de la justicia juvenil. Los criterios de decisión son de orden socio-económico, aunque relacionados en la mayoría de los casos con el pasado del delincuente y la naturaleza del delito. AB - JUGENDKRIMINALITÄT UND SOZIALE REAKTIONDas Ziel dieser Untersuchung besteht darin, den Prozess der sozialen Reaktion auf die Jugendkriminalität aufzuzeigen, so wie die Entscheidungskriterien, die von den Verantwortlichen gebraucht werden, um die Jugendlichen zu stigmatisieren. Von der nachweisbaren und amtlichen Delinquenz-ziffer ausgehend, geht es vor allem darum, dem Verlauf dieser Kriminalität im System der sozialen Ordnung zu folgen, so wie sie von der Öffentlichkeit, der Polizei und den Justizbehörden ausgeübt wird.Das Material umfasst die aufgedeckte Kriminalität (gemessen mit Hilfe des Fragebogens von Nye und Short), die der Polizei bekannt gewordene De-linquenz und die Entscheidungen der Polizeibeamten und Richter im Hinblick auf die kriminellen Ereignisse. Das Material wurde in fünf verschiedenen Wbhnquartieren von Montreal gesammelt, die fünf verschiedene soziale Stra-tifikationsebenen aufweisen.Die Analyse der Kriminalität hat ergeben, dass die Untersuchungsobjekte des Arbeitermilieus eher prädestiniert sind, in das System der Jugendgerichtsbehörden zu geraten, besonders wenn es sich um Vermögensdelikte handelt, in Fällen der gemeinsamen Zusammenrottung und in Fällen von Familien und Sexualfehlverhaltens. In gehobeneren Schichten drücken sich Aggressivität und Auflehnung durch Fehlverhalten mit dem Automobil und durch Vandalismus aus.Was den Ursprung der sozialen Reaktion angeht, so findet beim Modus des Eintritts in das System der Jugendgerichtsbarkeit eine Umwälzung statt : der Bürger meldet Delikte gegen seine eigene Person oder sein Eigentum und der Polizeibeamte vermerkt Delikte, die gegen die öffentliche Ordnung wirken.Der Reaküonsmodus der Polizei stellt sich so dar : der Jugendliche wird den Eltern zugeführt, wenn es sich um eine Auflehnungsdelinquenz handelt, die von Jugendlichen im Alter von 12 bis 15 Jahren bandenmässig begangen worden ist. Er wird hingegen dem Gericht zugeführt, wenn es sich um ein von einem Bürger gemeldeten Rückfallsdelikt schwerer Natur handelt. Was diese gerichtliche Zuführung betrifft, so wird der Jugendliche in der Zelle behalten, wenn er rückfällig ist, oder er erhält Auflagen, wenn er zum ersten Mal delinquiert hat.Das gerichtliche Vorgehen bevorzugt besondere Massnahmen im Falle der Zusammenrottung und Auflehnung und keinerlei Massnahmen (Aufschub des Entscheids ohne Angabe des Termins), wenn es sich um Gewaltdelikte und Diebstahl handelt, die von Jugendlichen aus dem Arbeitermilieu begangen worden sind. Die Einweisung in eine Anstalt wird einem Rückfälligen für ein Delikt ernsthafterer Natur auferlegt, nicht hingegen in Fällen harmloser Delikte, wo der Jugendliche lediglich überwacht wird (milieu ouvert). In diesen Fällen werden Resozialisierungsmassnahmen engewendet, wenn der Jugendliche sich in Untersuchungshaft befunden hat, oder er wird mit einer Busse bestraft, wenn er nur die Auflage, vor Gericht zu erscheinen, erhalten hat.Die Ergebnisse zeigen deutlich, dass die Merkmale deliktischer Erscheinungen weitaus wichtiger sind als die sozio-ökonomische Herkunft der Betreffenden, was die Entscheidung der Behörden angeht. Jedoch beeinflusst das sozio-ökonomische Milieu den Eintritt in das System der Jugendgerichtsbarkeit und die gerichtliche Entscheidung selbst. Jugendliche aus dem Arbeitermilieu werden mit weniger Aufmerksamkeit behandelt als die aus gehobenen Schichten ; der Aufschub des Entscheids ohne Angabe des Termins ist im Arbeitermilieu gebräuchlicher, und die Busse oder die Resozialisierung in der offenen Anstalt findet eher Anwendung für Delinquenten der oberen sozialen Schichten. Im ganzen gesehen, ist der freie Entscheidungsraum ziemlich begrenzt, was bedeutet, dass in der Mehrzahl der Fälle die Entscheidungen einzig und allein durch die Deliktsmerkmale bestimmt sind. Dieser freie Entscheidungsraum ist begrenzt, was die polizeiliche und gerichtliche Auswahl der besonderen Massnahmen betrifft, er ist hingegen gross, wenn der Richter zwischen Aufschub und besonderen Massnahmen wählen kann. Die Evolution des Deliktes im Jugendgerichtssystem unterstreicht frühere Urteile durch einen Prozess der Verschärfung, was zur Folge hat, dass Jugendliche aus den Arbeiterschichten unverhältnismässig mehr bestraft werden.Als Konklusion kann gesagt werden, dass die Delinquenz im jugendlichen Alter ein weitverbreitetes Phänomen ist, dass aber nur eine Minderheit der Delikte in das Jugendgerichtssystem dringen. Die Entscheidungskriterien sind sozio-ökonomischer Natur, aber häufiger in Zusammenhang mit der Vergangenheit des Rechtsbrechers und der Art des Delikts zu sehen.
