TWO TYPES OF PUNISHMENT

AND THEIR EFFECT ON THE CRIMINAL

The examination of the immediate, spontaneous social reaction of groups towards deviants makes it possible to distinguish two very different types of punishment : corrective and stigmatizing. Corrective punishment is a measure intended to change the behaviour of a delinquent and to maintain him within the group. Stigmatizing punishment consists of attaching a dishonourable label to the delinquent and rejecting him from the group to which he belongs. When a person who is receptive to the influence of his group undergoes corrective punishment, his most probable reaction will be to conform to the expectations of his group. But if he is subjected to stigmatizing punishment, there is a possibility that he will interiorize the criminal identity attributed to him. He will then enter into conflict with the group and with others, and will tend to become integrated into a criminal group and become a recidivist criminal.

A study of recidivism, conducted on the basis of concepts of correction and stigmatization, makes it possible to formulate the following two propositions : 1) an individual who is easily influenced by his group will have a greater tendency to recidivate if, over a substantial period of time, the predominant reaction to his offenses is one of stigmatization. He will have less of a tendency to recidivate if the predominant reaction to his offenses is corrective ; 2) penal measures influence recidivism, not directly, but through the agency of the immediate social reaction. The penal measures start a process of stigmatization from the outset, which has an effect on the probability of recidivism.

The concepts of correction and stigmatization are also useful in the study of the evolution of penal measures. They make two other propositions possible : 3) the more complex societies become, the less the State tends to resort to stigmatizing punishment and the more it resorts to corrective punishment ; 4) imprisonment is a punishment which was developed during a period of transition during which stigmatizing punishment was losing out in favour of corrective punishment. It is a mixed measure which attempts to reach a compromise between stigmatization and correction. Because it contains elements that are incompatible, the prison will eventually fall into disuse.

At the level of action, the distinction between corrective punishment makes it possible to resolve seemingly insurmountable difficulties within the framework of the present ideology of treatment. It leads to the recognition of this basic fact, that all social reaction to an act that is disapproved of is a punishment, and care must be taken to safeguard the rights of the

delinquent, even when we claim to be treating him. Furthermore, this concept leads to the admission that all punishment is liable to contain elements of stigmatization. Only measures that are strictly necessary should therefore be applied to the delinquent, for fear of releasing, in an excess of zeal, a process of stigmatization that will only accentuate the delinquent's anti-social tendencies.

El examen de la reaccion social elemental, espontanea de los grupos contra la conducta desviada permite distinguir dos modalidades diferentes de penas : la pena correctiva y la pena estigmatizadora. La primera es una medida destinada a modificar la conducta de un delincuente y a mantenerlo en el grupo ; la segunda consiste en atribuir una etiqueta infamante al delincuente y expulsarlo del grupo a que pertenece. Cuando un individuo receptivo a la influencia de su grupo recibe una pena correctiva, su reaccion mas probable sera la de con-formarse a las expectativas de su grupo. En cambio, si recibe una pena estigmatizadora, corre el riesgo de interiorizar la identidad criminal que se le atri-buye ; entonces, entrara en conflicto con el grupo y con los demas, tendera a intergrarse en un grupo delincuente y se convertira en un criminal reincidente.

El estudio de la reincidencia realizado a partir de los conceptos de correccion y estigmatizacion permite formular las proposiciones siguientes : 1) un individuo receptivo a la influencia de su grupo tendra tanto mayor tendencia a reincidir cuanto, durante un lapso substancial de tiempo, la reaccion predominante frente a sus delitos sea estigmatizadora y tanto menor tendencia a reincidir cuanto la reaccion predominante a sus delitos sea correctiva ; 2) las medidas penales influencian la reincidencia, no directamente, sino por intermedio de la reaccion social elemental. Las medidas ponen en movimiento un proceso de estigmatizacion en el piano elemental, el cual ejerce cierta influencia en la probabilidad de reincidencia.

Los conceptos de correccion y estigmatizacion son tambien utiles para el estudio de la evolucion de las medidas penales. Dichos conceptos permiten anunciar las proposiciones siguientes : 3) a medida que las sociedades se vuel-ven mis complejas, el Estado tiende cada vez menos a recurrir a penas estig-matizadoras y cada vez mas a utilizar penas correctivas ; 4) el encarcelamiento es una pena que se ha desarrollado en un periodo de transicion durante el cual las penas estigmatizadoras perdian importancia en provecho de las penas correctivas. Se trata de una medida mixta que intenta realizar un compromiso entre la estigmatizacion y la correccion. Dado que lleva consigo elementos incompatibles, la pena de prision caera eventualmente en desuso.

En el piano de la accion, la distincion entre pena correctiva y estigmatizadora permite resolver ciertas dificultades que parecen insuperables en el marco de la actual ideologia de tratamiento y conduce a reconocer este hecho fundamental, a saber que toda reaccion social frente a un acto desaprobado es una pena y que hace falta preocuparse por salvaguardar los derechos de los delin-cuentes, incluso si se pretende tratarlos. Ademas, esta concepaon conduce a admitir que toda pena es susceptible de encerrar elementos estigmatizadores. Por consiguiente, solo debieran imponerse al delincuente mas que las medidas estrictamente necesarias, por miedo a poner en marcha, en un exceso de celo, un proceso de estigmatizacion que no haria mas que acentuar las tendencias antisociales del delincuente.

Die Priifung der elementaren, spontanen sozialen Reaktion der Grup-pen auf die Verbrecher ermoglicht, zwei sehr verschiedene Arten von Strafen zu unterscheiden : die korrektive Strafe und die stigmatisierende

Strafe. Die korrektive Strafe ist eine Massregel, die sich die Anderung des kriminellen Verhaltens als Ziel setzt, und dahinwirkt, den Verbrecher in der Gruppe zu erhalten. Die stigmatisierende Strafe besteht darin, den Verbrecher zu brandmarken, und inn in dieser Weise aus der Gruppe, der er angehort, auszuscheiden. Wenn ein auf die Einwirkung seiner Gruppe empfangliches Individuum eine korrektive Strafe verbusst, wird er in aller Wahrscheinlichkeit den Erwartungen seiner Gruppe Folge leisten. Verbusst er jedoch eine stigmatisierende Strafe, so lauft er die Gefahr, die ihm zugeschrienbene kriminelle Identitat zu verinnerlichen. In diesem Falle gerat er in konflikt mit der Gruppe, und mit anderen, und erliegt der Tendenz, sich einer kriminellen Gruppe anzuschliessen, wird also ein ruckfalliger Verbercher.

Das von den Begriffen der Korrektion und des Brandmarkens hergeleitete Studium des Ruckfalls ermoglicht uns, die zwei folgenden Vorschlage zu formulieren : 1) ein auf die Einwirkung seiner Gruppe empfangliches Individuum wird um so mehr die Tendenz zum Ruckfall haben, als, eine langere Zeitspanne hindurch, die vorherrschende Reaktion seinen Verbrechen gegenuber stigmatisierender Natur sein wird. Er wird um so weniger die Tendenz zum Ruckfall haben, als die vorherrschende Reaktion seinen Verbrechen gegenuber korrektiver Natur sein wird ; 2) die Straf-rnassnahmen beeinflussen den Ruckfall nicht unmittelbar, sondern durch die Vermittlung der elementaren sozialen Reaktion. Die Strafmassnahmen losen einen Stigmatisie-rungsprozess auf der elementaren Ebene aus, und dieser Prozess beeintrachtigt die Wahrscheinlichkeit des Ruckfalls.

Die Begriffe der Korrektion und des Brandmarkens sind auch im Studium der Entwicklung der Strafmassregeln nutzlich. Sie gestatten uns, zwei andere Vorschlage darzubieten : 3) je komplizierter die Gesellschaften werden, desto weniger hat der Staat Tendenz, stigmatisierende Strafen, und desto mehr, korrektive Strafen anzuwenden ; 4) die Einkerkerung ist eine Strafe, die sich in einer Ubergangsperiode entwickelt hat, wahrend der die stigmatisierenden Strafen ihre Wichtigkeit zunutzen der korrektiven Strafen einbussten. Sie ist eine gemischte Massregel, die versucht, einen Kompromiss zwischen der Stigmatisierung und der Korrektion durchzufuhren. Da sie unvereinbare Elemente enthalt, wird die Einberkerung gegebenenfalls ausser Gebrauch kommen.

Im Bereich der Handlung erlaubt die Unterscheidung korrektive Strafe-stigmatisierende Strafe die im Rahmen der aktuellen Ideologie der Behandlung unuberwindlich scheinenden Schwierigkeiten zu losen. Sie leitet zur Erkenntnis des grundlegenden Faktums, laut dem jede soziale Reaktion einem missbilligten Akt gegenuber eine Strafe bedeutet, und dass man danach trachten soll, die Rechte des Verbrechers zu schutzen und zu bewahren, auch dann, wenn man behauptet, ihn zu behandeln. Ausserdem fuhrt diese Auffassung zur Erkenntnis, dass jede Strafe stigmatisierende Elemente enthalten kann. Man sollte also dem Verbrecher nur die aller-notwendigsten Massregeln auferlegen, um in einem Ubermass von Eifer keinen stigmatisierenden Prozess auszulosen, einen Prozess, der bloss die antisozialen Tendenzen des Verbrechers hervoheben wurde.

INFLUENCE DE LA JUSTICE CRIMINELLE SUR L'INTEGRATION NORMATIVE

Ce document est separe en trois parties : 1) la theorie de la peine ; 2) l'aspect psychologique de l'integration normative ; 3) l'aspect sociologique de l'integration normative. Il trace les grandes lignes des propositions suivantes.

1. L'ordre social engendre l'anomie, si la structure sociale et la conscience sociale dominante ne correspondent pas au degre de developpement de la societe.

2. L'anomie affecte la societe dans son ensemble, mais l'intensite du processus anomique varie selon les divergences entre les interets d'une strate sociale particuliere et les interets representes par la justice criminelle.

3. Le processus anomique demontre la necessite du changement dans la structure normative de la societe. Il ne reussit pas cependant a faire la difference entre les normes socialement utiles et celles qui ne le sont pas.

4. La structure sociale normative dominante est un systeme fortement articule. Comme tel il ne peut changer que dans son ensemble et non pas de facon partielle. Le choix doit etre fait, soit de la defendre comme un tout, ou de ne pas la defendre du tout.

5. La structure normative, a ce moment doit etre defendue en tant que tout, particulierement parce que le processus anomique l'attaque en tant que tout.

6. Le droit penal influence les sentiments collectifs a travers la peine. Plus le sentiment collectif est intense plus il est renforce par la punition. Si cette intensite n'est pas assez forte, la peine ne fera que dissimuler l'anomie ou meme catalysera le processus anomique.

7. L'influence de la peine n'est pertinente qu'en fonction des citoyens qui respectent les lois, parce que c'est la que le sentiment collectif est suffisamment intense.

8. Le manque d'identification au systeme normatif dominant a affecte la theorie sociale et ceux qui sont charges de faire respecter la loi. Cette tendance liee a la concentration de l'attention sur des delinquants, produit ou tend a produire une application de la justice criminelle moralement neutre.

9. Si nous voulons que la peine ait une influence positive sur l'integration normative, si nous voulons que la peine soutienne le sentiment collectif il faudrait que sa connotation morale soit preservee.

10. Toutefois, la peine n'est pas une solution au probleme de l'anomie. Dans le systeme de justice actuel, elle peut le diriger vers differents secteurs de la vie sociale ou le forcer a changer. Devant les besoins toujours plus grands de changement des valeurs et structures sociales, ses buts devraient etre de defendre les valeurs sociales de base qui expriment les besoins de la societe entiere. Cependant elle ne peut defendre ces valeurs qu'en defendant le systeme normatif dans son entier, l'anomie ne pouvant se developper dans certains secteurs sans affecter les points vitaux de la structure normative.

11. En consequence l'application de la justice criminelle aura necessairement un effet ambivalent : elle intensifiera l'integration normative de certaines normes a l'interieur de certains secteurs de la societe, et en meme temps elle augmentera Panomie de certaines normes dans d'autres strates sociales.

DERECHO PENAL Y SU INFLUENCIA SOBRE LA INTEGRACION NORMATIVA

Este articulo esta dividido en tres secciones : 1) teoria de la punicion ; 2) aspectos psicologicos de la integracion normativa ; 3) aspectos sociologicos de la integracion normativa. Sus grandes Hneas corresponden a las propuestas siguientes :

1. El orden social engendra la anomia si la estructura social y la con-ciencia social dominante no corresponden al estado de desarrollo de la sociedad.

2. La anomia afecta a la sociedad considerada como un todo, pero la intensidad del proceso anomico varia segun la discrepancia entre los intereses de un estrato particular de la sociedad y los que representa el derecho penal.

3. El proceso anomico indica la necesidad de cambio en la estructura normativa de la sociedad, pero no permite, sin embargo, diferenciar las normas socialmente utiles y las que no lo son.

4. La estructura normativa dominante de la sociedad es un sistema alta-mente articulado y, como tal, no puede cambiar parcialmente sino como un conjunto. Hay que escoger, pues, entre defenderlo como un todo o no defenderlo.

5. Por consiguiente, la estructura normativa debe defenderse como un todo, especialmente porque el proceso anomico la ataca como un todo.

6. Por lo que se refiere a la punicion, el derecho penal ejerce una in-fluencia sobre los sentimientos colectivos. La punicion refuerza dichos senti-mientos en la medida en que estos poseen un nivel de intensidad suficiente. Si el nivel de intensidad no es suficiente, la punicion solo reducira la visibi-lidad de la anomia o actuara como catalizador del proceso anomico.

7. Por consiguiente, la influencia del castigo dependera en primer lugar de las expectativas legales de la poblacion, ya que es aqui donde los sentimientos colectivos son suficientemente intensos.

8. La ausencia de identificacion con el sistema normativo predominante ha afectado a la teoria social y a los organismos que aplican el derecho penal. Esta tendencia, junto a la concentracion de atencion respecta al delincuente, ha producido o tiende a producir una aplicacion moralmente neutra del derecho penal.

9. Si se quiere que la punicion ejerza una influencia positiva sobre la integracion normativa, si se desea que el castigo sostenga o refuerce los sentimientos colectivos, debe preservarse la connotacion moral del castigo.

10. Sin embargo, la punicion no es la solucion al problema de la anomia. En un sistema de justicia formai, puede canalizarla a traves de diversas areas de la vida social u obligarla a adoptar una forma diferente. En la situacion de necesidad de cambio de la estructura y valores sociales, que avanzaria pro-gresivamente, su finalidad debe ser la defensa de los valores sociales basicos que representan las necesidades de la sociedad considerada como un conjunto. Sin embargo, puede defenderlas unicamente defendiendo el sistema normativo considerado como un todo, ya que la anomia no puede desarrollarse en diversas areas sin afectar a los centras vitales de la estructura normativa.

11. Por consiguiente, la aplicacion del derecho penal tendra necesaria-mente un efecto ambivalente : intensificara la integracion normativa de algunas normas en determinados estratos de la sociedad y al mismo tiempo reforzara la anomia de otras normas en otros estratos de la misma sociedad.

EINFLUSS UBER NORMATIVER INTEGRATION

Die Arbeit ist in drei Teile untergliedert : 1) die Theorie der Strafe ; 2) Psychologische Aspekte normativer Integration ; 3) Soziologische Aspekte normativer Integration. Folgende Thesen werden untersucht.

1. Die Gesellschaftliche Ordnung erzeugt Anomie, wenn die gesellschaftliche Struktur und das herrschende gesellschaftliche Gewissen nicht der Entwiclungsstufe der Gesellschaft entsprenchen.

2. Die Anomie beeintrachtigt die Gesellschaft als ganzes ; ihre Intensitat jedoch andert sich je nach dem Spannungsverhaltnis zwischen den Interessen der besonderen Interessenschicht in der Gesellschaft und den Interessen, die im Strafrecht reprasentiert werden.

3. Anomische Prozesse weisen auf die Notwendigkeit, die gesellschaftliche Struktur zu andern. Sie vermogen jedoch nicht zwischen solchen Normen, die von sozialen Nutzen sind und solchen, die es nicht sind, zu unterscheiden.

4. Die normative Struktur einer Gesellschaft ist ein System inten-siver Interdependent. Demnach kann es nur vollkommen sich andern und nicht in Einzelteilen. Die Entscheidung ist zu treffen, ob es als ganzes zu verteidigen ist oder ob es iiberhaupt nicht verteidigenswert ist.

5. Die normative Struktur ist demgemaQ als ganzes zu verteidigen, insbesondere da die anomischen Prozesse sie als ganzes angreifen.

6. Strafrecht ubt iiber die Strafe EinfluS auf kollektive Gefiihle aus. Strafrecht bestarkt kollektive Gefiihle insoweit als sie von geniigender Intensitat sind. Wenm die Intensitatsstufe nicht hoch genug ist, kann die Bestrafung nur entweder die Sichtbarkeit der Anomie verringern oder sogar die anomischen Prozesse als Katalysator vergrogern.

7. Der Einflufi der Bestrafung ist damit von Bedeutung im wesen-tliche im Verhaltnis zur rechstreuen Bevolkerung, da dort die kollektiven Gefiihle ausreichend intensiv sind.

8. Gesellschaftstheorie und die Behorden, die das Strafrecht anwen-den und durchsetzen, identifizieren sich in geringem Umfang mit dem vor-herrschenden normativen System. Diese Tendenz, verbunden mit der Bli-ckrichtung auf den individuellen Rechtsbrecher, hat bewirkt — oder bewirkt — eine Anweodung des Strafrechts, die moralisch neutral ist.

9. Wenn die Strafe einen positiven Einflug auf die normative Integration haben soil, wenn die Strafe die kollektiven Gefiihle erhateen oder in ihrer Intensitat erweitern soil, mug der moralise Aspekt der Strafe erhalten bleiben.

10. Bestrafung ist jedoch keine Losung fiir das Problem der Anomie. In einem system formaler Gerechtigkeit kann es die Anomie in ver-schiedene Bereiche gesellschaftlichen Lebens treiben oder sie veranlassen, verschiedene Formen anzunehmen. In einer Situation in der das Bediirfnis nach einer Anderunge der Struktur von Gesellschaft und Werten zuneh-mend wachst, mu6 dar Zweck der Strafe es sein, die Grundwerte zu verteidigen, die Bediirfnisse der Gesamtgesellschaft ausdriicken. Die Strafe kann sie jedoch nur verteidigen, in das ganze normative System als solches verteidigt wird, da Anomie sich nicht in einigen Bereichen entwickeln kann, ohne die Lebens nerven der normativen Struktur zu beeintrachtigen.

11. Dementsprechend wird die Anwendung und Durchsetzung des Strafrechtes eine zweischneidige Wirkung haben : es wird die normative Integrationswirkung fiir manche Vorschriften innerhalb bestimmter sozialer Schichten vergroftern und es wird gleichzeitig in anderen Schichten die Anomie in Bezug auf andere Normen erweitern.

SOCIAL REACTION TO DEVIANCE : AN EXPLORATORY STUDY

The object of this exploratory study is to analyse social reactions to deviance by endeavouring to show some of the mechanisms of these re-

actions. To do this, we have isolated deviant behaviour from its situational elements in order to study the fluctuations of reactions according to the nature of the deviance, and according to the categories of those reacting to the deviance.

The instrument of measurement is a questionnaire which was administered to a random sample for pre-testing. This sample was drawn from the metropolitan region of Montreal. The data analysis is concerned with the degree of generality, consensus, consistency and contingency of reactions in terms of the nature of the deviant behaviour.

The results showed the reactions to be surprisingly general. The regularity of the continuum drawn by the indices of contingency and those of strictly punitive consensus was remarkable.

This exploratory study gives interested researchers information on crime-deviance continuums and social reactions to deviance. The continuum of social reactions is clearly defined, and this gives us reason to believe it would be possible to introduce an order of importance in the evaluation of social reactions.

REACCION SOCIAL FRENTE A LA CONDUCTA DESVIADA : UN ESTUDIO EXPLORATORIO

El objeto de este estudio exploratorio es analizar las reacciones sociales frente a la conducta desviada ; con este fin, se intentara descomponer parte de los mecanismos de dichas reacciones. Para ello, se ha aislado la conducta desviada de sus elementos situacionales con vistas a estudiar las fiuctuaciones de la reaccion segun la naturaleza de la desviacion por una parte y las categorias de la audiencia por otra.

El instrumento de medida es un cuestionario que ha sido administrado a una muestra aleatoria de pre-test seleccionada en la region metropolitana de Montreal. El analisis de los datos se refiere al grado de generalidad, consenso, consistencia y contingencia de la reaccion, en funcion de la naturaleza de la conducta desviada.

Entre los resultados, sorprende la generalidad de las reacciones. Tam-bien conviene subrayar la regularidad de los continues determinados por los indices de contingencia y consenso formai punitivo.

Este estudio exploratorio contribuye a esclarecer a los investigadores in-teresados por los continuos desviacion-criminalidad y por las reacciones sociales frente a la conducta desviada. Efectivamente, el continuo de dichas reacciones sociales aparece con toda claridad, lo cual permite creer en la pqsibilidad de introducir un orden de magnitud en la evaluacion de la reaccion social.

SOZIALE REAKTIONEN AUF DAS ABWEICHENDE VERHALTEN : EIN ERFORSCHENDES STUDIUM

Das Objektiv dieses untersuchenden Studiums ist die Analyse der sozialen Reaktionen auf das abweichende Verhalten, indem es versucht, einen Teil der Mechanismen dieser Reaktionen zu zerlegen. Zu diesem Zweck haben wir das abweichende Verhalten von seinen situationnellen Elementen isoliert, um die Schwankungen der Reaktionen in ihrer Abhan-gigkeit von der Natur der Abweichung einerseits, und nach den Audienz-kathegorien andrerseits, zu studieren.

Das Massinstrument ist ein Fragebogen, der einem zufallig ausge-wahlten Pra-Test Muster verabreicht wurde. Diese Probe wurde der metro-politanen Gegend von Montreal entnommen. Die Datenanalyse betrifft den

Grad von Generalitat, Konsens, Konsistenz und Kontingenz der Reaktionen in Abhangigkeit von der Natur des abweichenden Verhaltens.

Unter diesen Ergebnissen scheint die Allgemeinheit uberraschend zu sein. Die Regelmassigkeit des Kontinuums, gezeichnet von den Kontingen-zindizien, und desjenigen gezeichnet von den formellen Straf-Konsensin-diziem ist bemerkenswert.

Dieses erforschende Studium tragt dazu bei, interessierte Forscher uber das Kontinuum abweichendes Verhalten-Kriminalitat und der sozialen Reaktionen auf die Abweichung aufzuklaren. Tatsachlich tritt das Kontinuum der sozialen Reaktionen klar hervor, und diese Feststellung erlaubt uns anzunehem, dass es moglich ist, ein Grossenmass in die Wertung der sozialen Reaktionen einzufuhren.

«THE HIDDEN DIMENSION : THE CIRCULAR INDEX» AN INTRODUCTION TO RE-EDUCATION PROGRAMS WITHIN THE COMMUNITY

It was in seeking to define and operationalize the prevention of juvenile delinquency that we discovered the circular index. First we will describe the method we followed in a clinical experiment and study on the marginal adolescent as he interacts with his school environment. Then we discuss our new understanding. Instead of seeing the social reality piecemeal, we saw it as a whole. There always seems to be a greater and greater distance between the evaluation in the form of detection, psycho-social and criminological evaluation and the supportive programs we are trying to elaborate and apply for reeducation within the community.

The nosographic school is represented by the work of Hochman (1971). He asks whether this school has not reached its limits; he doubts its descriptive and prescriptive value. Nonetheless, we ask him to give us time, for to answer categorically in the affirmative can have grave consequences for a country or a province. While agreeing that our clinical and research theory belongs to a part of the nosographical school, it is not so much its descriptive and prescriptive value that is in question as the relationship between the two entities.

This is why we are making a brief inventory of the outside restraints on our own clinical thinking. Among these, there is the lack of time available to the practitioner, his lack of resources, his inability to refer to the past, the difficulty of sharing his experience with that of others in a scientific manner, the mobility and uncertainty of the practitioner, etc.

Second, we raise a number of restraints which are part of the clinical thinking of the practitioner. Two general types of restraints are described. The first refers to the different theoretical frames of reference of the practitioner, the second particularly concerns his work methods.

Third, we place the linear index against the circular index. The linear index is defined as any evidence by which the first characteristic questions the individual's relations with abstract entities. The circular index is defined as any evidence attributed to an individual in relation to systems and groups. As to the systematizing of the circular index, we will have to wait another few months. Nevertheless, an example of the circular index is given through the study of a negative gang in the neighbourhood.

The last part of the article deals with palliatives that can be used to reduce internal and external restraints on the clinical thinking and can but encourage this dialectic between the descriptive and prescriptive elements of the nosographic school. Among these palliatives, there is an urgent need to make an inventory of circular indices, to put them in order and to find the best methods to obtain them. In addition, a clinical table_mjist be constructed connecting the different resource items the practitioner needs to apply various supportive programs within the community once the accent is placed on rehabilitation, socialization and or the clinical prevention of the behaviour, and or the structure of the marginal personality.

As a last palliative, we describe a way in which we give the client the evaluation we have made of him, explaining to him his behavioural and psychodynamic profile. For us, the aim of this last palliative is not only to evince greater respect for the client, but also to recognize his potential participation in his own program of treatment.

EL INDICE CIRCULAR

ENSAYO SOBRE LA REEDUCACION EN MEDIO LIBRE

El autor cree haber descubierto el indice circular al intentar definir y operacionalizar la prevencion de la delincuencia juvenil. Describe, en la primera parte de su trabajo, el itinerario seguido gracias a una experiencia a la vez clinica y de investigacion, la cual ha puesto en inter-accion al adolescente marginal con su medio escolar. Enseguida se llega a la fase de la explosion. A una vision hasta entonces dividida de la realidad social, el autor opone una vision global de la misma. A su parecer, existe siempre una distancia cada vez mas grande entre la parte evaluativa — en forma de deteccion y evaluacion psicosocial y criminologica — y los programas de sosten que se intentan elaborar y aplicar en medio libre.

Refiriendose a Hochman (1971), el autor descubre la razon nosografica. Hochman se pregunta si esta razon no esta caduca y duda de su valor descriptivo y prescriptivo. Sin embargo, el autor pide se aplace este debate puesto que contestar categoricamente por una afirmacion puede tener consecuencias enormes para un pais. Admitiendo que el racional clinico y de investigacion utilizado pertenece a la razon nosografica, el autour pone en tela de juicio menos el valor descriptivo y prescriptivo de dicha razon nosografica que la relacion existente entre estas dos entidades.

De esta manera consigue realizar un inventario, que no pretende ser completo, de las limitaciones exteriores al racional clinico. Entre estas pueden citarse : la falta de tiempo de que dispone el especialista, la carencia de recursos puestos a su disposicion, la imposibilidad de efectuar retrospecciones, la dificultad de compartir de manera cientifica su experiencia con la de otros, la mobilidad e inestabilidad del especialista, etc.

En una segunda etapa, el autor expone algunas limitaciones pertenecientes al racional clinico del especialista y describe dos grandes categorias de limitaciones : la primera se refiere a los diferentes marcos teoricos de referencia del especialista, la segunda concierne particularmente los metodos de trabajo del mismo.

En una tercera fase, el autor opone los indices lineal y circular. Define el primero como todo signo cuya principal propiedad consiste en presentar al individuo en sus relaciones con entidades abstractas. En cuanto al indice circular, es definido como todo signo atribuido a un individuo en relacion con sistemas y conjuntos. Por lo que se refiere a la sistematizacion del indice circular, habra que esperar aun varios meses. Sin embargo, presenta un ejemplo de dicho indice a partir del estudio de una banda negativa del barrio.

La ultima parte del articulo se refiere a los paliativos que pueden ser utilizados con vistas a reducir las limitaciones internas y externas del racional clinico y que solo pueden favorecer la dialectica entre las partes descriptiva y prescriptiva de la razon nosografica. Entre dichos paliativos figuran la urgencia de efectuar un inventario de los indices circulares, de sistematizarlos, de descubrir los mejores metodos para obtenerlos. Ademas, es urgente construir un cuadro clinico que ponga en relacion las diferentes unidades de recursos que el especialista necesita para elaborar y aplicar diferentes programas de sosten en medio libre, segun que se insista en la reeducacion, la socializacion o la prevencion clinica de la conducta o de la estructura de la personalidad marginal.

Como ultimo paliativo, el autor describe un metodo utilizado para devolver al cliente la evaluacion que sobre el se ha efectuado, explicandole su perfil comportamental y psicodinamico. Este ultimo paliativo tiende no solamente a respetar mas al cliente, sino tambien a reconocerle un potential de participacion en su proprio programa de tratamiento.
