Abstract

TWO TYPES OF PUNISHMENT

AND THEIR EFFECT ON THE CRIMINAL

The examination of the immediate, spontaneous social reaction of groups towards deviants makes it possible to distinguish two very different types of punishment : corrective and stigmatizing. Corrective punishment is a measure intended to change the behaviour of a delinquent and to maintain him within the group. Stigmatizing punishment consists of attaching a dishonourable label to the delinquent and rejecting him from the group to which he belongs. When a person who is receptive to the influence of his group undergoes corrective punishment, his most probable reaction will be to conform to the expectations of his group. But if he is subjected to stigmatizing punishment, there is a possibility that he will interiorize the criminal identity attributed to him. He will then enter into conflict with the group and with others, and will tend to become integrated into a criminal group and become a recidivist criminal.

A study of recidivism, conducted on the basis of concepts of correction and stigmatization, makes it possible to formulate the following two propositions : 1) an individual who is easily influenced by his group will have a greater tendency to recidivate if, over a substantial period of time, the predominant reaction to his offenses is one of stigmatization. He will have less of a tendency to recidivate if the predominant reaction to his offenses is corrective ; 2) penal measures influence recidivism, not directly, but through the agency of the immediate social reaction. The penal measures start a process of stigmatization from the outset, which has an effect on the probability of recidivism.

The concepts of correction and stigmatization are also useful in the study of the evolution of penal measures. They make two other propositions possible : 3) the more complex societies become, the less the State tends to resort to stigmatizing punishment and the more it resorts to corrective punishment ; 4) imprisonment is a punishment which was developed during a period of transition during which stigmatizing punishment was losing out in favour of corrective punishment. It is a mixed measure which attempts to reach a compromise between stigmatization and correction. Because it contains elements that are incompatible, the prison will eventually fall into disuse.

At the level of action, the distinction between corrective punishment makes it possible to resolve seemingly insurmountable difficulties within the framework of the present ideology of treatment. It leads to the recognition of this basic fact, that all social reaction to an act that is disapproved of is a punishment, and care must be taken to safeguard the rights of the

delinquent, even when we claim to be treating him. Furthermore, this concept leads to the admission that all punishment is liable to contain elements of stigmatization. Only measures that are strictly necessary should therefore be applied to the delinquent, for fear of releasing, in an excess of zeal, a process of stigmatization that will only accentuate the delinquent's anti-social tendencies.

El examen de la reaccion social elemental, espontanea de los grupos contra la conducta desviada permite distinguir dos modalidades diferentes de penas : la pena correctiva y la pena estigmatizadora. La primera es una medida destinada a modificar la conducta de un delincuente y a mantenerlo en el grupo ; la segunda consiste en atribuir una etiqueta infamante al delincuente y expulsarlo del grupo a que pertenece. Cuando un individuo receptivo a la influencia de su grupo recibe una pena correctiva, su reaccion mas probable sera la de con-formarse a las expectativas de su grupo. En cambio, si recibe una pena estigmatizadora, corre el riesgo de interiorizar la identidad criminal que se le atri-buye ; entonces, entrara en conflicto con el grupo y con los demas, tendera a intergrarse en un grupo delincuente y se convertira en un criminal reincidente.

El estudio de la reincidencia realizado a partir de los conceptos de correccion y estigmatizacion permite formular las proposiciones siguientes : 1) un individuo receptivo a la influencia de su grupo tendra tanto mayor tendencia a reincidir cuanto, durante un lapso substancial de tiempo, la reaccion predominante frente a sus delitos sea estigmatizadora y tanto menor tendencia a reincidir cuanto la reaccion predominante a sus delitos sea correctiva ; 2) las medidas penales influencian la reincidencia, no directamente, sino por intermedio de la reaccion social elemental. Las medidas ponen en movimiento un proceso de estigmatizacion en el piano elemental, el cual ejerce cierta influencia en la probabilidad de reincidencia.

Los conceptos de correccion y estigmatizacion son tambien utiles para el estudio de la evolucion de las medidas penales. Dichos conceptos permiten anunciar las proposiciones siguientes : 3) a medida que las sociedades se vuel-ven mis complejas, el Estado tiende cada vez menos a recurrir a penas estig-matizadoras y cada vez mas a utilizar penas correctivas ; 4) el encarcelamiento es una pena que se ha desarrollado en un periodo de transicion durante el cual las penas estigmatizadoras perdian importancia en provecho de las penas correctivas. Se trata de una medida mixta que intenta realizar un compromiso entre la estigmatizacion y la correccion. Dado que lleva consigo elementos incompatibles, la pena de prision caera eventualmente en desuso.

En el piano de la accion, la distincion entre pena correctiva y estigmatizadora permite resolver ciertas dificultades que parecen insuperables en el marco de la actual ideologia de tratamiento y conduce a reconocer este hecho fundamental, a saber que toda reaccion social frente a un acto desaprobado es una pena y que hace falta preocuparse por salvaguardar los derechos de los delin-cuentes, incluso si se pretende tratarlos. Ademas, esta concepaon conduce a admitir que toda pena es susceptible de encerrar elementos estigmatizadores. Por consiguiente, solo debieran imponerse al delincuente mas que las medidas estrictamente necesarias, por miedo a poner en marcha, en un exceso de celo, un proceso de estigmatizacion que no haria mas que acentuar las tendencias antisociales del delincuente.

Die Priifung der elementaren, spontanen sozialen Reaktion der Grup-pen auf die Verbrecher ermoglicht, zwei sehr verschiedene Arten von Strafen zu unterscheiden : die korrektive Strafe und die stigmatisierende

Strafe. Die korrektive Strafe ist eine Massregel, die sich die Anderung des kriminellen Verhaltens als Ziel setzt, und dahinwirkt, den Verbrecher in der Gruppe zu erhalten. Die stigmatisierende Strafe besteht darin, den Verbrecher zu brandmarken, und inn in dieser Weise aus der Gruppe, der er angehort, auszuscheiden. Wenn ein auf die Einwirkung seiner Gruppe empfangliches Individuum eine korrektive Strafe verbusst, wird er in aller Wahrscheinlichkeit den Erwartungen seiner Gruppe Folge leisten. Verbusst er jedoch eine stigmatisierende Strafe, so lauft er die Gefahr, die ihm zugeschrienbene kriminelle Identitat zu verinnerlichen. In diesem Falle gerat er in konflikt mit der Gruppe, und mit anderen, und erliegt der Tendenz, sich einer kriminellen Gruppe anzuschliessen, wird also ein ruckfalliger Verbercher.

Das von den Begriffen der Korrektion und des Brandmarkens hergeleitete Studium des Ruckfalls ermoglicht uns, die zwei folgenden Vorschlage zu formulieren : 1) ein auf die Einwirkung seiner Gruppe empfangliches Individuum wird um so mehr die Tendenz zum Ruckfall haben, als, eine langere Zeitspanne hindurch, die vorherrschende Reaktion seinen Verbrechen gegenuber stigmatisierender Natur sein wird. Er wird um so weniger die Tendenz zum Ruckfall haben, als die vorherrschende Reaktion seinen Verbrechen gegenuber korrektiver Natur sein wird ; 2) die Straf-rnassnahmen beeinflussen den Ruckfall nicht unmittelbar, sondern durch die Vermittlung der elementaren sozialen Reaktion. Die Strafmassnahmen losen einen Stigmatisie-rungsprozess auf der elementaren Ebene aus, und dieser Prozess beeintrachtigt die Wahrscheinlichkeit des Ruckfalls.

Die Begriffe der Korrektion und des Brandmarkens sind auch im Studium der Entwicklung der Strafmassregeln nutzlich. Sie gestatten uns, zwei andere Vorschlage darzubieten : 3) je komplizierter die Gesellschaften werden, desto weniger hat der Staat Tendenz, stigmatisierende Strafen, und desto mehr, korrektive Strafen anzuwenden ; 4) die Einkerkerung ist eine Strafe, die sich in einer Ubergangsperiode entwickelt hat, wahrend der die stigmatisierenden Strafen ihre Wichtigkeit zunutzen der korrektiven Strafen einbussten. Sie ist eine gemischte Massregel, die versucht, einen Kompromiss zwischen der Stigmatisierung und der Korrektion durchzufuhren. Da sie unvereinbare Elemente enthalt, wird die Einberkerung gegebenenfalls ausser Gebrauch kommen.

Im Bereich der Handlung erlaubt die Unterscheidung korrektive Strafe-stigmatisierende Strafe die im Rahmen der aktuellen Ideologie der Behandlung unuberwindlich scheinenden Schwierigkeiten zu losen. Sie leitet zur Erkenntnis des grundlegenden Faktums, laut dem jede soziale Reaktion einem missbilligten Akt gegenuber eine Strafe bedeutet, und dass man danach trachten soll, die Rechte des Verbrechers zu schutzen und zu bewahren, auch dann, wenn man behauptet, ihn zu behandeln. Ausserdem fuhrt diese Auffassung zur Erkenntnis, dass jede Strafe stigmatisierende Elemente enthalten kann. Man sollte also dem Verbrecher nur die aller-notwendigsten Massregeln auferlegen, um in einem Ubermass von Eifer keinen stigmatisierenden Prozess auszulosen, einen Prozess, der bloss die antisozialen Tendenzen des Verbrechers hervoheben wurde.
