Cet article examine l'histoire de la culture juridique québécoise depuis les années 1840 jusqu'à aujourd'hui. la transformation de ses moyens et de ses rapports de communication. On y montre que la culture des années 1840 était encore à prédominance orale, et que la tradition orale dans l'organisation du savoir, à savoir la rhétorique et le débat, persista, malgré la codification des lois du Bas-Canada en 1866. jusqu'au XX" siècle. Durant les années 1920. par contre, on insista plutôt sur l'analyse et l'exégèse, la logique de l'écriture (et de la codification) ayant finalement été intériorisée par le corps judiciaire. Cette intériorisation eut un impact énorme sur le contenu du système juridique, comme le suggère l'ouvrage de J. Goody.The Domestication of the Savage Mind.

Abstract

The Domestication of the Québec Legal Mind

This essay examines the history of Québec legal culture from the 1840s to the present from the perspective of the transformations in its means and relations of communication. It is shown that in the 1840s the culture was still predominantly oral, and that the oral tradition in the organization of knowledge - e.g. rhetoric and disputation - persisted, despite the codification of the laws of Lower Canada in 1866. into the twentieth century. In the 1920s the emphasis shifted to analysis and exegesis, the logic of writing (and codification) having finally been interiorized by the legal corps. This interiorization had a massive impact on the content of the legal system, as the work of J. Goody, particularly The Domestication of the Savage Mind, would lead one to expect.
