Résumé
À beaucoup d'égards, la loi française du 5 juillet 1985 tendant à l'amélioration de la situation des victimes d'accidents de la circulation restera, dans l'histoire du droit français, comme une curiosité sans doute unique en son genre. Le législateur, persuadé qu'il était de procéder à une simple réforme du régime de responsabilité existant, ne s'est pas aperçu qu'il instituait un régime d'indemnisation sans égard à la responsabilité. La Cour de cassation, de son côté, a vu, dès l'origine, que le nouveau régime n'était plus celui de la responsabilité, mais ensuite il lui a fallu une dizaine d'années pour enfin découvrir ce qu'il était. Si bien qu'au cours de cette période, nous avons eu une jurisprudence erratique, oscillant entre les deux régimes.
C'est cette longue marche que se propose de narrer l'auteur du texte qui suit.
Abstract
In many ways the French Statute of July 5,1985 respecting an improvement in the situation of victims of road accidents will go down in the history of French law as a curiosity uniquely one of its kind. The Legislator, convinced that he was undertaking a simple reform of existing liability, did not realize that he was actually in the process of implementing a no-fault indemnification system. The Cour de Cassation realized from the outset that the new system was no longer one of liability, but that same court then took ten years to discover exactly what the system had become. As a result, we experienced an indecisive period where case law ricocheted from one system to the other and back again.
It is this drawn out settling of case law that the reporter proposes to narrate.
