Le Code civil catalan : choix, finalités et transplantations législatives du Code civil québécois

Résumé

Après la description du processus de codification du droit civil en Catalogne, l’auteure s’intéresse à la transposition juridique de certaines institutions du Code civil québécois dans le nouveau Code civil catalan. La réception de celui-ci est plutôt partielle, par rapport à des institutions déterminées ou bien à la philosophie qui les inspire et, sans aucun doute, dans la plupart des cas, l’importation s’adapte à la vision du législateur catalan. L’auteure s’attache spécialement au cas de l’adoption de la disposition préliminaire ainsi qu’à la perspective d’implantation de la fiducie et de l’administration du bien d’autrui. Dans le domaine du droit de la personne, elle souligne que d’autres emprunts seraient souhaitables.

Abstract

Following a description of the codification process of civil law in Catalonia, the author turns her attention towards the legal transposition of certain institutions found under the Civil Code of Québec into the new Catalan Civil Code. Integration under the Catalan Civil Code remains somewhat incomplete considering the specific institutions or philosophical grounds that inspire them and, doubtless to say, remains limited in most cases since such importing adapts itself to the Catalan legislator’s vision. The author focuses specifically on the adoption of the preliminary provision as well as a perspective for implementing the trust and the administration of the property of others. In the field of the law of persons, she emphasizes that other borrowings would be advantageous.
