Le droit nouveau proposé en matière d'assurance terrestre

Résumé

Cet article fait une analyse comparative du chapitre de l'Avant-projet sur l'assurance terrestre et des chapitres du Code civil du Bas-Canada sur le même sujet. L'analyse est en trois parties : l’intégration du droit spécial sur l'assurance en droit général des contrats, les innovations apportées au droit sur le contrat d'assurance et les clarifications du droit actuel.

La première partie traite principalement de modifications formelles : la terminologie, le réaménagement de certains articles du Code actuel et l'abrogation de certains autres.

En matière de dispositions applicables à tous les contrats d'assurance, la seconde partie traite, entre autres choses, du nouveau caractère obligatoire pour l'assureur de la totalité des dispositions du chapitre sur l'assurance, de l'adoption du critère de l'assuré raisonnable, de la présomption de représentation de l'assureur par l'agent et le courtier d'assurance. En matière de dispositions applicables à des contrats d'assurance spécifiques, cette partie discute de questions comme l'exigence d'un intérêt d'assurance pour le transport d'une police d'assurance-vie, l'entrée en vigueur de l'assurance-vie moyennant le paiement d'un acompte sur la prime, le transport de l'assurance de biens sans le consentement de l'assureur.

La troisième partie discute plus particulièrement des clarifications du droit actuel sur la notion de divergence entre la police et la proposition, l'indemnité proportionnelle, la subrogation, les déclarations mensongères et le droit d'action direct contre l'assureur.

De l'avis de l'auteur, la plupart des modifications au droit actuel visent à accentuer la protection des intérêts du consommateur d'assurance, mais elles peuvent bouleverser assez sérieusement la pratique de l'assurance, dans le domaine de l'assurance de dommages en particulier.

Abstract

This paper presents a comparative review of the Draft Bill on nonmarine insurance as well as chapters of the Civil Code of Lower-Canada on the same subject. The review is conducted under three headings : integration of the special law on insurance to the general law on contracts, innovations made to law governing the contract of insurance and clarifications to existing legislation.

The first part mainly deals with formal changes : terminology, rearrangement and abrogation of various articles in the present Code.

As for provisions of law applicable to all insurance contracts, the second part investigates a variety of topics, including the new obligatory character of the entire chapter for the insurer, the adoption of the criteria of the reasonable insured and the presumption of representation of the insurer imposed on the agent and the broker. With regard to provisions applicable to specific insurance contracts, it delves into matters such as the requirement of having an insurable interest in order for one to transfer a life insurance policy, the coming into effect of life insurance upon partial payment of the premium and the transferal of a property insurance policy without the consent of the insurer.

The third part more specifically looks into clarifications of existing law relevant to inconsistencies between the policy and the application, proportional indemnity, subrogation, deceitful representation and direct action against the insurer.

In the author's opinion, most changes to the law are aimed at increased protection of the insurance consumer's interests, but they could tend to upset present practices in insurance considerably, especially in the field of damage insurance.
