À l’occasion d’un colloque tenu à Paris les 5 et 6 novembre 2008 pour souligner le centième anniversaire de naissance de Jean Carbonnier, l’auteur a participé à une table ronde portant sur le rayonnement international de la pensée de ce dernier. Il livre dans ce texte un court essai de synthèse sur l’influence de l’oeuvre de Carbonnier au Québec et rend hommage à celui que plusieurs considèrent tel le plus grand juriste français du vingtième siècle.

L’auteur suggère que l’oeuvre d’élite du doyen Carbonnier a d’abord laissé sa marque chez les premiers professeurs universitaires de carrière des facultés de droit québécoises, au tournant des années 1960, ainsi qu’auprès de la communauté de juristes ayant travaillé à la réforme et à la recodification du droit civil québécois. Toutefois, ce sont surtout les juristes tenants d’une approche sociologique ou interdisciplinaire du droit qui forment les admirateurs les plus authentiques de la pensée de Carbonnier et les utilisateurs les plus attentionnés de ses concepts dans l’étude des rapports entre le droit et la société.

L’auteur résume par la suite trois prédispositions cognitives et normatives qui traversent l’oeuvre de Carbonnier et qui expliquent pourquoi sa pensée, teintée du chaud et du froid d’une morale d’honnête homme, a essentiellement bénéficié d’un succès d’estime auprès des juristes québécois.

Au final, l’auteur avance que l’influence la plus grande de Carbonnier réside probablement dans la fonction pédagogique de ses enseignements plutôt que dans ses écrits. En effet, le doyen Carbonnier fut avant tout un professeur, rappelant sans cesse l’importance de cultiver un regard critique et ancré dans la réalité dans l’exercice du métier de juriste.

On the occasion of a conference held in Paris on 5 and 6 October 2008 to commemorate the hundredth anniversary of the birth of Jean Carbonnier, the author participated in a round table on the international influence of Carbonnier’s thoughts. In this text, the author delivers a short essay summarizing the influence of Carbonnier’s work in Quebec, and pays homage to a man whom many consider to be the greatest French jurist of the twentieth century.

The author suggests that the sophisticated doctrinal work of Dean Carbonnier initially left its mark upon the first career professors in Quebec’s faculties of law in the early 1960s, as well as upon the community of jurists who worked on the reform and recodification of the civil law of Quebec. However, it is primarily the jurists adopting a sociological or interdisciplinary approach to the law who are the most authentic admirers of Carbonnier’s views, and who employ his concepts the most attentively in the study of the relationship between law and society.

The author then summarizes three cognitive and normative predispositions underlying the work of Carbonnier that explain why his thoughts, coloured by the sensitivity and logic of the morality of an honest man, are highly regarded but not well-known among Québécois jurists.

Finally, the author puts forward the argument that Carbonnier’s greatest influence probably rests in the pedagogic function of his teachings rather than in his writings. In effect, Dean Carbonnier was above all a professor, forever reminding us of the importance of cultivating critical thinking, anchored in the reality of the exercise of the profession of jurist.

The acquisition of property plays an important role in the federal Income Tax Act (ITA), determining eligibility for a number of tax benefits, including entitlement to capital cost allowance, investment tax credits, and the deductibility of interest expenses incurred in respect of eligible property. In spite of its importance, the concept of an acquisition of property is not defined in the ITA, and it has been subject to divergent interpretations in the common law and the civil law.

The author traces the sources of law informing the meaning of an acquisition of property in the common law and the civil law, and concludes that certain transactions may be subject to different tax consequences depending on whether they occurred in a common law province or in Quebec. The author demonstrates that the primary reference for determining whether a taxpayer acquired property—the twofold test in M.N.R. v. Wardean Drilling Ltd.—is premised on common law concepts and is incompatible with the goals of Canadian bijuralism expressed in the Federal Law—Civil Law Harmonization Act, No. 1 and section 8.1 of the federal Interpretation Act. In response to this contradiction, the author proposes a number of statutory amendments to ensure the uniform and predictable application of the ITA across Canada.

Dans la Loi de l’impôt sur le revenu (LIR), l’acquisition de bien permet de déterminer l’éligibilité à un nombre d’avantages fiscaux, notamment au droit à la déduction pour amortissement, au crédit d’impôt à l’investissement et à la déductibilité des frais d’intérêts encourus relativement au bien éligible. Malgré son importance, le concept d’acquisition de bien n’est pas défini dans la LIR et a reçu des interprétations divergentes en common law et en droit civil.

L’auteur retrace les sources de droit éclairant le sens d’acquisition de bien en common law et en droit civil. Il conclut que la réalisation de certaines transactions dans une province de common law ou au Québec peut entraîner des conséquences fiscales différentes. L’auteur démontre que la référence principale en matière de détermination d’acquisition de bien par un contribuable (le test en deux parties de l’affaire M.N.R. v. Wardean Drilling Ltd.) est basée sur des concepts de common law et est incompatible avec les objectifs du bijuridisme canadien tel qu’exprimé dans la Loi d'harmonisation n° 1 du droit fédéral avec le droit civil et dans l’article 8.1 de la Loi d’interprétation fédérale. Afin de répondre à cette contradiction, l’auteur propose un nombre d’amendements législatifs pour assurer une application uniforme et prévisible de la LIR partout au Canada.

Canada’s greenhouse gas emissions have risen dramatically since the 1997 negotiation of the Kyoto Protocol, and that rise has continued through Canada’s 2002 ratification of the Protocol. Along with economic dislocation, constitutional barriers to regulation have sometimes been cited as the reason for caution in regulating greenhouse gases. This article critically evaluates the constitutional arguments and examines the policy considerations surrounding various regulatory instruments that might be used to reduce greenhouse gases. We conclude that the Canadian constitution does not present any significant barriers to federal or provincial regulation and that policy considerations strongly favour the use of two instruments: a federal carbon tax to impose a marginal cost on emissions and the Canadian Environmental Assessment Act to review federal projects that may increase greenhouse gases.

Les émissions de gaz à effet de serre du Canada ont augmenté dramatiquement depuis les négociations du Protocole de Kyoto en 1997. Cette augmentation a continué même subséquemment à la ratification du Protocole par le Canada en 2002. En plus de la dislocation économique, les barrières constitutionnelles à la réglementation ont parfois été citées comme justification à la prudence dans la réglementation des gaz à effet de serre. Cet article évalue de manière critique les arguments constitutionnels et examine les considérations de politiques entourant les différents instruments réglementaires qui pourraient être utilisés pour réduire les gaz à effet de serre. Nous concluons que la constitution canadienne ne présente pas de barrière significative à la réglementation fédérale ou provinciale et que les considérations de politiques favorisent fortement l’utilisation de deux instruments, soit une taxe fédérale sur le carbone pour imposer un coût marginal aux émissions et la Loi canadienne sur l’évaluation environnementale pour évaluer les projets fédéraux qui pourraient augmenter les gaz à effet de serre.

The confessions rule—the requirement that the Crown prove the voluntariness of the accused’s statements to persons in authority—is a well-established rule of criminal evidence and is closely connected with the constitutional principle against self-incrimination that it structures. The confessions rule is thus a natural candidate for recognition as a principle of fundamental justice under section 7 of the Canadian Charter of Rights and Freedoms. However, there are two distinct routes by which the confessions rule might be constitutionalized. Under the “rule of evidence” approach, the confessions rule would be recognized as an aspect of the accused’s constitutional right to a fair trial. Under the “rights violation” approach, the conduct of the state in obtaining an involuntary statement would be treated as a violation of the accused’s constitutional rights.

In R. v. Singh, despite having previously adopted the “rule of evidence” approach, the Supreme Court of Canada applied the “rights violation” approach and linked the confessions rule very closely to the constitutional right to silence. In so doing, the Court conflated the distinct protections offered by the right to silence on the one hand and the confessions rule on the other, particularly when Singh is read in light of other recent cases that appear to weaken the confessions rule. Fortunately, the Court’s recent decisions concerning the confessions rule may also be read as instances of appellate deference to trial judges’ factual findings on voir dires. Thus, they leave room for the recognition that neither the right to silence nor the confessions rule is reducible to the other, and that each has a distinct role to play: the right to silence protects the accused’s decision to speak at all, while the confessions rule concerns the accused’s motivations for speaking as he or she did.

La règle des confessions, qui requiert que la Couronne prouve le caractère volontaire des déclarations de l’accusé aux autorités, est une règle de preuve bien établie en droit criminel. Elle lie et structure le principe constitutionnel empêchant l’accusé de s’incriminer. La règle des confessions pourrait donc être reconnue comme principe de justice fondamentale en vertu de l’article 7 de la Charte canadienne des droits et libertés. La règle des confessions pourrait être constitutionnalisée de deux manières distinctes. Selon une approche insistant sur les règles de preuve, la règle des confessions serait reconnue comme composante du droit constitutionnel de l’accusé à un procès équitable. Selon une approche insistant sur la violation des droits, la conduite de l’État dans l’obtention d’une déclaration involontaire serait traitée comme une violation des droits constitutionnels de l’accusé.

Dans R. c. Singh, bien qu’elle ait auparavant adopté l’approche des règles de preuve, la Cour suprême du Canada a appliqué l’approche de la violation des droits et a fermement rattaché la règle des confessions au droit constitutionnel au silence. Ce faisant, la Cour a fusionné les protections distinctes offertes par le droit au silence et par la règle des confessions, particulièrement lorsque l’affaire Singh est interprétée à la lumière d’autres décisions récentes qui semblent affaiblir la règle des confessions. Heureusement, les décisions récentes de la Cour concernant la règle des confessions peuvent aussi être vues comme des exemples de déférence des instances d’appel envers les conclusions de faits des juges de première instance relativement à des voir-dires. Ainsi, il est encore possible d’affirmer que le droit au silence et la règle des confessions ne sont pas réductibles l’un à l’autre et ont chacun un rôle distinct à jouer. Le droit au silence protège la décision de l’accusé de parler ou non, alors que la règle des confessions concerne ses motifs d’avoir parlé tel qu’il l’a fait.

Le droit à l’information des personnes placées sous garde en établissement est porteur d’enjeux juridiques et sociaux importants. En tant que droit reconnu par la Charte des droits et libertés de la personne et également en tant que condition essentielle à l’exercice d’autres droits fondamentaux, le droit à l’information permet la promotion des valeurs de citoyenneté et la mise en place d’une procédure transparente de reconnaissance et de mise en oeuvre des droits.

Malgré une existence formelle, tant en droit international qu’en droit interne, l’auteure démontre que la concrétisation du droit à l’information pose de nombreuses difficultés. Elles trouvent notamment leurs sources dans l’économie de la loi et dans la procédure, mais également dans le rapport problématique entre les systèmes psychiatrique et juridique. Cette négation factuelle des droits fondamentaux a pour répercussion la constitution d’une classe de citoyens à part, dont l’exclusion sociale et la stigmatisation contribuent à la perpétuation d’un statut marginal, en dehors du projet social commun.

The right to information of persons placed under confinement in institutions raises important legal and social issues. As a right recognized by the Charter of human rights and freedoms and as an essential condition to the exercise of other fundamental rights, the right to information allows both the promotion of the values of citizenship and the implementation of a transparent procedure for the recognition and enforcement of rights.

Despite its formal existence in international and domestic law, the author demonstrates that the materialization of the right to information poses many difficulties, arising mainly from the economy of law and from procedure, but also from the problematical relationship between the judicial and psychiatric systems. This factual negation of fundamental rights has the consequence of creating an isolated class of citizens whose social exclusion and stigmatization contribute to the perpetuation of a marginal status outside the common social project.
