My traditional name is YELḰÁTŦE, which I received from my late maternal grandfather, Earl Claxton Sr. I am WSÁNEĆ (Saanich) from the Tsawout First Nation. The Tsawout First Nation is one of four bands that comprise the WSÁNEĆ Nation. This article is drawn from my LLM thesis. I would like to thank John Borrows, Heidi Stark, and Val Napoleon for their encouragement and comments throughout my LLM, John Elliott for his support and cultural guidance, and Kirsten Anker for her comments as external examiner for my LLM thesis. I would also like to thank my family and wife Susannah for their endless love and support. Finally, I would like to thank the McGill Law Journal and the two anonymous reviewers for their time and helpful comments on an earlier version of this article. This article is dedicated to my late grandfather, YELḰÁTŦE.
