CONTRIBUTION A L’ETUDE DU DROIT DE LA PROTECTION DE LA SANTE PUBLIQUE AU QUEBEC

Résumé

L’étude du droit de la protection de la santé publique au Québec pourrait susciter un certain intérêt avec l’apparition récente de nouvelles maladies (comme le SIDA) présentant des menaces à la santé de la population. Après avoir indiqué les grandes lignes de son évolution, notamment dans ses aspects constitutionnels, l’auteure analyse l’actuelle Loi sur la protection de la santé publique régissant les interventions des autorités sanitaires. Sont ainsi constatées des lacunes importantes au chapitre de leurs pouvoirs et des moyens de protection, d’où la nécessité d’apporter des modifications législatives pour les rendre plus efficaces.

Abstract

The study of public health law in Quebec could generate more interest considering that new diseuses (such as AIDS) are threatening the public health. After a brief historical survey of its constitutional background, the author comments on the legal framework now provided by the Public Health Protection Act for the intervention of public health authorities. A number of problems are then identified as to the limits of their powers and of the protective measures, showing therefore a need for legislative reform.
