LA RÉCEPTION DES THÉORIES JURIDIQUES FRANÇAISES EN DROIT CIVIL QUÉBÉCOIS

Résumé

Lors d’une précédente recherche portant sur la place des théories juridiques dans le discours juridique québécois, nous avons constaté que ces théories juridiques, dont les juristes québécois se servent, étaient très majoritairement empruntées au droit français, aucune ou presque n’étant le fruit d’une activité doctrinale locale. Par conséquent, les théories juridiques que l’on trouve dans le paysage québécois sont le résultat d’un phénomène de réception. La présente étude aborde ainsi les modalités de la réception de différentes théories juridiques en droit privé.

Abstract

In an earlier study, the writers reached the conclusion that the legal theories referred to in Quebec law were, for the most part, borrowings from the French legal system. In fact none (or almost none) of them were the product of Quebec legal doctrine. As a result, legal theories applied in Quebec law are the result of a process of reception. This article examines the different criteria referred to by Quebec jurists in their discussions concerning this issue in private law.
