Le bénévole associatif, en quête de son identité Volunteers and the Search for an Identity

Le bénévolat se définit à partir de trois critères : l’absence de rémunération, la liberté de faire ou de ne pas faire et le choix délibéré d’une absence de rémunération. Le bénévolat associatif est multiple. Lorsque le bénévole est membre de l’association, son activité doit, selon la loi de 1901, être  « permanente ». La nature de cette activité est variable : participation à la gestion, de solidarité  « interne » ou  « externe » … Le bénévole peut également ne pas être membre de l’association et agir de diverses façons : soutien individuel sur le terrain, mise à disposition, volontariat (volontariat pour la solidarité internationale et volontariat civil) et jusqu’à des formes de  « bénévolats de nécessité » semi-contraints, ces dernière formes appelant en contrepartie une indemnité ou une rémunération. Face à la complexité des situations, l’auteur propose deux clarifications qui concernent la frontière entre bénévolat et salariat, d’une part, et la question de la rémunération, d’autre part.

Abstract

Volunteering is defined on the basis of three criteria. The volunteer works without pay, the volunteer can freely decide whether or not to do the work, and the volunteer makes a conscious choice not to get paid. Volunteering has many facets. According to the 1901 law, when the volunteer is a member of the association, the volunteer’s work must be “permanent”. The nature of this work varies. It may entail participating in the running of the association, or some form of “internal” or “external” support. The volunteer may also not be a member of the association and may act in various ways, ranging from individual support in the field, secondment, and voluntary service (volunteer work for international solidarity and community service) to types of semi-constrained volunteering “by necessity” that draw upon a fee or wage in compensation. In view of such complexity, the author proposes two clarifications concerning the boundary between volunteer and paid employment, on one hand, and the issue of pay, on the other.
