Le recrutement des juges en France

Résumé

Selon sa conception de la théorie de la séparation des pouvoirs, il existe en France une double juridiction, civile et administrative. L’auteur décrit et commente le recrutement des juges de l’ordre judiciaire ainsi que des tribunaux administratifs, en insistant particulièrement sur le concours et les conditions de nomination. Si les modes de recrutement se révèlent complexes et variés, ils se caractérisent par leur pragmatisme.

Abstract

According to its understanding of the theory of the separation of power, there exists in France a dual jurisdiction, civil and administrative. The author describes and explains the selection of judge process of the judiciary and the admnistrative tribunals, focussing on the competitive examination and conditions of nomination. Despite the complexity and variety of selection methods, all are pragmatic.
