LES LIMITES À LA COMPÉTENCE INTERNATIONALE DES TRIBUNAUX QUÉBÉCOIS

Résumé

Il existe trois moyens pour un défendeur de s’opposer à la compétence internationale des tribunaux québécois. Le défendeur peut prétendre que les faits ne répondent pas aux critères juridictionnels du Droit international privé tels qu’énoncés dans le Livre X du Code civil. Il peut aussi démontrer que bien que le tribunal québécois soit prima facie compétent en vertu du Code civil, il n’existe pas de lien réel et substantiel entre le tribunal et le litige. Finalement, le défendeur peut invoquer le forum non conveniens par l’intermédiaire de l’article 3135 C.c.Q., c’est-à-dire demander au tribunal de décliner l’exercice de sa compétence.

Ces trois moyens doivent être exercés à l’intérieur d’un délai variant selon que la procédure soit ordinaire ou allégée. Dans la voie ordinaire, la règle générale est que la requête en exception déclinatoire soit signifiée, selon les articles 161 et 163 C.p.c. dans les cinq jours de la date prévue pour comparaître, depuis l’arrêt Alimport c. Victoria Transport Ltd. L’incompétence du tribunal québécois relevant d’une clause d’arbitrage ou d’une clause d’élection de for sont cependant des exceptions à cette règle. En procédure allégée, l’article 481.7 C.p.c. prévoit que le défendeur doit proposer ses moyens déclinatoires « dans les dix jours suivant le délai de comparution ». L’arrêt Corporation Internationale Brother c. S.T.D. Systems Inc. indique cependant qu’il ne s’agit pas d’un délai de rigueur, le tribunal pouvant proroger ce délai.

Les différences des régimes de délai applicable selon que l’on se trouve dans une procédure ordinaire ou allégée n’est qu’un des motifs justifiant une révision en profondeur de la procédure à suivre pour s’opposer à la compétence internationale des tribunaux québécois.

Abstract

There are three options available to the defendant who opposes the international jurisdiction of Quebec courts. First, the defendant may claim that the facts do not satisfy the jurisdictional criteria set by Private International Law in Book X of the Civil Code of Québec. He can also demonstrate that although the Quebec court is prima facie competent in light of the Civil Code of Québec, there is no real and substantial link between the court and the case. Finally, the defendant can invoke forum non conveniens through article 3135 of the C.C.Q., thereby requesting that the court decline jurisdiction.

The three alternatives outlined above are available to the defendant within a varying time limit depending on whether it is an ordinary or simplified procedure. With respect to the ordinary procedure, since the decision of Alimport v. Victoria Transport Ltd, the general rule is that the request by which a defendant tries to demonstrate the incompetence of the jurisdiction that the plaintiff had chosen, must be done in accordance with articles 161 and 163 of C.C.P within five days of the date set for the appearance. The incompetence of the Quebec court relatively to arbitration or “choice of court” clauses are therefore exceptions to that rule. In a simplified procedure, article 481.7 C.C.P provides that the defendant must present, “within ten days following the time of appearance”, his declinatory exemptions. The Corporation International Brother v. S.T.D. Systems Inc. decision shows, however, that this time limit is not imperative, the court having the possibility to extend it.
