LES ROMS : LE CAS PARTICULIER DE LA HONGRIE ET DE LA ROUMANIE

Résumé

La situation des Roms diffère de la situation des autres minorités en Hongrie et en Roumanie et ce, en raison notamment de la discrimination dont ils font particulièrement l’objet et aussi parce qu’ils n’ ont pas de mère patrie à laquelle ils peuvent se rattacher. Donc, appliquée aux cas particuliers de la Hongrie et de la Roumanie, l’auteur propose ici une analyse en trois temps de la situation socio-juridique des Roms. Dans un premier temps, elle examine la situation de ce peuple avant la chute du communisme dans le but de mieux comprendre les particularités de leur situation. Dans un deuxième temps, elle étudie leur situation actuelle pour ensuite se pencher sur les législations nationales en matière de protection des minorités afin de mesurer si ces dernières peuvent effectivement remédier ou offrir une solution aux problèmes auxquels ils sont confrontés aujourd’hui. Enfin, elle complète son analyse en établissant dans quelle mesure les perspectives d’adhésion aux institutions européennes pourraient avoir un impact sur la protection de leurs droits. Au terme de ces trois parties, l’auteur arrive notamment à la conclusion que les lois nationales actuelles sont insuffisantes pour corriger la discrimination raciale ou ethnique dont sont victimes les Roms. Elle conclut également à la nécessité d’une approche détaillée sur le long terme avant de pouvoir parler de véritable démocratie pluraliste et de véritable protection des droits des Roms. Si l’éventualité d’une adhésion à l’Union Européenne a pour l’instant forcé la main des gouvernements hongrois et roumain, les résultats demeurent toutefois en deçà du niveau de protection nécessaire pour que la situation des Roms s’améliore de façon notoire.

Abstract

The situation of the Roma’s differs from that of other minorities in Hungary and Romania. This is mainly because of the discrimination which they are particularly subjected to and also because they do not have any motherland to which they can be linked to. The author hereby proposes a threefold study of the Roma’s social and judicial conjuncture specific to the Hungarian and Romanian experience. First, she analyzes the Roma’s situation before the fall of communism in order to better understand the particularities thereof. Second, she examines their present situation and assesses respective national legislations in the minority protection sphere in order to evaluate if the latest measures implemented can effectively improve, or offer a permanent solution to the contemporary problems they are confronted to. The author completes her analysis by determining the extent to which a potential European Union integration would create an impact on the protection of the Roma’s rights. Consequently, the author comes to the conclusion that present national legislations are insufficient to offset racial discrimination or discrimination based on ethnicity and that is affecting the Roma’s. The author also articulates the necessity of a sustainable detailed approach before being able to speak of a true pluralistic democracy and of enhanced minority rights for the Roma’s in both Hungary and Romania. The possibility of integrating the European Union has recently forced the hand of both the Hungarian and Romanian govemments to alter their policies in a positive way. However, results remain below expectations and the situation has yet to improve beyond what is necessary for the Roma’s situation to improve in a substantial way.
