LES FONCTIONS DE LA DÉMARCHE INTERPRÉTATIVE DANS LE CADRE DE L’ORGANISATION MONDIALE DU COMMERCE

Résumé

Dans le cadre de l’Organisation mondiale du commerce (OMC), la démarche interprétative remplit trois fonctions différentes. Comme toute démarche interprétative, la fonction première de l’interprétation réside dans la clarification du sens et dans la détermination de la portée des dispositions des différents accords de l’OMC. L’essentiel de cette tâche est aujourd’hui assurée par les groupes spéciaux et l’Organe d’appel dans le cadre de la procédure de règlement des différends. Ceux-ci ont, au fil de leur jurisprudence, parfaitement intégré les règles coutumières d’interprétation, auxquelles ils font aujourd’hui référence de manière quasi systématique. À côté de cette première fonction, l’interprétation des accords de l’OMC poursuit également un deuxième objectif : la complexité des accords et l’enchevêtrement des différentes obligations qui en résultent, invitent l’interprète à préciser comment celles-ci s’articulent entre elles. L’interprétation assure ainsi la cohérence de l’ensemble du système commercial multilatéral. Enfin, en se référant aux règles coutumières d’interprétation du droit international public, l’interprète assume une dernière fonction qui consiste à enraciner le droit de l’OMC dans le cadre plus général du droit international public. Cette troisième fonction est toutefois révélatrice des tensions qui peuvent exister entre deux aspirations antagonistes, la préservation de l’équilibre des droits et avantages négociés d’un côté, et l’absence d’isolation clinique du droit de l’OMC par rapport au droit international de l’autre.

Abstract

The interpretation of the WTO Agreements fulfills three objectives. As any interpretative process, the first goal of the interpretation is to define and/or determine the meaning and the scope of the various provisions of the WTO Agreements. Interpretation of these agreements is mainly given by the panels and the Appellate Body, in the framework of the dispute settlement mechanism. WTO Case law reveals that they almost systematically and skillfully refer to the customary rules of interpretation. Beside this first objective, the interpretation of the WTO Agreement aims at fulfilling a second objective. Considering the complexity of the entangled obligations arising out of the WTO Agreements, the interpret has inevitably to clarify their articulation. The interpretation of the WTO Agreements aims therefore at ensuring the coherence of the whole multilateral trading system. Finally, the use of the general customary rules of interpretation tends to enshrine WTO Law in general international law. However, this third objective of the interpretative process reveals the existing tensions between two antagonist aspirations: the preservation of the equilibrium of the negotiated rights and advantages on the one hand, and the absence of clinical isolation of WTO Law vis-à-vis international law on the other.
