L’AFFAIRE DES USINES DE PÂTE À PAPIER SUR LE FLEUVE URUGUAY (ARGENTINE C. URUGUAY) : UN NOUVEAU DIFFÉREND ENVIRONNEMENTAL DEVANT LA COUR INTERNATIONALE DE JUSTICE

Résumé

L’arrêt prononcé dans l’affaire des Usines de pâte à papier sur le fleuve Uruguay (Argentine c. Uruguay) offrait à la Cour internationale de justice une nouvelle occasion de faire la démonstration de son aptitude à trancher les différends environnementaux. Par le truchement d’une interprétation dynamique et évolutive du Statut du fleuve Uruguay, la Cour rend une décision équilibrée, réaffirmant la pertinence des principes fondamentaux du droit international de l’environnement dans le domaine de l’utilisation des cours d’eau internationaux à des fins autres que la navigation. La Cour ne saisit cependant pas l’occasion de consacrer la valeur coutumière du principe de précaution. De plus, la question de la participation d’experts à l’instance manifeste une certaine difficulté à s’emparer avec pertinence de la dimension scientifique du contentieux environnemental.

Abstract

The Judgment pronounced in the case concerning Pulp Mills on the River Uruguay (Argentina v. Uruguay) was a new opportunity for the International Court of Justice to demonstrate its ability to deal with environmental matters. Through a dynamic and evolutionary interpretation of the Statute of the River Uruguay, the Court gives an equilibrated decision, reaffirming the pertinence of fundamental principles of international environmental law in the field of non-navigational uses of international watercourses. However, the Court missed the opportunity to consecrate the precautionary principle as a norm of customary international law. Furthermore, it experiences difficulty in the handling of scientific dimension of environmental disputes as showing by the question of participation of experts in the proceedings.
