LE NOUVEAU PARTENARIAT POUR LE DÉVELOPPEMENT DE L’AFRIQUE DANS L’ARCHITECTURE INSTITUTIONNELLE DE L’UNION AFRICAINE

Résumé

L’objet de cet article est d’analyser les relations entre le Nouveau Partenariat pour le développement de l’Afrique (NEPAD) et l’Union africaine pour répondre à la question non encore débattue dans la doctrine de la nature juridique du NEPAD. Il a été démontré d’une part qu’en tant qu’organe créé par la Conférence de l’Union et sous contrôle de cette dernière, le NEPAD est un organe subsidiaire, Janus, partagé entre la volonté d’autonomie et le caractère subordonné à l’organe principal. Cette opération de qualification emporte d’autre part un développement institutionnel et fonctionnel du NEPAD en tant qu’agence panafricaine d’exécution au sein de la Commission de l’Union africaine.

Abstract

The purpose of this paper is to analyze the relationship between the New Partnership for Africa's Development (NEPAD) and African Union to address the issue not yet discussed in the doctrine of the legal nature of NEPAD. It has been shown that as part of a body established by the Conference of the Union and under the control of the latter, NEPAD is a subsidiary organ, Janus, shared between the desire for autonomy and subordinated to the main body. This operation entails qualifying the other functional and institutional development as an agency of the NEPAD Pan-African Implementation within the African Union Commission.
