Ce texte présente les origines, le sens et la portée des modifications apportées en 1993 à la Constitution de 1982. Après avoir rappelé les modifications introduites en 1988, qui accordaient une reconnaissance constitutionnelle à l'activité économique privée et autorisaient le transfert du droit d'utilisation du sol, l'auteure montre en quoi les modifications de 1993 consacrent certains acquis de la politique de réforme et d'ouverture et précisent l'expression constitutionnelle de l'idéologie dirigeante.
A cette fin, l'auteure rattache ces modifications à deux thèmes majeurs, l'actualisation de la référence du développement socialiste de la société chinoise et des objectifs de ce développement et l'introduction de la notion d'« économie socialiste de marché », ainsi qu'à deux thèmes de moindre portée : la perpétuation du principe de coopération multipartite sous la direction du PCC et le prolongement du mandat des assemblées populaires de district.
Relativement à l'actualisation de la théorie du développement du socialisme en Chine, le texte analyse la signification des changements à certains alinéas du préambule, notamment pour y consacrer la référence à la théorie de la « construction d'un socialisme aux caractéristiques chinoises » et y affirme la volonté de poursuivre la politique dite « de réforme et d'ouverture ».
Certains acquis de cette politique, et notamment la notion d'« économie socialiste de marché », se sont traduits par une série de modifications. Cette notion elle-même a été consacrée à l'article 15, alors que l'autonomie élargie qu'elle comporte pour les entreprises appartenant à l'État, les entreprises collectives et les exploitations familiales agricoles a été inscrite aux articles 16, 17 et 8 respectivement.
Abstract
This paper presents the origins, meaning and scope of amendments made in 1993 to the 1982 Constitution. After recalling the amendments introduced in 1988, which granted constitutional recognition to private economic activity and authorised the transfer of the right to use land, the author shows how the 1993 amendments consecrate certain acquisitions of the policy of reform and overture and provide enhanced precision to the constitutional expression of the official ideology.
To do so, the author links these amendments to two major themes : the updating of the reference to the socialist development of Chinese society and the objectives of this development, and the introduction of the concept of a « socialist market economy », along with two lesser themes : the perpetuation of the principle of multiparty cooperation under the direction of the Chinese Communist Party and the extension of the mandate of district peoples' assemblies.
With regard to the updating of the theory of socialist development in China, the paper analyzes the significance of amendments to certain paragraphs of the preamble, especially for consecrating therein the reference to the theory of the « construction of a socialism with Chinese characteristics » and affirms the will to pursue the policy known as « reform and overture ».
Certain acquisitions of this policy, and especially that of the concept of a « socialist market economy », have been seen through a series of amendments. This concept itself was consecrated in section 15, while the enlarged autonomy that it provides for businesses belonging to the State, collective businesses, and family farm operations was laid down in section 16, 17 and 8 respectively.
