L'entreprise fédérale

Résumé

Parmi les problèmes que pose en droit constitutionnel canadien l'existence d'entreprises fédérales, il y a celui de l'identification de ces entreprises. L'auteure étudie la notion d'entreprise fédérale et examine à cette fin diverses compétences législatives attribuées au Parlement fédéral qui ont été considérées par les tribunaux à l'égard de sa juridiction sur les entreprises fédérales afin de déterminer s'il est exact, comme l'a souhaité une certaine doctrine et comme ont pu le laisser croire quelques jugements, que la plupart des compétences fédérales peuvent justifier l'existence d'entreprises fédérales.

Abstract

Among the juridical problems concerning federal undertakings in Canadian constitutional Law, there is the problem of the identification of these enterprises. The author studies the notion of federal undertaking and examines diverse legislative competences attributed to the federal Parliament which have been considered by the courts having regard to its jurisdiction over federal undertakings in order to determine if it is the case, as a certain doctrine and a few judgments would have us believe, that most of the federal powers can justify the existence of the core federal undertakings.
