Abstract
This paper deals with European experiences of inscription of traditional cultural practices on UNESCO’s Representative List of Intangible Cultural Heritage (ICH). It will first establish the institutional context of the UNESCO’s listing within the framework of reflections on cultural rights. Then, the author briefly presents four European masterpieces in the Mediterranean area. A comparative analysis follows which specifically focuses on the multiplication of practitioners and on translocality; on the overlapping between institutions and artisans; on the use of intangible cultural heritage as a driver for local development via cultural tourism; and on the multimedia “museification” of the intangible. The comparative study of the listing of these intangible cultural heritage traditions also questions the value of customary law versus freedom of expression and creation. It reveals the tensions between the “purity” and “impurity” of cultural practices and social agents, as well as exclusions related to ethnicity, sex or territory. These tensions create new social divisions and remodel the link people have with cultural practices. An examination of gender sheds light on the marginality of women in public space.
Résumé
Cet article porte sur les expériences européennes d’inscriptions de pratiques culturelles traditionnelles sur les Listes du patrimoine culturel immatériel représentatif de l’UNESCO. Il commence par définir le contexte institutionnel dans lequel s’élaborent les listes de l’UNESCO dans le cadre des réflexions sur les droits culturels. L’auteur présente ensuite brièvement quatre éléments européens du patrimoine culturel immatériel de la région méditerranéenne inscrits sur la Liste représentative de l’UNESCO. Il s’ensuit une analyse comparative qui se penche plus particulièrement sur la multiplication des praticiens et sur le niveau translocal ; sur l’imbrication des institutions et des artisans ; sur l’utilisation du patrimoine culturel immatériel comme moteur du développement local par l’intermédiaire du tourisme culturel ; et sur la « muséification » de l’immatériel au moyen des outils multimédia. L’étude comparative des inscriptions sur les listes de ces traditions culturelles immatérielles interroge également la valeur de la loi coutumière par opposition à la liberté d’expression et de création. Elle dévoile les tensions entre la « pureté » et « l’impureté » des pratiques culturelles et des agents sociaux, ainsi que des formes d’exclusion qui tiennent à l’ethnicité, au genre ou au territoire. Ces tensions créent de nouvelles divisions sociales et reconfigurent les liens qu’entretiennent les gens avec les pratiques culturelles. L’examen du genre met en lumière la marginalisation des femmes dans l’espace public.
