Au Canada, les ententes conclues avec les Autochtones afin de rendre possibles les développements hydroélectriques participent à divers degrés au renouvellement de la relation entre l’État et les Premières Nations. Alors que jusque dans les années 1975 l’attitude des gouvernements provinciaux face aux populations autochtones était assez homogène, aujourd’hui les « ententes hydroélectriques » varient grandement d’une province à l’autre. Pour schématiser, nous pourrions dire qu’elles reflètent deux attitudes différentes. Il y a, d’une part, les ententes ayant pour seul objectif la mise en place de partenariats économiques consistant à partager, entre les communautés autochtones et les entreprises hydroélectriques, les « risques » et les « bénéfices » engendrés par les projets. De l’autre, il y a les ententes prétendant conduire à un renouvellement du contrat social entre les Premières Nations et l’État. Dans cet article, nous analysons l’évolution des « ententes hydroélectriques » signées avec les Cris au Québec et au Manitoba, notamment parce que ces cas représentent de façon exemplaire les nouvelles tendances évoquées. Nous nous demanderons si ces nouvelles approches, par-delà leurs différences, attestent du renouvellement du paradigme du « contrat colonial moderne » ayant jusqu’à présent gouverné les rapports entre l’État et les Autochtones.
Abstract
In Canada, the agreements negotiated with Aboriginal groups in order to make hydroelectric developments possible contribute, at various levels, to the renewal of relations between the Government and First Nations. Though provincial governments displayed a homogeneous conduct towards Aboriginal peoples until 1975, today’s “hydroelectric agreements” vary greatly from one province to another. These agreements can be said to reflect two types of approach. The first type consists of agreements developed with the sole intention of establishing economic partnerships that consist in sharing the “risks” and “benefits” generated by these projects between Aboriginal communities and hydroelectric industries. The second type of agreement claims to foster a renewal of the social contract between First Nations and Inuit Communities and the Government of Canada. In this article, we analyze the evolution of the “hydroelectric agreements” signed with the Cree communities in both Quebec and Manitoba, for in examining these cases the above emerging tendencies can be clearly demonstrated. We will also ask ourselves if these new approaches, beyond their differences, attest to the renewal of the “contemporary colonial contract” ideal that has, thus far, prevailed over the relationships between Aboriginal communities and the Government of Canada.
