The contradiction was not lost on contemporaries, who saw the impunity of duelling as a serious problem and debated how best to overcome the gulf between law and practice. This article looks at the arguments for and against the criminalisation of the duel, and shows how the debate raised far more fundamental questions about the role of law in a modernising society. AB - Bien qu'il ait été officiellement considéré à l'époque comme un crime, le duel est devenu de plus en plus répandu en Amérique latine à la fin du XIXe siècle et au début du XXe, surtout dans le milieu politique, celui-là même qui rédigeait, interprétait et appliquait la loi. La contradiction n'est pas passée inaperçue chez certains contemporains, qui considéraient l'impunité des duels comme un grave problème et qui essayaient de concilier loi et réalité. L'article présente les arguments pour et contre la criminalisation des duels et montre comment le débat a soulevé des questions fondamentales sur le rôle de la loi dans une société en pleine modernisation.
