In THE wake of President Roosevelt's New Deal for labour in the US, the International Woodworkers of America (IWA) experienced tremendous growth in Oregon and Washington. Fearing the arrival of the IWA in BC, the provincial government enacted the Industrial Conciliation and Arbitration (ICA) Act as a means to stanch the growth of militant industrial unionism. It was at the company town of BlubberBay, BC, that the ICA Act was tested for the first time as capital, labour, and the state struggled over the pith and substance of the new legislation. Drawing on the insights of critical legal theorists and neo-institutionalists, this article examines the multiple ways in which the state, law, and legal process shaped both the formation of the IWA and the nature of class struggle itself. In particular, it illustrates how the expansion of formal collective bargaining, as well as the age-old legal remedies available at common and criminal law, worked together to set limits and erect boundaries on collective working-class action and, in the end, forge a "responsible union."

A LA suite du NOUVEL accord sur la main-d'oeuvre signé par le président Roosevelt des États-Unis, le syndicat International Woodworkers of America (IWA) a connu une croissance incroyable en Oregon et dans l'état de Washington. Craignant l'arrivée du syndicat IWA en Colombie-Britannique, le gouvernement provincial a adopté la Loi sur la reconciliation et l'arbitrage industriel pour arrêter la croissance du syndicalisme industriel militant. C'est à Blubber Bay que cette loi a été mise à l'épreuve pour la première fois lorsque les capitalistes, les ouvriers et l'État se heurtèrent sur le contenu essentiel de la nouvelle législation. Grâce à la perspicacité des théoriciens juridiques et néo-institutionalistes, cet article examine les nombreux moyens par lesquels l'État, la loi et le processus juridique ont façonné le développement du syndicat IWA et la nature même de la lutte des classes. En particulier, il montre comment la négociation collective ainsi que les recours légaux en droit civil et criminel qui existent depuis longtemps, ont permis aux syndicalistes d'établir les limites de cette action collective de la classe ouvrière et, à la fin, de fonder un «syndicat responsable».

À partir des fiches du personnel de la Noranda Mines Ltd, l'auteur cherche à cerner les facteurs objectifs qui ont incité quelque 300 travailleurs à déclencher une grève le 12 juin 1934. Comme d'une part, la participation à la grève est inscrite sur les fiches, mais comme d'autre part, la majorité des travailleurs ont refusé de respecter les piquets de grève, deux groupes d'ouvriers-mineurs, les grévistes et les non-grévistes, peuvent ainsi être distingués lors du conflit. Hormis leurs orientations idéologiques, ces travailleurs ont-ils adopté face à la grève une attitude qui peut s'expliquer par leurs caractéristiques socioprofessionnelles? Au centre de cette analyse: les immigrants qui composent la majorité de la main-d'oeuvre. Puisqu'ils sont divisés sur les mérites de la grève, le texte examine l'influence de leur degré d'enracinement au pays sur leur militantisme.

Based on employee files of Noranda Mines Ltd., the author seeks to determine objective factors which incited some 300 workers to go on strike on 12 June 1934. On the one hand, strike participation was kept on record; but on the other, majority of workers refused to respect the picket lines. Two groups of miners, strikers and non-strikers, could easily be distinguished from one another during the conflict. Apart from their ideology, faced with the strike, did these workers adopt an attitude that could be explained by their social and professional characteristics? At the centre of this analysis: immigrants who formed majority of the labour force. Since they were divided on the merits of the strike, the article examines the influence of their degree of integration into the country upon their militancy.

In this article, we discuss representations of women's identities as workers in the wartime newspaper, Aircrafter, produced by management at the Canadian Car and Foundry Company Limited in Fort William, Ontario, during World War II. We argue that Aircrafter functioned as an ideological mechanism by which pre-war, middle-class prescriptions of femininity, emphasizing women's roles as decorative homemakers in the private sphere, survived the challenges of women's war work to shape post-war gender roles. The article demonstrates the efficacy of this ideological mechanism by revealing the comprehensive way in which different rhetorical styles and varied sections of the newspaper — the front page news and pictures, the editorial page, the women's page entitled "The Feminine Touch," as well as cartoons and pin-ups — collectively conveyed an ambivalent attitude that both praised and questioned women's war work in traditionally male jobs thus reinforcing pre-war socially prescribed forms of femininity. This research reveals how state policies concerning representations of women workers in government war propaganda influenced a northwestern Ontario war plant and shaped the ideological atmosphere which the women war workers at Canadian Car would have to negotiate as part of their daily working lives.

Dans cet article, nous discutons de la représentation de l'identité des femmes dans le journal, Aircrafter, publié par la direction de Canadian Car and Foundry Company Limited à Fort William, Ontario, pendant la Deuxième Guerre Mondiale. Nous soutenons que Aircrafter a servi de mécanisme idéologique par lequel les préceptes de féminité, qui insistent sur le rôle des femmes en tant que femmes décoratives au foyer, ont survécu aux défis que les femmes ont relevé dans leurs emplois pendant la guerre pour façonner le rôle féminin après la guerre. Little historical work has been done in Canada on public drinking in general and public drinking after prohibition in particular. For British Columbia this neglect is a real oversight because hotel saloons were transformed into hotel beer parlours after prohibition. The first parlours opened in Vancouver in 1925, and, like saloons, they catered to a working-class clientele. Parlours held sway until 1954 when a new Government Liquor Act provided for additional venues of public drinking. One did not have to sit long in a Vancouver parlour to realize that more than alcohol consumption was being regulated. Parlours also regulated class, gender and sexuality, and race.

Parlour regulation is better understood as moral regulation rather than social control. Moral regulation is a useful analytical perspective because it emphasizes the dynamic qualities of regulation, the multitude of regulators, and broad conceptions of knowledge and power. Advocates of moral regulation, however, tend to deemphasize state power. I argue that the state's influence should not be minimized to a point that obscures the significance of internalization, acquiescence, and coercion. In Vancouver's beer parlours the state remained an important manager of the marginal.

Peu de recherches historiques ont été faites au Canada sur la consommation d'alcool dans les établissements publics en général et sur la consommation d'alcool après la prohibition en particulier. Pour la Colombie-Britannique, cette carence est vraiment une omission car les bars d'hôtel ont été transformés en tavernes après la prohibition. Les premières tavernes ont ouvert leurs portes à Vancouver en 1925, et, comme les bars, elles s'adressaient à la classe ouvrière. Ces tavernes ont existé jusqu'en 1954 quand une nouvelle loi a permis à plus d'endroits de servir de l'alcool. On n'avait pas besoin de s'asseoir très longtemps dans une taverne de Vancouver pour réaliser qu'autre chose que la consommation d'alcool faisait l'objet de la réglementation. En fait, les tavernes permettaient de réglementer la classe sociale, le genre, l'orientation sexuelle, ainsi que la race.

On comprend mieux la réglementation des tavernes quand la considère comme une réglementation de la morale plutôt qu'un exercice de contrôl social. Le réglementation morale est une perspective analytique utile car elle met l'accent sur les qualités dynamiques de la réglementation, la multitude de régulateurs et les conceptions larges de savoir et de pouvoir. Les défenseurs de la réglementation morale, toutefois, essaient de minimiser l'importance du pouvoir de l'État. Je soutiens que l'influence de l'État ne doit pas être réduite au point de cacher l'importance de l'intériorisation, de l'acquiescement et de la coercition. Dans les tavernes de Vancouver, l'État était toujours demeuré un important gérant des marginaux.
