La primauté du droit et la légitimité démocratique comme enjeux du Renvoi sur la sécession du Québec

Résumé

L’auteure procède à une analyse de la construction historique du concept de rule of law pour en décoder l’idéologie sous-jacente et les intérêts qu’il conforte, avant de suivre le cheminement des transformations qu’a subies le fondement de la légitimité depuis Weber jusqu’à notre époque post-moderne. On arrive ainsi à mieux comprendre le contexte qui empêche la Cour de préserver intactes à la fois les exigences de la rule of law et celles de sa légitimité.

Abstract

The author proceeds to analyze the historical construction of the concept of the rule of law in an attempt to decipher its underlying ideology inclinations and the interests it promotes. Subsequently, the author reviews the grounds for legitimacy of this concept and how it has evolved from Max Weber to the present. In doing so, the article sheds some light on the context which prevents the Court to uphold the requirements of both the rule of law and those of its legitimacy.
