L’auteur vise à mettre en lumière l’influence musulmane et la contribution des juristes musulmans à l’édification des règles du droit international humanitaire contemporain. À ses yeux, cette influence peu traitée dans les écrits sur le droit international humanitaire apparaît non seulement dans les reconnaissances faites par les pères fondateurs du droit international humanitaire de l’apport de la tradition musulmane, mais également et surtout dans le rôle joué par les délégations et les juristes musulmans dans l’élaboration des instruments conventionnels de ce droit, comme le prouve la présente recherche historique qui s’inscrit dans les efforts intellectuels de relecture de l’histoire du droit international.
Abstract
This article seeks to highlight the contribution of Muslim legal scholars and the importance of Muslim legal tradition in general in the elaboration of contemporary international humanitarian law. According to the writer, although little reference is made to this influence in international humanitarian law doctrine, the founding fathers of this branch of law indeed acknowledged the contribution of Muslim traditions. The role played by Muslim delegations and jurists in the development of legal conventions in this field of law are emphasized in this historical study relating to a critical re-examination of the historical origins of international law.
