L’impact de la règle religieuse sur la disparition du lien conjugal en droit civil français et québécois

Résumé

En droit civil français et québécois, l’impact de la règle religieuse sur la disparition du lien conjugal est, à première vue, incertain : en France et au Québec, le mariage civil et les mariages religieux sont deux institutions désormais distinguées par la loi et par la jurisprudence. Cependant, l’impact de la règle religieuse sur la disparition du lien conjugal se manifeste dans certaines décisions relatives à la nullité du mariage et au prononcé du divorce. Dans ces décisions, la règle religieuse est reconnue pour les juges français et québécois de droit civil comme une règle juridique au statut particulier.

Abstract

In French and Quebecois civil law, the impact of religious ride on the disappearance of the marital bond is, at first sight, uncertain: in France and in Quebec, civil marriage and religious marriage are two institutions now distinguished by law and jurisprudence. However, the impact of the religious rule on the disappearance of the marital bond appears in certain decisions relating to the annulment of the marriage and to the declaration of divorce. In these decisions, the religious rule is recognized by the French and Quebecois judges of civil law as a legal rule in its own right, with a particular statute.
