Pour ce faire, il y a lieu d’en analyser l’aspect contractuel et l’aspect institutionnel afin d’en dégager une définition originale. La comparaison entre le droit coopératif et corporatif permet de conclure à l’originalité de chacun d’eux. De plus le contrat de coopération et le contrat de société ne peuvent être assimilés puisque dans le premier on retrouve l’affectio cooperationis et dans le second l’affectio societatis. Enfin, le contrat de coopération qui est à la base de la création d’une coopérative est régi par des conditions de fond et de forme clairement identifiées par le législateur. AB - The juridical classification of cooperatives is fundamental. To achieve this result, the contractual and institutional aspects must be analysed in order to obtain an original definition. The comparison between cooperative and corporate law allows to conclude as to the originality of both systems. Furthermore, the cooperation contract and the partnership contract may not be assimilated as in the first there is the affectio cooperationis and in the latter the affectio societatis. Finally, the contract of cooperation which is at the basis of the creation of a cooperative is regulated by conditions which have been clearly detailed by the legislator.
