Risques industriels et responsabilité : la réponse du Conseil de l’Europe en matière d’environnement

Résumé

Deux conventions du Conseil de l’Europe sont consacrées à la responsabilité des dommages à l’environnement, l’une concerne la responsabilité civile, l’autre entend renforcer la protection de l’environnement par le droit pénal. Les deux instruments doivent exercer leurs effets essentiellement dans les ordres juridiques internes des États parties et peuvent ainsi apporter une contribution significative à l’élaboration et à l’unification des normes juridiques dans ce domaine et, indirectement, à la prévention des atteintes à l’environnement.

Abstract

The Council of Europe has drafted two conventions on liability for environmental damage. One is related to civil liability, the other tends to reinforce environmental protection through criminal law. The two instruments are to be applied mainly in the national legal orders of the contracting States. They can thus contribute to the drafting and the unification of legal norms in this field as well as, in an indirect way, to the prevention of the deterioration of the environment.
