Avec les développements de la législation, le syndicalisme a perdu son caractère d'institution strictement privée et volontaire. Il a acquis un caractère semi-public. Dans quelle mesure la confessionnalité syndicale peut-elle être compatible avec un tel régime juridique? Les tribunaux n'ont pas encore eu à se prononcer sur ce point. L'auteur analyse ici les différentes mesures législatives et les pratiques syndicales qui peuvent affecter la confessionnalité; il donne également une opinion doctrinale sur cette question.

With the development of labour legislation, unionism has lost its character of a purely private and voluntary organization. It now has the status of a semi-public institution. Confessional unionism, under these conditions, can no longer stand the test of legality, even if the courts have never been called to rule on this question.

Among the laws which we have to consider here, the Labour Relations Act is the most important. This act gives to one union only the right to bargain for and on behalf of all workers in a bargaining unit. If one wants to become an efficient member of a union, he has to join the local which represents him and his fellow workers in the plant where he is employed. Moreover, compulsory membership is commonly observed in collective labour agreements as a condition of employment. The natural right of association is thus limited in fact to those who may, without making it a point of conscience, freely accept the constitution and by-laws of a union.

Local unions which require a worker to be a Catholic as a condition of membership are very seldom, but the sole fact that the Canadian and Catholic Confederation of Labour has a reference in its constitution to the social doctrine of the Catholic Church may bring a worker to scruple to belong to an affiliated local of this central body. The question of what may be a matter of conscience in this case is related to the fact that the interpretation of the doctrine is considered by non-catholics as vested with an outside organization, i.e. the Church. If the constitution of the union merely referred to the Christian social principles as the basic guide of its action, it would be a quite different thing, because this would involve no outside opinion and would be acceptable to anyone in a Christian country such as Canada.

Si on les considère uniquement comme un certain pourcentage du chèque de paie, les bénéfices sociaux ne prennent pas toute leur signification véritable. Il faut plutôt les envisager comme des valeurs fondamentales dans notre conception du bien-être social dans la civilisation industrielle. Les bénéfices sociaux constituent désormais un élément important et permanent de la structure de la rémunération ouvrière.

Les bénéfices sociaux d'origine privée sont en fait une partie intégrante de l'ensemble du système de bien-être social, que l'opinion publique et l'intérêt général réclament. C'est dans cette perspective qu'il faut les juger et sur ce critère qu'il faut s'appuyer pour faire l'évaluation critique des décisions qui sont prises dans ce domaine.

Il n'est pas facile de mesurer exactement les conséquences des bénéfices sociaux, mais on peut affirmer avec une certaine assurance que leur coût tend à être passé au consommateur sous forme d'augmentation du prix des produits lorsque les affaires sont prospères. C'est ce qui est arrivé au cours des quinze dernières années. Il ne faut pas oublier non plus que le coût global des bénéfices sociaux dépasse celui des montants qui y sont consacrés sur les chèques de paie: il comprend les effets sur la productivité, les résultats de l'augmentation des loisirs, la possibilité d'inflation, etc.

Il importe que patrons et ouvriers soient conscients de leurs responsabilités publiques dans ce domaine et que le public lui-même soit mieux au courant de ce qui se passe autour de la table de négociation afin que l'intérêt général ait le dernier mot.

Grievance is but one form of industrial conflict. It must be seen in the light or the global industrial relations situation of the parties. Its functions are many, whether it be a conflict over rights or over interest. The main thing is that the parties keep the closest possible control over the produce by resort to private arbitration.

Le grief est une des multiples formes de conflit industriel. Il s'éclaire de tout l'arrière-plan des relations entre les parties. A bien des égards, il joue un rôle utile. Conflit de droit, il peut également être conflit d'intérêts. Le point important, c'est que direction et syndicat soient maîtres du mécanisme de règlement des griefs dans la mesure du possible.

L'auteur décrit ici la réalité juridique et sociale de l'Etat considéré comme un employeur et pose le problème des objectifs et des moyens du syndicalisme chez les fonctionnaires. Il rappelle les notions de base du droit d'association et de son exercice, et souligne les obligations de l'Etat envers ses employés.

There is a growing tendency among civil employees to organize and to join the general labour movement. On the other hand, the government and certain important sections of public opinion are afraid of some consequences that collective bargaining might have, especially on the authority of the government as an employer.

There is no reason why civil employees should not get substantially the same conditions as workers from private business. International agreements have recognized the right of association to every employee, including those working for governments, and the consequent right to bargain collectively their conditions of employment. Of course this right is to be exercised in different ways, according to special circumstances.

The theory that civil servants should work under the unlimited and uncontrolled authority of the State, without a voice in the determination of their working conditions, is obsolete and totalitarian. As far as labour legislation and collective bargaining rights are concerned, the distinction should not be made between public and private workers, but between essential services for the nation and all the others. In some cases, government services are far less important and vital to the country than some others performed by private firms; in other cases, the government and private business are in direct competition.

One of the reasons for denying to civil servants the right to full collective bargaining is the fear that such an action would give them such power as to overcome democratic government control on public administration. As a matter of fact, unionism and collective bargaining have had the opposite effects when and where civil employes have enjoyed their full rights.
