Bill 9 has brought substantial amendments to the Construction Industry Labour Relations Act (Bill 290). It was adopted by the Québec Legislature and sanctioned June 1st, 1973.

MAIN PROVISIONS OF BILL 9

Four provisions will be considered here : the bargaining unit, the designation of the bargaining agents, the decree and the Construction Industry Commission.

One Joint Industry-wide Bargaining

Under the Collective Agreement Decrees Act, the contracting parties in construction, from 1934 to 1968, bargained on the basis of their choice, and voluntarily requested ofterwards the juridical extension of their collective agreement. Thus, for more than thirty years, an industry-wide bargaining situation had been experienced, with few exceptions, in fifteen regions that covered altogether almost the whole province.

Bill 290 made it mandatory, since 1969, to negotiate jointly for the industry as a whole, without any exception for any trade : there was to be one collective agreement determining all working conditions for all the trades. Although favouring bargaining on a provincial basis, the Act left it to the parties involved to bargain regionally or provincially. In the first round of negotiations under the new Act, bargaining quickly moved from the regional level to a provincial table. Bill 9 has sanctioned this situation by ruling out the possibility anymore of any bargaining for the construction industry on a regional basis.

Designation of the Bargaining Agents

The choice and designation of the bargaining agents and the employers' representatives have been changed substantially by Bill 9. To put the problem intoperspective, and acknowledging an oversimplification, it may be said that the various employee representation schemes fall into two models : the North-American model based on a monopoly of representation, and the European model based on simultaneous multi-union representation (union pluralism).

The Collective Agreement Decrees Act foresaw no official recognition of the unions involved. It must be remembered that the juridical extension system was introduced in 1934, ten years prior to the Labour Relations Act and the union certification framework. The thrust of the Decrees Act was toward the collective agreement, not the bargaining parties. Either side or both of them could petition the Minister of Labour for their collective agreement to be juridically extended. The required conditions pertained to the preponderant significance and importance of the agreement itself. If the juridical extension was granted, the bargaining parties were thus implicitly recognized.

Bill 290 brought a basic change by removing the initiative of the extension from the parties : it implied there would always be a decree. A formula became necessary to identify the bargaining agents for each side. The Act itself designated by name the employee and employer representatives, stating « [these] associations shall be deemed representative throughout the province of Quebec » (s. 5). This concept of representative associations is typically European and commonly found in French labour legislation.

The designated employee associations were not the local syndicates or the locals of the various building trades international unions ; they were the central provincial bodies, namely the Confederation des syndicats nationaux (C.S.N.) and the Federation des travailleurs du Québec (F.T.Q. ), with respect to their own affiliated bodies. On the employer side, the Act designated five province-wide associations or federation of associations. AU the designated associations were on an equal footing. Each one of them enjoyed a veto power as to the signing of the agreement, except for the unlikely case where one such designated association would come to represent only5% or less of the employers or employees in its own class ; such an association would then have only the right to be present at the bargaining table,

This veto power was responsible for the fact that there was no signed agreement by the contracting parties in 1970 ; the government had to prepare and adapt the decree by itself, following long and difficult strikes, terminated by Bill 38 and special government powers. The dramatic rivalries between the C.S.N. and the F.T.Q. — but also the less publicized but quite deep oppositions between some of the employers' associations — threatened a similar situation to materialize in the 1973 round of bargaining.

Bill 9 has developed a new scheme to identify the bargaining agents. The Bill maintains the concept of representative association, but defines it differently ; instead of being designated in the Act, an association will be recognized as representative by the chief investigation commissioner, if it has jurisdiction throughout the province and in respect of all the trades and occupations. On this last point, two exceptions are mentioned : the two Corporations of Master Electricians and Master Plumbers will continue to be considered representative although limited to one trade.

After having ascertained whether the applicant is an association within the meaning of the Act, the chief investigation commissioner must evaluate its degree of representativeness. This degree depends on three percentages and is equal to the arithmetic average of these percentages : 1° the percentage of its membership with respect to all the employees or all the employers in the industry, 2° the percentage of the wages earned or paid by the members of the association in comparison to the total construction wage bill for a specified period (according to the Act, the levies are to be measured, but since the levies are directly proportional t6 the wages, the result is the same), 3° the percentage of the number of hours worked in relation to the total hours worked in the industry. Total number of employees and employers, hours of work and wages are those of the first nine months of the calendar year preceding the expiry date of the decree, while membership will be counted as the number of employees or employers who informed the chief investigation commissioner of their member status during the seventh month preceding the expiry date of the decree.

Using these three percentages instead of the membership only should give a better-balanced picture of the representativeness of the associations involved ; their economic importance is thus recognized and considered. Because certain associations have many workers who do little work in the industry or employers who run very small business, while others have fewer members but doing a lot of the work, the legislator considered appropriate to balance the membership aspect by some measure of either the attachment of the workers to the industry or the economic significance of the employers.

With this measure of the three percentages, a new type of majority rule has been introduced. To force the order party to begin and continue negotiations, one or more associations must be representative to a degree of more than 50%. Any representative association may notify any other association that it is prepared to negotiate a collective agreement, but the obligation to bargain exists only between associations (one or more on each side) that are representative to a degree of more than 50%. The other associations must nevertheless be notified. In the same manner, to be considered a collective agreement under the Act and eventually become a decree, an agreement must be signed by one or more associations which are representative on each side to a degree of more than 50%.

Without imposing a union monopoly, as in the case of certification under theLabour Code, the new Act gives a definite preponderance to any association or associations representing the majority of employees or employers. It thus establishes a new type of majority rule, in a context of union multiplicity or union pluralism. The bringing together of two different models of labour relations will not be without difficulties.

The Decree

Besides the already mentioned requirement of a 50% or more representation degree on both sides, Bill 9 has made another important modification in connectionwith the decree it self. A certain number of clauses in the agreement, such as job classification, hours of work and monetary items in general will become mandatory from the moment of their first publication in theQuébec Official Gazette as a notice of agreement ; still there will be the usual period during which objections will be received by the Minister of Labour before the final publication of the decree. The immediate application of the monetary clauses serves a valuable goal, namely granting the employees the new advantages as soon as possible ; but it implies an engagement on the part of the government that any agreement on these clauses will be accepted and juridically extended automatically, once they have been bargained and signed by the majority representing associations. A serious situation could develop if government considered that the parties have gone into a sweetheart agreement at the expense of the public.

A transitional provision gave the Minister of Labour the right to consider a collective agreement under the Act an agreement signed before the adoption of the Act if it met the prescribed requirements. Actually, the legislator had in mind precisely to recognize such an agreement which had intervened between the F.T.Q. international unions and four employers' associations at the end of April, agreement which was unlawful under the terms of Bill 290 as it stood before, because it was not signed by all the representative associations.

The Construction Industry Commission

Bill 9 has introduced two important modifications in relation to the Construction Industry Commission (C.I.C.). One regards the designation of its members, the other the vote-taking system.

The C.I.C. remains composed of fourteen members, six representing the employers, six the employees, plus a president and a representative of the Minister of Labour. Bill 290 stated specifically that the C.S.N. and the F.T.Q. would have three representatives each, and that every one of the five employers' associations would have one representative, plus a sixth to be named by the other five.

Under the new provisions, each representative association has the right to designate one member. On the employers' side, the count will be complete immediately, for the Montréal Construction Association has become a representative association and the number of employers' representative associations has thus been brought to six. On the union side, with the presence of the Centrale des syndicats démocratiques (C.S.D.), the first round of designation will end up with three employee members. In the second round, associations representative to a degree of 15% or more will each designate another member. If necessary, there will be a third round, in which only associations representative to a degree of 30% or more will have a right to designate a member. In the end, considering the present situation, the F.T.Q. will have three members, the C.S.N. two members and the C.S.D. one member.

Vote-taking within the CI.C. will require a majority on each side of the table. Each association will have a weighted vote corresponding to the degree to which it is representative.

This new concept of the degree of representativeness is central to all the main amendments of Bill 9. It implies a radical change from the previous situation and it will have very serious implications.

SOME IMPLICATIONS

These implications will bear on the representation aspect, the collective bargaining, the C.I.C. and construction labour relations in general.

Impact on Representation

To ensure an immediate application of the Act, the Minister was empowered to verify by himself the current degree of representativeness of the previous representative associations and of those who had asked before May 9, 1973, to be recognized as such. Table 1 in the article gives the results of this verification.

The practical consequences of the new system will be much more dramatic on the union side than on the employer side. Through the new majority rule, the F.T.Q. will enjoy, in practice, all the powers associated with a union monopoly situation : the right to give the notice to bargain and to oblige the employers' associations to start negotiations, the right to conclude the agreement whatever the position of the two other union bodies, and the determining union vote in all the decisions within the C.I.C. The only limitation it will face regards any attempt it could make to include a discriminating clause against a minority union in the collective agreement : in such a case, the Minister has the right to modify the agreement on that point without the consent of the majority representing associations.

The minority unions have very limited rights, such as the right to be informed of any notice to commence collective bargaining, the right to give such a notice but without the power to force the other parties to act accordingly, the right to be present at the bargaining sessions and very likely to present their viewpoints, even their own demands, but not more, the right to appeal to the C.I.C. chairman from any decision respecting the interpretation or application of the decree.

But the major impact might be on job sites, where the employees themselves seeing the relative powerlessness of the minority groups may decide to join the majority unions. The end-result may be a union monopoly in fact, despite the recognition of union pluralism within the law.

On the employers' side, since no one group has a degree of representativeness of even 30%, there will need be alliances if the system is to work at all.

Impact on Bargaining

The veto power any representative association had under the previous system was the most important drawback in promoting true collective bargaining. From that viewpoint, the new majority rule may be a great help. The collective agreementthat has been bargained and signed in April 1973, before the adoption of Bill 9, by majority representing associations may be another sign of the practicality of the new system. On the other hand, the parties had then special incentives to agree, the main one being that their very bargaining at that time had no support of the law. Besides, the F.T.Q. unions could hope that an early settlement, later approved by the law, would bring unto them members from other associations ; and the Montréal Construction Association could hope to be recognized as representative, which it was not before.

The long run effect will depend on the attitude of the majority groups. If they decide to stick to their positions, they can do so without any fear to be undercut by the minority groups : the impasse will remain, and the government will again be forced to intervene, and probably to decide by it self, for it is hard to believe that the whole system could be left to fall apart. On the other hand, if the majority groups would agree to act collusively, the employers could pass to the consumer any extravagant conditions, and the government would likely be obliged to extend the agreement any way. The rigidity of the system, coupled with the large scope of an industry-wide agreement, gives the majority groups a tremendous power.

But the unity and cohesion of the industry is still endangered. Some highly specialized trades, as the elevator mechanics and their contractors, have never really accepted the one-and-only-one rule for collective bargaining and the collective agreement. The section of Bill 9 excluding the flat glass industry from the application of the Act may suggest to other trades a possible way out of a system which they feel unfavourable to them.

Impact on the C.I.C.

Within the C.I.C, the majority groups are likely to cooperate for the application of the decree, for it is in their interest that the agreement they have signed be respected. If they do not agree, the new Act foresees that the chairman of the C.I.C. shall decide. Moreover, any representative association may appeal to the chairman from a decision respecting the interpretation or application of the decree. If one single association decides to use this power systematically, then the chairman will have to take finally all the decisions. In this case, the Commission itself would become a mere façade, and it might well be replaced by a board under direct government supervision. Another possibility would be, of course, a strict monopoly union situation, where the right of appeal of minority groups would be revoked.

Employment Security and the Hiring Hall

Bill 9 has maintained section 62 of the Act, which already stated that « the Lieutenant-governor in councillshall make regulations respecting the employment offices of the associations of employees. » It also prohibited any agreement « by which all or a percentage of the labour force must be hired through the employment office of an association of employees ». But this may remain a wishful dream, as it has been until now. Besides, regulating hiring halls will prove a very difficult job for any government under any condition.

The various employment security schemes that have been put forward and successively abandoned since 1969 have led to the current obligation of a work permit for the qualified trades only. This work permit, in conjunction with the powers granted to the majority groups at the bargaining table and at the C.I.C., might become an extremely powerful instrument for controlling the labour market and eventually the working conditions. AU will depend on how it is used.

CONCLUSION

The majority rule introduced with the degree of representation might usher in a period of improved collective bargaining and a better functioning of the whole system, together with greater autonomy for the parties. But this is not really ensured. For there are two sets of opposite dangers. The system might function so well for the majority groups that it will be to the detriment of the public, the other groups and maybe the workers themselves ; and the government would have to intervene to protect those affected. Or it might not function at all, and again the government would be called in, with more intervention and more and more regulation.

The middle way remains possible, if the majority groups accept the rules of the game and give them a fair try.

In the course of the last decade, many changes took place in the education system of the Province of Québec. A network of organizations was set up so complex that it is almost impossible for people to get an overview of the structure and functionning of the entire system.

The system concept is used because it invites people to focus their attention on the outputs or results to be achieved instead of looking only at the activities and the resources necessary for their accomplishment. Educating children and helping adults to adapt to a continuously changing environment are the main results that the population expects from its school system.

Personnel management in this context can be looked upon as a sub-system whose output is to provide productive, stable and motivated human resources. That is the way the role of the personnel department is usually defined.

The purpose in this paper is to reformulate the role of the personnel department in the light of a school system that can be made more human. But, first, is it possible to reach an agreement on what is meant by a « more human school system » ? I think a system is human when it gives to the people engaged in it the opportunity of growing, to develop themselves by doing meaningful work, that is, work that gives to somebody a feeling of self-identity and self-esteem.

Going back to Maslow's needs hierarchy and Herzberg's two-factor theory, it is possible to identify two levels of humanization of a school system. The first one encompasses the conservation needs and the conditions of work that could satisfy this category of needs. Herzberg calls these conditions « hygienic factors ». The second level comprises the growth needs of individual that could be fulfilled by « motivational factors », that is, conditions of work that enhance self-esteem and self-actualization.

Keep these two levels in mind, it is now possible to reformulate the role of a personnel department within a school system.

In the short-run, the personnel department must keep on providing services and assistance to other departments in the school system. These services (recruitment, selection, training, contract administration, compensation, etc...) are necessary to keep people within the system but fall short of motivating them to do their best. In performing this role, the personnel department help creating and maintaining working conditions that satisfy first-level needs of individuals.

But, the personnel department can perform a larger role by « getting out of the kitchen work and enter the living-room ». This means that the personnel department must get a broaden outlook and play the role of a « change-agent » within the entire system. This can be accomplished by helping people in authority position to question their philosophy and behavior about managing other people. This also implies helping to create conditions for growth or self-actualization at each level of the organization.

To play the role of internal change-agent, the personnel manager of educational institutions will have to be familiar with new ideas drawn from the behavioral sciences which are already put into practice in business and industry.

On s'intéresse à la qualité de la vie en milieu de travail depuis au-delà d'un siècle. Pour s'en convaincre, il suffit de rappeler les noms de Victor Hugo, de Charles Dickens, d'Upton Sinclair, d'Engels, de Le Play, de Mayhew. Avant le commencement du XXe siècle, les gouvernements avaient essayé de faire disparaître les abus les plus révoltants.

Il est cependant paradoxal que, au moment où les salaires, la durée du travail, les vacances et les congés payés se sont améliorés à un point qu'on aurait considéré inaccessible il y a quelques générations et au moment où la machine a éliminé en bonne partie le travail pénible et dangereux, il se trouve autant de salariés qui ne soient pas satisfaits de leurs conditions de vie. Et ceci est vrai non seulement du travail en usine, mais également des emplois de bureau. Une étude récente publiée aux États-Unis met en lumière le mécontentement de plusieurs catégories de travailleurs : jeunes ouvriers, personnes âgées, personnel féminin, minorités raciales, cols bleus, cadres intermédiaires, etc. Des enquêtes font ressortir les effets pernicieux d'un travail peu satisfaisant sur la santé physique et mentale, les effets catastrophiques du chômage dans une société où la considération sociale s'acquiert par le travail.

De même, dans les cercles d'employeurs, on cherche à trouver des moyens d'humaniser le milieu de travail afin d'éliminer certains maux : absentéisme, chapardage, sabottage, accidents, alcoolisme, usage des stupéfiants. Il y a déjà plus d'un demi-siècle qu'on se penche sur la question et qu'on étudie les effets de la lumière, de la chaleur, du bruit, de la fatigue, de la monotonie sur la productivité des travailleurs. La satisfaction au travail a fait le sujet d'enquêtes de plus en plus approfondies. Pendant longtemps, on a pensé que plus l'ouvrier était heureux à son travail, plus il y avait de chance que la productivité soit meilleure. Des études récentes ont mis en doute cette hypothèse optimiste. On a également cru que des heures de travail plus courtes, des congés plus nombreux et des vacances prolongées contribueraient à hausser le niveau de la santé physique et mentale des travailleurs. Les expériences récentes tendent à démontrer que l'objectif recherché n'a pas été atteint.

Il n'est donc pas surprenant que sociologues et psychologues se tournent d'un autre côté et qu'ils imputent à d'autres causes comme l'aménagement urbain, les contraintes sociales, par exemple, le phénomène moderne du manque de satisfaction au travail, toutes choses qui échappent à l'esprit des économistes et des hommes d'affaires. Ceux-ci sont maintenant sur la défensive. Stigmatisés comme des « marchands de mort » et des destructeurs de l'environnement, ils cherchent à découvrir des moyens de convaincre le public de leur désir sincère de promouvoir une société meilleure. Ceci signifie que, même si les employeurs ne considèrent pas la qualité de la vie au travail comme une fin en soi, ils prêtent une attention plus grande aux propos des sociologues.

LA QUALITÉ DE LA VIE

L'expression « qualité de la vie » n'a pas un sens très précis. Elle évoque l'image du poisson mort sur la plage aussi bien que la masse de béton au coeur de la ville. Cependant, il y a une certaine affinité entre l'attention que nous portons à la qualité de la vie en milieu de travail et l'intérêt que nous manifestons pour les vieilles notions de conditions et de normes de travail. Cette nouvelle expression semble se prêter à bien des interprétations différentes : le mineur qui se sent bien inconfortable au fond du puits, l'employeur qui veut par là accroître la production et réduire les arrêts de travail au minimum, l'État qui recherche la stabilité et le développement économiques, la santé et la sécurité publiques ainsi que le bien-être des consommateurs. On se trouve donc pour ainsi dire en présence de trois perspectives bien différentes devant le concept de la qualité de la vie en milieu de travail.

Cette notion de « la qualité de la vie » en milieu de travail a également une dimension d'ordre temporel, c'est-à-dire qu'elle peut varier pour un même individu selon ses origines, ses obligations personnelles, le stade de sa carrière professionnelle. Ainsi, ce qui convient au jeune homme dont l'intérêt est tourné vers l'avenir ne sourit pas nécessairement au travailleur d'âge mûr qui doit pourvoir à la vie de plusieurs rejetons et qui ne nourrit plus guère de rêves.

Enfin, la qualité de la vie en milieu de travail doit également s'évaluer en tenant compte des autres aspects de la vie du travailleur : sa situation familiale, l'organisation de ses loisirs, son activité sociale, ses convictions politiques.

LA SATISFACTION AU TRAVAIL

C'est en considérant toutes ces dimensions de la vie humaine qu'il faut aborder la question de la satisfaction au travail. À ce propos, l'auteur commence par faire une revue de la littérature sur ce sujet, littérature qui est déjà fort volumineuse. Les méthodes d'étude de la satisfaction au travail sont orientées vers la connaissance du sentiment global de satisfaction ou d'insatisfaction au travail ou vers un aspect particulier du travail comme l'environnement ou la conduite personnelle, par exemple. D'autre part, elles peuvent s'intéresser aux expériences passées ou aux aspirations du travailleur. Parfois, la méthode consistera dans des questions assez simples du genre de celles-ci : « Aimez-vous ou détestez-vous votre emploi ? » « Y a-t-il un autre genre de travail que vous aimeriez faire ? » ou « Travailleriez-vous si vous n'aviez pas besoin de gagner votre vie ? » Parfois il s'agit d'un ensemble de questions très compliquées.

Au cours des années, sans tenir compte de la méthode utilisée ni du caractère des personnes interviewées, les études sur la satisfaction au travail indiquent une certaine uniformité. La plupart des personnes interrogées se déclarent satisfaites, alors que de dix à vingt pour cent donnent un autre son de cloche. Si les résultats sont intéressants, il n'en reste pas moins que les psychologues ont souvent de la difficulté à les interpréter. La formule du questionnaire indirect, plus raffinée, laisse voir certaines différences dans le pourcentage des travailleurs satisfaits et insatisfaits quand on les analyse en fonction de l'âge, du degré d'instruction et du statut économique des travailleurs.

De tout ceci, il ressort diverses constatations. L'américain traditionnel est plutôt un bluffer qu'un revendicateur : le degré de respectabilité sociale lui importe plus que le bonheur. La personnalité du travailleur est tellement reliée à son emploi et à son milieu de travail que se plaindre de son travail, c'est remettre en question toute sa vie. Le mythe du travailleur heureux semble avoir été créé dans une certaine mesure par des formes d'enquête trop simplistes.

Des études ont démontrée que l'intégration de l'employé dans le milieu semble favoriser la satisfaction au travail. La façon dont le travailleur est dirigé, le salaire les avantages d'appoint et les chances d'avancement donnent des résultats assez ambigus. Ces questions sont sans doute importantes mais le travailleur peut les considérer, la rémunération par exemple, bien des points de vue différents : comme gagne-pain, comme récompense, comme compensation juste pour son activité.

D'autre part, on ne peut pas tirer de conclusions de la satisfaction ou de l'insatisfaction au travail sur le comportement des individus placés devant des situations concrètes. L'insatisfaction au travail ne peut être une explication suffisante de l'attitude du travailleur qui a posé un geste précis. Selon les individus, le sentiment de satisfaction ou d'insatisfaction inspire des comportements fort variés. Parfois la satisfaction au travail peut être un stimulant pour la productivité, mais le phénomène inverse peut aussi se produire. D'une façon générale, toutefois, on peut conclure que les gens travaillent mieux et davantage lorsque leur activité est conforme à la réalisation de leurs aspirations profondes qu'il s'agisse d'argent, de statut social ou de prestige. C'est pourquoi, pour apprécier valablement le comportement du travailleur, il faut recourir à une quarantaine de variables.

On a aussi fait des études sur la satisfaction au travail en rapport avec l'état de santé physique et mentale des travailleurs. Dans ce cas, on est arrivé à la conclusion qu'il y avait une relation évidente entre la longévité et la satisfaction. Plus le travailleur est insatisfait, plus il est exposé aux maladies du coeur, de l'estomac et à des affections rhumatismales.

LE SENTIMENT D'ALIÉNATION

Au problème de la satisfaction au travail est intimement lié celui de l'aliénation par le travail. Les conditions mêmes de la vie moderne ont accru la pertinence des études sur cette question. L'idée selon laquelle le travail est en quelque sorte l'extériorisation de l'être ne remonte pas au-delà de la Renaissance. Auparavant, et c'est encore vrai pour le commun, le travail était ressenti comme un mal nécessaire, un moyen de gagner sa vie, de se donner unstanding social et d'amasser des richesses. Cependant, savants et artistes ont toujours trouvé que le travail était une fin en soi. L'idée d'aliénation a été élevée au titre de concept philosophique par Hegel. Marx a appliqué le terme « aliénation » aux forces diverses qui tendent à briser l'unité de l'homme en le séparant du produit de son travail. C'est ainsi que l'institution du capital est devenue une force indépendante qui est régulatrice de l'activité humaine.

Ce thème de l'aliénation de l'homme par le travail a toujours été vivace depuis Marx parmi les humanistes et les sociologues. Certains mettent l'accent sur la fragmentation, donc la monotonie des tâches, tandis que d'autres se sont surtout penchés sur l'impuissance des travailleurs à fixer eux-mêmes le rythme de leur activité. On a aussi recouru au concept d'aliénation pour expliquer le comportement « anti-culture s » de la jeunesse et des minorités raciales.

Par ailleurs, la définition du concept d'aliénation varie considérablement d'un auteur à l'autre. D'une façon générale, on peut retenir que l'aliénation consiste dans le rejet, actif ou passif, d'un ou de plusieurs des rôles sociaux que l'homme doit tenir. Le rejet actif revêt plusieurs formes : la rébellion, le choix d'un rôle nouveau, c'est-à-dire d'adoption d'un style de vie déviant et excentrique, le combat pour modifier ce rôle, soit par persuation, soit par la lutte ouverte. Quant au rejet passif, il consiste soit à éviter systématiquement de s'engager personnellement, soit à fuir les responsabilités qui sont les plus onéreuses.

Il faut distinguer l'aliénation de l'insatisfaction au travail. Le travailleur se veut aliéné depuis les débuts de l'ère industrielle. Pour la société, pour l'employeur principalement, l'aliénation ne devient sensible et significative qu'au moment où elle est suffisamment généralisée pour rendre difficile le recrutement des travailleurs pour occuper les postes-clés. Par exemple, les fonctions de cadres exigent pas plus de connaissances techniques que les postes d'ouvriers, mais elles exigent un « bon comportement », c'est-à-dire l'acceptation des normes et des objectifs de l'entreprise. Pour ce qui est du travailleur du rang, cela n'a pas d'importance qu'il se sente aliéné dans la mesure où leur sentiment d'aliénation demeure passif. Cependant, les tenants de l'humanisation du travail remarquent que l'aliénation a tendance à prendre des formes actives et à s'extérioriser dans le milieu de travail par l'augmentation de la violence, du sabotage, de l'absentéisme, du chapardage, de l'alcoolisme et des stupéfiants. Elle s'extériorise aussi par la participation des travailleurs aux mouvements politiques extrémistes, par le rejet de toutes formes d'activités communautaires et par la recherche d'un type de loisirs qui exclut les relations interpersonnelles.

LA LUTTE CONTRE L'ALIÉNATION PAR LE TRAVAIL

Pour contrecarrer l'aliénation, les spécialistes ont préconisé des réformes sociales. Dans le domaine des relations professionnelles, celles-ci ont soulevé un intérêt considérable et la mise en train de nombre d'expériences socio-techniques visant à accroître la productivité, à augmenter la motivation au travail et à former des groupes spéciaux de travailleurs : systèmes de primes au rendement variées, réaménagement des lieux de travail, installation de dispositifs favorisant les communications et les consultations entre les employés.

On peut dire que ces expériences visent les buts suivants : chercher à créer des emplois plus intéressants et à favoriser l'interaction entre les employés ; développer le sens de la responsabilité chez les travailleurs ; établir une ambiance et un environnement plus égalitaire ; faciliter la communication et la consultation entre les différents groupes d'employés; adopter certaines mesures spéciales concernant le mode de rémunération du travail.

L'auteur donne ensuite certains exemples concrets où de bons résultats ont été obtenus. Dans une usine de la compagnie General Foods, on a, par exemple, formé des groupes de travail autonomes, ajouté des activités de soutien au travail de production, valorisé certains postes de travail, etc. Dans certaines fabriques d'automobiles, on a remplacé la production à la chaîne traditionnelle par des groupes d'assembleurs.

Il est difficile de donner une appréciation globale de ces expériences. Toutefois, après une période de tâtonnement, elles semblent répondre aux attentes des employeurs. Il y a plusieurs avantages dans cette façon expérimentale d'améliorer la qualité de la vie en milieu de travail. L'efficacité et le moral des travailleurs s'améliorent. En ce qui concerne la recherche, cette façon de procéder permet de faire des comparaisons valables. Elle permet aussi de constater si les sociologues ont erré dans leur appréciation de l'état d'esprit des travailleurs. Par ailleurs, ces expériences ne permettent pas de conclure à coup sûr qu'elles ont contribué à accroître les connaissances au sujet de la qualité de la vie ni à découvrir des moyens efficaces et certains de l'améliorer. Ces expériences ne sont pas non plus facilement exportables. Il se peut aussi, en en considérant les résultats, bons ou mauvais, qu'on ne saisisse pas les causes véritables.

Dans le domaine de la recherche, dans quelle voie, compte tenu de ce qui a été accompli jusqu'ici, faut-il s'engager? Ce qui semble presser le plus, c'est de mettre au point une théorie générale valable. Les méthodes de mesure de la satisfaction au travail ont été jusqu'à maintenant trop empiriques. Les nouvelles formules devront être plus complexes, s'appuyer sur de nombreuses variables.

L'ATTITUDE DES SYNDICATS ET LE RÔLE DE L'ÉTAT

Un des phénomènes les plus paradoxaux en Amérique du Nord, c'est que les syndicats attachent assez peu d'attention aux efforts qui sont faits pour améliorer la qualité de la vie en milieu de travail alors que l'on pourrait naturellement penser qu'ils devraient être à l'avant-garde de ce mouvement. À quoi attribuer cette attitude ? L'auteur en voit la raison d'abord dans le fait que les dirigeants syndicaux craignent de perdre leur emprise auprès des travailleurs. D'autre part, les conventions collectives de travail tendent à enfermer dans la négociation des règlements d'atelier et des spécifications d'emploi. Troisièmement, les syndicats mettent toujours l'accent sur les gains matériels et sur les questions d'argent, en particulier dans les périodes d'inflation. Enfin, les syndicats considèrent que toute tentative en vue d'améliorer le milieu de travail est un moyen pour les employeurs de s'assurer une part plus grande des profits obtenus par l'accroissement de la productivité.

En ce qui concerne l'État, on est enclin à se demander si c'est bien la fonction de s'engager systématiquement sur ce terrain. Cependant, les mesures destinées à protéger la santé physique et mentale des travailleurs peuvent l'inciter à se préoccuper de la question. Une chose apparaît certaine : les gouvernements ne peuvent plus ignorer le problème.

En bref, l'auteur s'est efforcé de poser le problème de la qualité de la vie en milieu de travail tant en ce qui concerne le double phénomène de la satisfaction au travail que de l'aliénation par le travail. Son étude constitue une revue à vol d'oiseau fort intéressante qui rappelle les nombreuses études et les expériences concrètes qui ont été effectuées en cette matière, principalement aux États-Unis, depuis une cinquantaine d'années.

INTRODUCTION

In the context of this topic, we will concentrate our discussion on wages, salaries, labour costs and expenditures and related conditions. This is not to say that the possible implementation of the processes we will be discussing in this paper could not be explored to cover other forms of costs and expenditures as well.

Here are the reasons which brought us to such a discussion. As readers may note, they are far from following out of a highly integrated or logical order.

First, we share with many a concern for the ability of our industry and of our economy as a whole to compete and to expand in a world where our trading partners and friends are certainly not on the increase, if however the word « friends » can ever be used in the context of world trade. In the context of the concern just expressed, we are with many others, anxious to learn more about the impact of the collective bargaining system on our industry and public services ; for it is felt that through the knowledge of that impact, the system could be strenghtened so as perhaps to play a fuller role within the economy ; more specifically, we feel that we ought to know more not only about the total costs of collective bargaining but also about thebenefits that collective bargaining generates for industry, the economy and society as a whole ; we feel, therefore, that costing and cost-benefit analysis of the bargaining process is a function that could well serve our economic performance in total.

Secondly, we also share a concern with many, that the institution of collective bargaining is too often functioning today in a context of public hostility ; an hostility, often understandable, although not always justified, which could be detrimental to the normal functioning and development of the institution ; it is suggested here that the release of data, in appropriate form, on the impact of collective bargaining, in terms of benefits as well as costs, could assist in rehabilitating the institution in the eyes of many.

Thirdly, we deplore what we view as excessive introversion on the part of too many members of our collective bargaining research community, including the author of this article, with regard to the institution itself. It is our belief that we tend too often to study collective bargaining for collective bargaining sake, and we often fail to sufficiently concern ourselves with and to study the wider impact, in both cost and benefit terms, of some collective bargaining decisions. What is meant particularly here is that too often, insufficient attention is, in our view, paid to the wider potential use that could be made of procedures and mechanisms generated through collective bargaining.

At the risk of oversimplifying, we consider that a labour-management experiment on which a favourable cost-benefit tag could be placed could perhaps be more easily exported, either in total or in part, into a non-labour relations context, where it might prove to be highly useful. For instance, the success of a joint union-management employee development program, success that can be shown through a very favourable assessment from a cost-benefit angle, may increase the chances of this program of being tried in other contexts than that of labour relations.

Fourthly, we suggest that collective bargaining costing may well lead to the repeated discovery of a phenomenon that has been long considered more or less as the private domain of « idealists » and « dreamers », and that is that a reduction in costs for employers could be, more often than suspected, coupled with increased well-being for employees.

Fifthly, we believe that the collective bargaining system in the Federal Public Service, because of the lesser competitive context within which it operates, could perhaps, within acceptable and feasible limits, offer for wider assessment the experience, expressed in appropriate cost and benefit terms, that its implementation has generated. We would consider that such exposure, if possible, of the Federal Public Service collective bargaining system and of its results to the wider collective bargaining community could well serve the public interest.

Sixthly, another of our reasons for being happy to discuss our topic, is of course that our Pay Research Bureau has certainly played for many years a pioneering role in developing information on a wide range of fringe benefit expenditures as well as on their incidence and characteristics. Incidentally, may we also mention the currently developed Pay Research Bureau program of AUTOCODS, which, using computer facilities, is aimed at producing wage and salary information on a current basis. What might also be considered is the feasibility of applying similar techniques to the collection and presentation of fringe benefit information so as to facilitate the analysis of the «  total compensation package ». Such data — gathering effort would certainly be of relevance in any costing, or cost-benefit analysis effort.

Seventhly, it is also felt that the costing and cost-benefit analysis of collective bargaining may assist in due time in the development of banks of information relating to labour relations' experiences. In referring to these new types of banks, the expression « Experience banks » is used so as to make the distinction between these and the already existing and well functioning « Data Banks » on the contents of collective agreement provisions.

At this very early stage of our article, we hope to be forgiven if we point out that our discussion of the possible establishment of collective bargaining experience banks is based in part on our reading of a book by a leading French Medical Doctor deploring the harmful effects that the lack of proper medical experience information could have, in certain instances, on the outcome of medical treatment ¹. I shall quote a couple of paragraphs from that book : ... I have... seen patients die who could have been cured if sufficient information would have been provided, through the reading of an article lost in one of the thousands specialized medical journals which are published every month in the world, regarding the manner in which the fatal accident could be avoided »². (Translation)

We certainly do not wish to dramatize, but can we be accused of undue exageration in suggesting that in the field of labour relations perhaps many a conciliator, mediator, industriel relations manager, arbitrator, or union negotiator, or union management negotiators jointly, in whatever jurisdiction, may have been justified at one time or another of their involvement in saying : « We could have succeeded in solving certain disputes much faster, and in preventing certain situations from deteriorating, had we had knowledge of successful solutions previously brought to similar problems elsewhere ». Of course, not any more than medical experience banks would, or are preventing people from getting sick, would experience banks in labour relations solve all problems, but it is suggested here that they could be of assistance. And to the extent that cost data provide information as to the workings of collective bargaining policies and practices, collective bargaining costing and cost-benefit analysis, will be instrumental in the setting up of those experience banks to which reference has just been made.

Although we do not wish to overstress the point, we cannot resist to the enjoyment of drawing a parallel between another quotation from the book we just referred to, and the field of labour relations. In referring to information that could be stored in medical experience banks, the author of the book, Dr. Hamburger, writes : « The computer will not only respond to directives such as : could you list all the possible causes of convulsions in pregnant women ? Or what is the optimum dose of « chloramphinicol » for a child of 10 years who suffers from typhoid fever ? The computer will also respond, provided it has been well conditioned, to questions such as : what is the likelihood for a pregnant woman who has contracted german measles 85 days after the date of her latest menstruation to give birth to a malformed child ? » ³.

For the enjoyment of the readers we would leave it up to them to raise similar questions pertaining to labour relations problems the solution of which could be made easier through stored experience information. We might perhapsraise a few questions on my own : is it lacking in realism to suggest that stored labour relations experienced information could provide meaningful information to the following queries — which could of course be made more specific : « What is the most frequent, or typical, response of younger employees — between the ages of 20 and 25 — to training requirements when subjected to a training provision which does provide that in exchange for receiving training, they shall quarantee service to the company for a period of time of no less than two years ? » « What are the problems, if any, encountered when employees promoted to a position of foreman outside the bargaining unit, but not successfully completing their probationary period in the new job, are returned to their former jobs with full seniority rights ? » « What is the attitude of unskilled employees between the age of 40 and 50, towards a skill upgrading program involving a required submission to tests ? » « What are typical career paths, if any, followed by employees after having gone through the adjudication process involving matters of discipline ? » Such questions could of course be made to apply specifically to either professional or non-professional employees.

COLLECTIVE BARGAINING COSTING

Some Prerequisites of Costing

At the outset, we would like to very briefly refer to the prerequisites of costing collective bargaining settlements and results. As we have already dealt at some length with these prerequisites in a previous document⁴, we shall deal with them very quickly at this time. Research conducted in currently existing costing methodologies has clearly indicated that good and reliable costing implies a thorough knowledge of the contents of collective agreements ; that if costing is to be usefully done on a broad basis, that is in the context of an industry or in a wider context than industry, a standard methodology and terminology is in need of development so that costs are identified in the same manner and are assembled in roughly the same way. It also appears that if the costing function is to be further developed, more contacts ought to take place between costing experts in our industries so that gradually a more common approach to costing might emerge. Let me emphasize here that we were, in doing our own costing research, much impressed with the high degree of professional competence of the costing experts we were privileged to meet ; however, what we seemed also to perceive — we might be wrong — is that these costing experts tended to operate in a context of isolation and did not seem to have frequent opportunities to offer the benefit of their experience to their colleagues, and neither had they frequent opportunities to benefit from their colleagues' experience. At any rate, there is, in our view, in the field of costing, considerable talent that could perhaps be used in the pursuit of broader research objectives. We should also add here that on a previous occasion, we had called for a broadly-based seminar of costing experts for the specific purpose of developing a more standardized costing methodology.

QUALITATIVE ASPECTS OF THE COSTING FUNCTION

If costing has certain prerequisites, it has also what we view as an exciting side. For, if costing is to be meaningful, it should cover all measurable items of collective bargaining clauses, settlements and practices. And if collective bargaining benefits and clauses are introduced in labour contracts to respond to different aspirations, needs and requirements of employees and of management, it is submitted here that the expenditures that can be traced to the implementation of these various clauses and provisions can be subjected to some kind ofqualitative evaluation. On a previous occasion, we had wondered whether expenditures on overtime could be looked at in the same way as expenditures on retraining provisions ; whether expenditures on increased night shift premiums could be approached in the same manner as expenditures on provisions designed to assist in combating the pollution gradually invading some work environments.

At this time, could we phrase a similar question in more down-to-earth terms, from a qualitative standpoint : is a million dollars spent on overtime equal in every respect to a million dollars spent on retraining or in combating pollution in the work environment ? What is simply suggested here is that an examination of certain expenditures under collective bargaining, as part of the total costing effort, inevitably covers built-in wider social concerns. Such cost examination, therefore, may well pave the way for an assessment of the social contribution made by collective bargaining in meeting these broader concerns, in the instances just cited, the social concern for the protection of the environment and for the training of the labour force.

The costing of total expenditures under collective bargaining raises other important questions : for example, determining the extent to which certain benefits to employees are, in addition to being benefits per se, a form of additional or indirect income to employees. Paid safety shoes, paid rain-coats, paid uniforms, paid safety glasses may be considered as a form of indirect income but again hère, we perhaps should not restrict ourselves to look at the costs of such benefits, but also at the contributions that thèse may make as incentives to better work practices and even better work morale and productivity. What is simply suggested here is that costing almost naturally leads, in certain areas of the collective agreement at least, to an assessment of the benefits that are built-in certain costs. One could almost argue that the cost-benefit analysis of collective bargaining is, in a sense, the natural, although not illegitimate, offspring of costing per se.

Direct, Indirect and Impact Costs of Collective Bargaining

An analysis of the verynature of the costs incurred as a result of collective bargaining is also of practical interest⁵. Costing experts — at least those I was privileged to consult — usually make the distinction betweendirect costs of settlements andimpact costs of settlements. For example, the direct cost of awage increase is the increase in wage payments resulting from it ; one of the impact costs of such wage increase is the increase in vacation costs that result from it ; for example, the impact cost resulting from four weeks' paid vacation which must be paid at an increased straight-time rate, as a result of the wage settlement. Although the line is not always clear — at least to us— between what anindirect cost is and what an impact cost is, distinctions are made between the impact costs of the type we have just referred to and indirect costs that, for example, would be incurred if, as a result of the negotiation of a specific collective agreement provision, specialized staff of one kind or another had to be hired by the employer to implement the new provision. For example, industrial engineers might have to be hired following the negotiation of a clause providing for the systematic evaluation of jobs and duties ; or more nurses might have to be hired, so that first aid could be provided, if necessary, on the night shift as well as on the day shift.

For Discussion : Factors that Might Affect the Costing Function

The latter considerations do suggest that the process of costing cannot be divorced from the industrial or economic environment within which it is conducted. We do not feel that extensive discussions are required to demonstrate that in addition to varying direct bargaining and settlement costs, indirect and impact bargaining costs are also bound to vary from one environment to another. Perhaps one example will suffice here : in an industry where the operation is continuous, the granting of an additional paid statutory holiday may well result in additional costs due not only to the additional holiday but also due to the fact that the plant, having to be kept operating on a 24-hours basis, seven days a week, employees might then have to be kept working on that extra paid holiday at overtime rates, in addition to their holiday pay. On the other hand, an extra paid holiday for teachers might present no cost problem of any significance in certain cases, since that cost might be absorbed through the rescheduling of classes.

From our research post, we can only offer some further speculations for the consideration of readers regarding the varying degree of motivation that might inspire costing efforts. Some of the following considerations might not always totally reflect realities, and some readers, closer to the matters we will be raisin g in this section of the article could have some comments.

A given organization where labour costs represent a small proportion of total production costs might be under less pressure to undertake the thorough costing of its labour settlements than a firm where labour costs do indeed represent a high proportion of total costs. In addition to these internal factors, external factors, that is factors external to the organization, may have an impact on costing requirements. Persistently buoyant market conditions may not act as a particularly strong incentive to conduct costing on a comprehensive basis.

Increased competition, on the other hand, may be an incentive to introduce or to perfect a comprehensive cost assessment method. On the contrary, from thestrong position or even dominant position of an organization in a given market a fuller recognition of the costing need might only slowly, if not painfully, develop ⁶.

In addition to factors — such as those just outlined — that could conceivably play a part in determining the rank occupied by the costing function in the order of administrative priorities of a given organization, considerations such as the need to protect the competitive position of a given firm could conceivably place costing and cost-benefit information in the sensitive data package that is not to be circulated.

The Development of Collective Bargaining Experience Information

Whatever the case may be, we feel however justified in suggesting that in the field of labour relations today — as in some fields of medicine, as is discussed in the book to which reference was made earlier — a number of positive collective bargaining experiments -— on which incidentally, favourable cost-benefit tags might perhaps be placed — might never be brought to the attention of the very organizations which might derive much benefit from them.

What has just been observed is based on an assumption — which the research we have conducted so far has not invalidated — that in many a collective bargaining experiment there may be elements of wide relevance and therefore of wide potential application into labour relations and occupational contexts that may have little in common with the context within which the experiment initially took place.

And perhaps one of the grinding yet challenging tasks facing labour relations researchers today is to thoroughly explore the ways in which an impartially set up experience information network might be developed, network that would make it possible for the largest possible number of organizations in all jurisdictions — on both the employee and management side, and perhaps even most important in the third-party area — to have access to experience information. The development of such experience information would of course involve the assessment of positive, and less than positive, experiments and provisions, since there may be equal benefit in knowing the reasons why certain things failed, as in knowing why others succeeded. Hopefully, such experience information could be researched, processed, presented and constantlyupdated in such a manner as to minimize the restrictions that might be placed on its availability as a result of some of the factors discussed earlier in this paper ; in so doing the number of instances might be minimized where otherwise broadly useful information might have to be kept buried in packages of sensitive and highly restricted data.

Operational Contexts of Costing

Returning to more practical considerations, one has to envisage very briefly the several contexts within which costing can be conducted. Costing can be conducted strictly within the context of the bargaining unit. Within that context, it might be noted that the full costing of a given provision of the collectiveagreement may have to be done at least in part by assessing and measuring the costs incurred under another clause⁷. For example, some of the costs resulting from a closed shop provision requiring the employer to hire union members only and, thereby, possibly limiting the labour supply, might have to be assessed through an examination of expenditures under the overtime provision in view of the fact that the limited number of available employees might have to work a substantial number of overtime hours in order to meet production requirements.

Also, high overtime costs indicating a frequent recourse to overtime work, might, in certain contexts, be related to high turnover costs since frequent overtime may be a factor encouraging employees to look for employment where the work is performed within a more regular schedule.

From a broader methodological standpoint, we might stress that a bargaining cost-analysis conducted on a clause to clause basis might present incomplete and even misleading information regarding the cost impact of certain provisions in view of the fact that such cost impact may have to be measured through expenditures under a variety of other provisions as well ⁸.

Suggested Potential Uses of Costing

The costs of collective bargaining can of course also be traced in contexts wider than that of the bargaining unit per se. We need not draw attention to the obvious impact that a wage increase for unionized employees can have for unorganized personnel in the same firm or plant. And of course collective bargaining settlements may have a cost impact extending into unorganized firms where the law of supply and demand for certain types of occupations may require that the same wage rates be paid to unorganized employees as those paid to unionized employees.

We have in a previous paper discussed some of the uses that can be made of costing in a broader context than collective bargaining per se⁹. But there is perhaps one function that we did not discuss and that we would submit for the consideration of readers ; it is the predictive function of costing not in terms of predicting the costs that will be incurred as a result of settlements but in terms of providing indications and signs that problems and storms may be ahead in a given bargaining unit, in other words, providing « storm signals » ¹⁰.

For example, an analysis of expenditures under certain types of provisions, such as the grievance procedure, can reveal a deteriorating working climate in the plant. Mounting costs due to turnover, absenteism can likewise reveal, or confirm, in a tangible manner, a lack of organizational response to employees' needs ¹¹. In that predictive sense, one should not exclude situations where costing under collective bargaining can provide the much needed additional evidence which will confirm what has been observed at the broader societal level. Obviously, developing social disorders can have an impact on expenditures incurred under specific clauses of the labour contract¹². In that sense, collective bargaining cost analysis may be a tool supporting broader social analysis.

Costing can also be an appropriate tool for the measurement of the increasing obsolescence, or use, of a specific clause, to the extent that the volume of expenditures incurred under the provision being examined constitutes a reliable indicator of the degree of its actual implementation.

COST-BENEFIT ANALYSIS OF COLLECTIVE BARGAINING

Perhaps, we should now turn more specifically to the benefit side of collective bargaining. It should also be pointed out that our approach, at this time, to cost-benefit analysis is very pragmatic. For the purpose of this article, what we view as benefits to organizations derived from bargaining practices, are decreases in costs, or the avoidance of costs, that would have otherwise been incurred had certain provisions not existed, or had existing provisions not been modified, or had existing provisions not been dropped.

At the outset, it must be recognized that cost-benefit analysis — as costing — is at times impractical or even impossible to conduct in strictly monetary terms ¹³. It is, for instance, difficult to undertake the strict cost-benefit analysis of seniority provisions which, on the one hand, through their ability requirements, respond to operational and efficiency needs, and, on the other hand, through therecognition of length of service, can be said to respond to more welfare-oriented considerations. We hasten to add that a proper cost-benefit approach, which in this case might only mean a balanced approach, does not necessarily mean that the costs to employers result from the recognition of length of service for there can also be benefits to employers as well as to employees through that recognition of service ; as there can also be benefits to both employees and employers through the ability requirements contained in the provision.

As is the case of the costing function, cost-benefit analysis can also be conducted in a variety of contexts. But in the case of cost-benefit analysis, it would seem to me that the requirement to undertake it in as broad a context as possible seems to be even more imperative than in the case of costing ; we would hope that the following observations would illustrate that statement.

Cost-benefit analysis conducted in the context of the bargaining unit can reveal that the introduction of certain provisions can lead to increased expenditures through their direct implementation, while reducing costs under certain types of other provisions. For instance, in referring to an example of a case that we have already discussed, in another seminar¹⁴, a grievance committee could involve costs to the employers in terms of the paid time that might have to be provided to those employees who will serve on the committee in order to investigate grounds for potential grievances, and to examine actual grievances and process them. Tt also involves additional costs to the employer in view of the fact that the employees serving on the grievance committee might have to be replaced by other employees to carry out duties normally performed by those serve on the committee. However, such grievance committee might, over a period of time, lead to a decrease in expenditures under provisions such as paid rest periods, paid wash-up time that might have been excessively used and unduly prolonged by employees as a way of protesting against a mounting backlog of unprocessed and unexamined grievances. Of course, the establishment of the grievance committee might also lead to a decrease in other expenditures that could not be traced to any one provision of the labour contract, indeed if they could be measured and traced at all.

Suggested Uses of Cost-benefit Analysis in Contexts Broader Than the Bargaining Unit

As in the case of costing, cost-benefit analysis can be conducted in contexts broader than of the bargaining unit. The cost-benefit analysis exercise, for example, can assist in throwing factual light on the successful side of experiences and experiments that have taken place as a result of collective bargaining in the organized segment of a firm, and at least could be tested and applied in the non-unionized sector of the organization. The implementation of certain elements of training provisions, of grievance handling clauses might conceivably have positive value for both management, and unorganized personnel.

We would venture to suggest incidentally, that the cost-benefit analysis of collective bargaining within certain organizations might lead to the development of an understanding of the collective bargaining process not necessarily concern-traded in the industrial relations department of an organization. That perhaps more evenly spread understanding of the collective bargaining process, in the light of its assessed benefits as well as of its costs, could well be one of the factors generating a broad managerial approach to the problems faced by a firm, which might mean that industrial relations personnel might be, at an early stage, associated with, for instance, operational decision-making having a manpower impact.

We suggest that the cost-benefit analysis function may have broad potential use. A cost-benefit analysis of certain collective bargaining practices might facilitate the introduction of certain types of legislation, some elements of which might formalize what was previously provided for under clauses of collective agreements

Cost-benefit Analysis : Some Other Suggested Areas for Possible Experimentation

The cost-benefit approach might be tested on a number of provisions of collective agreements¹⁵; among these might be certain types of technological change provisions, on which some form of cost-benefit assessment might be experimented. Is it lacking in realism to suggest that provisions for advance notice in case of technological change might, — at least in certain contexts — by reducing the depressing effect of uncontrolled rumors regarding impending changes in technology, have a positive impact on work performance and work attitude ?

More generally, it can be argued that the cost-benefit analysis function may generate a better and deeper appreciation of the values as well as of the short-comings of the collective bargaining process. (In view of the current widespread emphasis on the short-comings of collective bargaining, we hope to be forgiven if we tend to emphasize the benefits derived from the institution, at this time.)

Equal pay, equal work provisions can generate additional costs to the extent that they may bring about wage and salary increases so as to bring certain salary and wage rates in line with those paid for jobs involving the same functions and duties ; but in terms of benefits, such provisions can also bring about a fuller utilization of talent in groups of employees who may gain easier access to a wider range of jobs and occupations, — whether such employees gaining such easier access are females in a predominantly male environment, or males in a predominantly female environment.

It might not be unrealistic to assume that certain provisions, that do represent costs, but that improve the morale and work attitude of unionized personnel canenrich and upgrade both the status and output of the supervisory function, thereby reducing costs associated with a relatively high turnover and/or low output of supervisory personnel finding neither challenge nor interest in the direction of an unmotivated and unresponsive work force.

Another example. The cost-benefit analysis of a negotiated and intelligently implemented skill upgrading plan could produce highly favourable results in terms of benefits to both employer and employees to the extent that such plan, by literally exhuming the previously undiscovered and therefore dormant skills in certain employees, might reduce the costs that might have otherwise been incurred if the required skilled personnel had to be hired from the outside, and gradually familiarized with the operations of the plant.

The following and last example may also be offered for consideration. A work and employment guarantee clause, which might prove costly to the employer, might of course be expected to be beneficial to the employees it covers, and the further question can be raised as to whether or not social costs might not be avoided through a clause of that sort : for the absence of that work guarantee provision might have generated social costs in terms of payment of unemployment insurance benefits to workers who might have had to be laid off had the provision not been negotiated. On the other hand, such provision, to the extent that it involved recognition of seniority, might also prevent, or delay, the employment of younger and perhaps better trained workers, thereby leading to social costs.

CONCLUSION

We shall now conclude, our purpose in presenting this article was, at this time, to stimulate thought and discussion on the need, obvious and even pressing in our view, to research the ways in which labour relations experience banks might be established, and the ways in which the labour relations costing function might be assessed not only as one of the tools that might be used for the development of such experience banks but also as a process strengthening both the institution of collective bargaining and the contributions it is making to our socio-economic performance. Of equal importance at this stage is that those with experience in this field should seek ways of communicating their knowledge to others. It is, after all, only through such communication that the collective bargaining process in its totality will develop and progress.

We earnestly hope that our labour and staff relations research community — in all jurisdictions — will find time and resources to devote to that research effort, which could well serve not only the institution of collective bargaining but the public interest as well.

10 We should mention here that our first acquaintance with the expression « storm signals » dates back to 1967, when we read a very interesting article entitled « After the race war, a blueprint for peace », published in theToronto Daily Star of August 5, 1967, by Professor Moynihan, in which the author explained among other things, how «  storm signals » — exprqssed in statistical terms — had developed well in advance of the outbreak of the 1967 Detroit riots; in the article, the author also suggested that these signals, if properly studied, might have been helpful in at least foreseeing the possibility of violent outbreak. 11 Costing could also be viewed as a useful tool in assessing thedegree of coherence of certain collective bargaining policies, in terms of their cost implications: for example, the successful introduction of a given collective agreement provision designed to decrease costs and achieving its purpose, might result in considerable increases in expenditures under other clauses of the agreement. It might be further noted that the decrease in costs might be/ immediately measured, while the increase in expenditures might only be assessed after a period of time; which leads to a more general observation: and that is that bargaining cost examination can be conducted in a context of immediate cost decreases and long-term cost increases, or immediate cost increases and long-term cost decreases. (Training provisions might be an instance of the latter context.)

12 For example, unsafe urban conditions, over which the parties to collective bargaining have no control, can lead to increased costs to employers: a case in point is, in some cities, the provision, described as highly desirable, of transportation to certain employees working on the evening shift, so they can reach home safely.

L'évaluation du coût des revendications en matière d'avantages sociaux au cours de la négociation des conventions collectives est chose complexe. Elle l'est d'autant plus que l'on ne s'entend généralement pas sur la terminologie et la méthode d'analyse qui varient d'un employeur à l'autre. Aussi les recherchistes ont-ils beaucoup de difficultés à mettre au point un système qui soit valable pour les entreprises et les associations d'employeurs, principalement celles qui possèdent déjà leur propre système de calcul.

D'une part, les petites sociétés, qui ne possèdent pas un service de relations professionnelles aguerri, ne peuvent pas facilement extraire les statistiques utiles à cette fin de leur bordereau de paie.

C'est dans l'intention de pallier à cet état de choses qu'un sous-comité de recherche del’Employers' Council of British Columbia a tenté de trouver une méthode permettant d'en arriver à une certaine standardisation dans ce domaine. L'expérience fut utile : on a pu en arriver à un certain degré d'uniformisation dans la terminologie, faire prendre conscience aux petites entreprises de l'importance de ce facteur dans l'évaluation des coûts, échanger des renseignements. Il y a eu une évolution certaine en Colombie Britannique, même si l'on doit encore recourir au pifomètre en attendant que les définitions proposées deviennent plus familières.

La Commission de médiation du ministère du Travail a fait, elle aussi, de grands efforts pour établir un service efficace afin d'aider au calcul du coût des avantages sociaux mais la grande difficulté ce fut de la vendre aux médiateurs, aux employeurs et aux dirigeants syndicaux. Cela n'a pas réussi et le service est disparu, l'automne dernier, en même temps que la Commission de médiation.

Néanmoins, il reste possible de faire accepter un tel service à condition de démontrer de façon concrète l'utilité, l'importance et la valeur pratique de tels calculs.

Un service du calcul du coût des avantages sociaux doit être un instrument de communication qui comporte à la fois la cueillette, l'emmagasinage, l'analyse et la diffusion des renseignements sur le coût de travail. Le service sera d'autant plus efficace qu'il sera en mesure de fournir rapidement des renseignements présentés avec clarté et avec simplicité.

Les renseignements sont requis à trois paliers : dans l'entreprise d'abord dans un but de planification, de vérification et de mise au point des méthodes à suivre dans l'évolution du régime des relations professionnelles, à la table de négociation, pour répondre enfin aux demandes des syndicats, des employeurs et du gouvernement.

C'est l'entreprise qui réclame le plus de tels renseignements afin de savoir comment les avantages sociaux qu'elle accorde se comparent avec ce qui existe ailleurs dans l'industrie et le milieu économique, afin d'établir les écarts, dans la négociation collective, entre ce qui est demandé et ce qu'elle est disposée à concéder, afin de connaître quel sera le coût pécuniaire des modifications à l'étude. Ce sont là des questions auxquelles les dirigeants d'entreprise veulent obtenir une réponse immédiate au moment où elles ont toute leur utilité. Ceci est encore plus vrai à la pointe des négociations quand les négociateurs des deux parties veulent connaître le coût en argent sonnant de ce qui les sépare.

Malheureusement, dans cette situation, on ne se préoccupe pas de ce que coûteront les nouveaux avantages accordés dans un avenir plus éloigné, qui dépasse la durée d'une convention collective. L'établissement du coût des avantages sociaux à longue échéance exige des ressources spéciales et des techniques raffinées qui ne sont pas à la portée des petites entreprises, d'où l'utilité d'un pareil service qui disposerait des instruments de travail nécessaires pour faire de semblables projections dans l'avenir.

Toutefois, c'est peut-être dans le cours normal des négociations qu'un tel service s'imposerait à condition que les parties soient prêtes à en reconnaître le travail objectif, ce qui aurait pour conséquence de favoriser une négociation intelligente et constructive.

Cet article tente de regrouper autour de deux pratiques de calcul, à savoir l'estimation et l'évaluation des coûts, les méthodes ou techniques habituellement utilisées dans les entreprises.

EN :

Cost evaluation and cost estimation are often misused by those interested in the identification and quantification of the application costs of a collective agreement. This paper aims at classifying in relation to these two calculation practices those methods or techniques generally used by the firm.

Cost estimation is a practice referring mainly to the rapid availability of statistical information in order to complete a projection of the additional costs caused by the renewal of a collective agreement. Cost evaluation refers mainly to a systematic and rational analysis covering a longer period, i.e. the life of the agreement, in order to control expenditures and to make some forecasts. Cost estimation is by far the most largely spread calculation practice in the firm.

Indeed, because of differences in stress situations and because of the belief that cost projections done in bargaining are sufficiently valid, cost evaluation is not as popular and as widely used as cost estimation. Such a cost evaluation method is limited by relatively important disadvantages. Indeed little or no concern is given to the costs and revenues stemming from changes in the essentially non-monetary provisions and negotiators are not able, with the methods in use, to quantify the indirect costs of monetary provisions.

The proposed method is not to be understood as an instrument to favorize the mutual destruction of the parties at the bargaining table. On the contrary, it aims at rationalizing the analysis of the monetary value of foreseable changes in the collective agreement in order to bring the parties to things more in the long term.

Generally speaking, the provisions of a collective agreement are evaluated in terms of direct costs. However the importance of indirect costs, although surely not forgotten, is generally not systematically evaluated and analyzed and too few interrelations are made. This brings up the point of the cost correction coefficient catalogue.

This catalogue, a booklet, includes a subdivision for each provision of the collective agreement. Direct costs are separately entered in each subdivision and, as for indirect costs, a complete list of those provisions indirectly related to a given clause is made. For each provision, a correction coefficient and the resultant cost in absolute value are indicated. The summation of such coefficients and indirect costs provides the total coefficient and the total indirect costs for a given agreement. The challenge stands within the effort to build correction coefficients. It is the basis of the validity of cost evaluation and cost estimation. More research is needed on such coefficients.

When one says that a cost for one party is a revenue for the other, we must keep in mind that it is gross revenue that is at stake. Indeed what concerns the worker is the increase in his actual available income. Therefore correction coffecients should also be used here if one wants to equate cost to satisfaction. Whereas for additional costs, coefficients are mostly positive in sign, they are generally negative for additional revenues.

It has been mentionned that cost estimation is more widely used than cost evaluation. One may however wonder how valid estimation of indirect costs of change in a provision can be obtained if no reference tool exists to identify the implications of such a clause on others and the degree of mutual influence. Correction coefficients find on additional rationale here.

Such an effort to systematize the cost measures of a collective agreement aims much more at bringing the parties to think in terms of positive satisfaction results stemming from expenses rather than exclusively looking and dollars and cents. This may be a better way to facilitate dialogue at the bargaining table.

This paper presents the union point of view on collective bargaining costing.

Le recours à l'argument du « coût » dans les négociations collectives apparaît être nettement abusif. Au cours des dernières années, l'État-employeur a mis au point une technique d'évaluation du coût des négociations qui est singulièrement trompeuse. La formule est simple. Il ne s'agit que d'additionner les demandes initiales du syndicat, de multiplier la somme ainsi obtenue par le nombre des employés et de la multiplier une fois de plus par deux ou par trois selon la durée de la convention collective projetée. Suivant le cadre de l'unité de négociation et la durée de la convention, on peut arriver à des sommes astronomiques et faire croire aux contribuables que les employés des entreprises publiques veulent les extorquer et qu'ils sont à la veille de mettre la stabilité économique du pays en danger.

Au fond, la tactique consiste à tenter de créer dans l'opinion publique l'impression qu'une revendication plutôt modérée du syndicat est fort exagérée. Les tenants de cette technique s'appuient sur le « Comment mentir avec les statistiques ? » et le « Plus le mensonge est grossier plus il a de chance d'être cru ».

Pour atteindre ce but, on procédera ainsi : toute demande du syndicat doit être évaluée au prix fort. Si le syndicat demande une journée de congé de deuil payée à l'occasion du décès du grand-père ou de la grand-mère d'un employé, l'employeur estimera que chaque employé perdra ses grands-parents pendant l'année. En voici une illustration. Au cours des négociations à la communauté urbaine de Toronto, pour faire ressortir le taux élevé du salaire du manoeuvre, on y avait ajouté une somme de $2,635.00 qui était censée représenter le coût des avantages sociaux. Or, il s'est avéré que ceci comprenait les sommes accordées pour vacances, congés payés et congés de maladie qui étaient déjà incluses dans le taux de salaire. Une fois cette somme déduite, le montant initial s'est trouvé réduit à $1,470.00 par année, et les avantages accessoires ne s'établissaient plus à 35 pour cent, mais à moins de 20 pour cent du revenu de l'employé.

Une autre façon d'impressionner le public, c'est le recours à l'effet multiplicateur, principalement dans le cas des grandes unités de négociation. Une augmentation de $1.00 par semaine par année pour une convention de trois ans, c'est peu. Mais si le groupe compte 5,000 travailleurs, cela fait tout de même la jolie somme de $1,300,000.00. Les négociations dans le secteur public au Québec sont une bonne illustration de la tactique. On a fait danser devant l'opinion publique le chiffre fabuleux de $250,000,000.00. Mais on n'a guère insisté pour dire que 250,000 salariés étaient en cause dans l'affaire.

On recourt encore à l'utilisation des statistiques globales, ce qui permet d'éviter l'estimation de la valeur relative des coûts pour chaque demande. On inclut aussi dans ces estimations tous les salariés de l'entreprise sous prétexte qu'il faudra accorder des avantages identiques aux employés qui ne font pas partie de l'unité de négociation. Il arrive même que l'on pousse encore plus loin. À Terre-Neuve, il y a quelques années, on négociait à un hôpital de Corner Brook les salaires des femmes de ménage qui étaient alors en grève. Il était question d'une majoration de $2.00 par semaine. Le gouvernement soutint qu'il devait accorder la même augmentation dans 30 autres hôpitaux et que le tout s'élèverait à $1,390,000.00. À un moment donné même, ce chiffre a atteint la somme de trois millions, car il fallait accorder cette majoration à tous les employés du gouvernement. C'est l'argument de la boule de neige qu'on fait grossir en la roulant.

Une des tactiques utilisées consiste à considérer les demandes initiales du syndicat qui sont généralement un peu gonflées comme sa réclamation minimale. Les journaux antisyndicaux se hâtent de publier ces chiffres impressionnants, non seulement pour berner les gens, mais aussi pour neutraliser l'appui des membres eux-mêmes.

Il importe de signaler d'autres points. On inclut aussi dans l'estimation le coût des contributions pour les accidents du travail, l'assurance-chômage, l'assurance-maladie, les rentes. Il est certain que ces montants ne devraient pas être inclus. Il devrait en être ainsi des deux premières semaines de vacances annuelles qui sont imposées par la loi partout au Canada. En effet, on estime à 42 pour cent du coût de l'ensemble des avantages sociaux ceux qui sont imposés par des mesures législatives.

Il s'agit là uniquement des facteurs à incidence directe qu'on peut compter. Jamais on ne fait entrer en ligne de compte l'accroissement de la productivité attribuable à la réduction de la durée du travail, à la retraite prématurée, à la meilleure formation professionnelle du personnel.

En réalité, le calcul des « coûts » dans la négociation collective repose sur deux hypothèses fausses : il ne se produira aucun changement dans le cours de la convention collective ; le taux de salaire et le coût du travail sont une seule et même chose.

Des changements se produisent en cours de convention dans le sexe, l'âge et la composition professionnelle des effectifs qui ne sont pas sans avoir beaucoup d'effet sur le coût du travail. Le changement dans les méthodes de travail doit aussi être considéré, car il y a nombre d'exemples où le coût par unité de travail a diminué même après la concession de majorations de salaire.

On peut conclure que l'employeur se trouve dans une situation privilégiée pour ce qui est de l'estimation du « coût » d'une négociation collective.

En guise de conclusion, deux suggestions concrètes : il devrait y avoir une loi qui oblige les employeurs à fournir aux syndicats dès le début des négociations collectives des renseignements exacts sur ces questions ; de même, les centrales syndicales devraient continuer à faire pression pour que le coût des mesures de sécurité sociale imposées par la loi soit assumé par les gouvernements à même leurs revenus ordinaires.

Before examining many of the myths surrounding the strike phenomenon, the author of this paper feels that the accuracy of the strike figures themselves should be questionned.

FR :

Chaque année, le ministère du Travail publie un rapport sur le nombre de jours de travail perdus à la suite des grèves. En 1972, le nombre s'établissait à 7,848,360 jours-hommes. Hommes d'affaires et journalistes alarmistes se sont prévalus de ce fait pour réclamer la restriction du droit de grève. Ces propos sont de nature à détourner l'attention des causes véritables des conflits du travail dont la grève n'est qu'une des manifestations.

En fait, le nombre de jours ainsi perdus n'équivaut qu'à deux cinquièmes de un pour cent des heures travaillées. Le temps perdu à cause de la maladie dépasse de beaucoup ce pourcentage. Quant au temps perdu par suite du chômage, on l'estime à plus de sept pour cent. Donc, parce qu'on met l'accent sur les grèves, on en vient vite à considérer qu'il s'agit là d'un problème social et économique plus grave que le chômage et les accidents du travail.

On peut également se demander ce que signifient ces statistiques dans la pratique. Ne sont-elles pas fondées sur des hypothèses dont on peut mettre en doute la valeur ? N'arrive-t-il pas qu'un certain nombre de travailleurs touchés par la grève auraient pu être licenciés, auraient pu tomber malades ou se seraient trouvés entraînés dans un mouvement de ralentissement du travail ? Par ailleurs, il est faux de prétendre que le temps de la grève est toujours irrémédiablement du temps perdu. On le reprend ensuite. Il ne faut pas oublier non plus que certains employeurs cherchent à sous-estimer le nombre des salariés touchés par la grève, alors que d'autres tendent à l'amplifier.

Ce n'est pas là l'aspect le plus important tout de même de la publication de ces statistiques. Parce qu'elles jettent une lumière crue sur une des facettes des relations du travail, elles contribuent à voiler bien d'autres éléments du problème considéré dans toute son ampleur. En réalité, ce ne sont pas tant les grèves qui instituent le vrai « problème », mais les huées et les clameurs qu'elles soulèvent. La presse, avec sa tendance à faire accepter le comportement anormal pour la règle générale et sa recherche ducatastrophisme, contribue à en fausser la signification.

Il est malheureusement impossible de mesurer les pertes de temps et de production causées par l'inefficacité de la direction dont les erreurs font perdre beaucoup plus de temps et baisser bien davantage la production que les grèves.

Il faut aussi se défier de l'importance que certains employeurs donnent aux pertes financières occasionnées par les grèves dont il faut déduire ce qu'ils n'ont pas à débourser en salaires et en achat de matières premières. On sait que certaines entreprises, faisant face à un surplus de production ou à des difficultés financières passagères, savent comment pousser leurs salariés à la grève. En un mot, il n'est pas possible d'évaluer les pertes réelles résultant des grèves et, en autant qu'il s'agit de la production, on peut aller jusqu'à dire qu'un vaccin antigrippe efficace permet d'épargner plus de temps que les mesures antigrèves les plus strictes. On condamne la grève parce qu'on la considère comme un comportement déviant, irrationnel et destructeur, alors que, en réalité, c'est le système industriel lui-même qui fait problème, la grève n'étant qu'une des manifestations de la rébellion contre le système.

En regard de la loi, on considère les employeurs et les travailleurs signataires d'une convention collective comme des parties égales. Mais elles ne sont pas si égales que cela. Le contrat, ramené à son élément essentiel, oblige le travailleur à servir l'employeur. Les travailleurs ne peuvent changer leurs conditions de travail sans l’acquiescement de l'employeur, tandis que ce dernier peut les modifier par voie d'autorité. Il est donc facile pour lui de se réclamer de la sainteté des contrats parce qu'il a rarement l'occasion de les violer.

Voilà pourquoi sous ce système, l'état de conflit apparaît endémique et inévitable. Au partage inégal de l'autorité s'ajoute celui de la distribution des richesses. Ce qui constitue le revenu de l'employé représente un coût que l'employeur s'efforce de minimiser le plus possible, même s'il arrive que les syndicats les plus puissants réussissent à arracher des augmentations de salaires supérieures à celles que l'employeur serait prêt à concéder. Au cours des soixante dernières années, la partdu travail dans le revenu national brut n'a varié que de quelques points, soit de 50 à 55 pour cent.

Il y a deux raisons pour lesquelles les conflits, donc les grèves, continueront d'exister : c'est que, d'abord, des facteurs comme le coût de la vie, le coût des matières premières et la valeur marchande du produit, échappent au contrôle des syndicats et parfois aussi des employeurs ; c'est aussi qu'il n'y a pas de point de saturation qui puisse être atteint pour ce qui est des majorations que souhaitent les salariés. D'ailleurs, sur ce dernier point, la publicité commerciale se charge bien de le leur rappeler chaque jour.

Cependant, même si, dans la plupart des grèves, le conflit porte ostensiblement sur les questions salariales, il ne fait pas de doute que beaucoup d'entre elles sont motivées par le sentiment d'insatisfaction qu'engendre le système lui-même. Il n'y a rien de nouveau dans ce phénomène. Les salariés ont toujours ressenti la dureté, la monotonie et, souvent le danger de leur travail. La seule différence avec le passé, c'est que, depuis quelques années, ils peuvent l'exprimer plus efficacement. Et le régime de la négociation collective tel qu'il est présentement structuré ne peut s'attaquer aux causes psychologiques de conflit. C'est pourquoi la grève dérive toujours vers des questions d'argent. Les travailleurs insistent pour être payés le plus possible non pas pas parce qu'ils placent la question du salaire au-dessus de toutes les autres, mais parce que l'action syndicale, étant ce qu'elle est aujourd'hui, ils ne peuvent toucher qu'au prix de leur travail et non aux conditions et au contenu de leur travail.

Cette situation engendre un mécontentement contre lequel il n'existe aucune valve de sécurité dans le régime actuel de négociation collective si ce n'est la grève, le ralentissement du travail et la « journée d'étude ». Cette situation suscite aussi nombre de réactions individuelles comme l'absentéisme, l'alcoolisme, la paresse, le travail bâclé ou même du vrai sabotage. Ce sont là autant de facteurs qui contribuent à abaisser la productivité beaucoup plus que les grèves et, pourtant, on s'y intéresse assez peu.

C'est une grave erreur que de croire que, parce que le travailleur est forcé de considérer son travail comme une marchandise, il s'attend aussi à ce que sa propre personne soit également traitée comme un objet de commerce. Aussi, trouvera-t-il toujours des moyens d'exprimer son mécontentement, individuellement ou collectivement. Si on impose des restrictions à l'exercice de la liberté collective par l'intermédiaire de son syndicat, il recourra à des méthodes personnelles de représailles.

Tout ceci permet de souligner que les statistiques relatives aux grèves ne sont qu'une mesure imparfaite de l'état de conflit ou de l'état de paix industrielle. Il est donc nécessaire de dépasser le cadre de ces statistiques pour avoir une vue juste de ces états. C'est une hypothèse dangereuse de penser que, s'il n'y avait pas de grèves, la production en serait d'autant accrue.

L'important c'est la suppression de la cause du mécontentement, car il ressort nettement de toutes les études faites sur le sujet que, partout où les travailleurs sont malheureux dans leur travail, ils expriment de quelque façon le malaise qu'ils ressentent, soit en se moquant des règlements et de la discipline, soit en abaissantla quantité ou la qualité de leur production. En fait, il y a une espèce d'interchangeabilité entre les grèves et l'absentéisme, les grèves et le roulement de la main-d'oeuvre. Dans certaines industries, le nombre des grèves tend à décroître à mesure que le taux de roulement de la main-d'oeuvre augmente. Au contraire, lorsque le taux de chômage s'élève, le taux de roulement de la main-d'oeuvre s'abaisse, mais les grèves et l'absentéisme se multiplient.

Les partisans des mesures restrictives en matière de grève s'inspirent de trois écoles de pensée. Pour les premiers, la grève est une déviation et une menace à la stabilité dustatu quo existant ; d'autres estiment que c'est lestatu quo lui-même qui fait problème et que, sans la grève ou d'autres formes de contestation, il ne sera jamais possible de changer la structure inhumaine et antidémocratique de l'industrie moderne ; une troisième école voit dans la grève un élément essentiel des relations du travail et un exutoire aux frustrations et aux ressentiments ce qui les incite à vouloir institutionnaliser l'instrument de la grève.

Considérée sous ce dernier aspect, la grève ne peut que causer une espèce de rupture entre les dirigeants syndicaux et les travailleurs du rang, d'où la naissance du factionalisme, du rejet par les membres des propositions de règlement et la défaite des dirigeants syndicaux à l'heure des élections. Un syndicat qui étouffe le mécontentement des travailleurs perd pour ainsi dire sa raison d'être.

Il n'en reste pas moins que les syndicats sont devenus une partie essentielle du mécanisme de contrôle social et, à ce propos, on peut dire d'une certaine façon que, du fait de leur association avec lespoliticiens et les employeurs dans différents comités ou commissions, ils appartiennent àl'establishment. C'est pourquoi d'ailleurs les employeurs acceptent facilement les clauses de sécurité syndicale. Ces pressions conservatrices ne s'étendent que rarement aux travailleurs du rang dont l'insatisfaction s'exprime par des grèves légales ou illégales, celles-ci étant ressenties comme un instrument révolutionnaire. La fréquence et la durée accrues des grèves au Canada est le symptôme d'un malaise profond.

Si les conflits vont toujours s'intensifiant, c'est que le régime actuel des relations professionnelles est inadéquat, et que ce n'est pas par des restrictions législatives qu'on résoudra le problème. Il s'agit là d'une vue absolument simpliste. Il y a et il y aura toujours dans l'industrie des conflits d'intérêts irréconciliables au sujet du partage des revenus, de la sécurité de l'emploi et de l'exercice de l'autorité.

Cet exposé n'avait qu'un objectif : montrer que la grève est un phénomène social complexe qu'on ne peut expliquer par les statistiques ni régler par l'adoption de mesures restrictives en matière d'exercice du droit de grève. Pour les travailleurs qui déclenchent une grève, la seule solution véritable se trouve dans la transformation du statut du travailleur et de la structure même des entreprises. Mais ce n'est pas pour demain.

Il est montré qu'on ne peut pas négliger les changements dans les parts du revenu national qui reviennent aux facteurs si on cherche à établir les rapports exacts entre les gains, la productivité et les prix.

L'argument du texte comporte deux points principaux : il est difficile d'arriver à des statistiques plus convenables pour les termes de l'identité tout en gardant des définitions qui s'accordent d'une façon précise ; et de toute façon les résultats obtenus en employant des conceptions globales sont suffisamment exacts pour expliquer les changements des relations en question et ne varient pas trop des mouvements observés dans les statistiques plus exactes de la productivité et des salaires. Les intéressés peuvent s'adresser à l'auteur s'ils désirent les renseignements complémentaires à l'article.

Une dernière remarque : l'identité des gains ne peut pas servir comme moyen de prévision d'un ou de plusieurs de ces termes, car évidemment les termes situés des deux côtés de l'expression se réduisent à la même chose. Cependant il fournit un moyen facile d'évaluer les rapports observés dans une prévision des comptes nationaux entre les gains, les coûts, la productivité et les prix.

Suivant l'auteur, l'introduction dans les conventions collectives aux États-Unis de dispositions relatives aux avantages d'appoint remonte à l'époque de la guerre, alors que le Conseil du travail en temps de guerre (War Labor Board) encouragea cette formule qui permettait de freiner l'inflation. Auparavant, les syndicats ne présentaient guère de revendications de cette nature, les employeurs estimant que de tels avantages relevaient strictement de leurs droits de direction.

Il y a trente ans, les avantages d'appoint équivalaient à cinq pour cent environ du coût du travail ; aujourd'hui, on les estime en moyenne entre 23 et 30 pour cent de ce coût.

Même, après tout ce temps, on ne s'entend pas encore sur la terminologie. L'expression « avantages d'appoint » n'a pas la même signification selon qu'il s'agit des syndicats, des employeurs ou des agences politiques. Au fond, l'imbroglio vient de ce que l'on n'est pas unanime sur la définition du salaire. Pour les uns, le salaire c'est ce que l'employé reçoit dans son enveloppe de paie chaque semaine. C'est là le point de vue des syndicats d'une façon générale. Les employeurs sont enclins à y ajouter tout ce qui entre dans le coût du travail. Quant aux fonctionnaires du travail, ils sont portés à faire certaines distinctions.

On peut en tout cas diviser les avantages d'appoint en deux catégories : ceux qui visent à maintenir le revenu de l'employé et ceux qui leur procurent des revenant-bon et des agréments, tout comme pour ce qui est des salaires, on parlera de salaires directs et de salaires indirects. C'est une formule commode, celle qu'il convient d'utiliser lorsqu'il s'agit de s'engager dans le calcul du coût des avantages sociaux, c'est-à-dire du salaire indirect.

Quel est le contenu du salaire indirect ? Pour les employeurs, il s'agit de tout argent qui est reçu par le travailleur et payé par l'employeur. Les syndicats considèrent comme salaire indirect les mesures qui font l'objet de négociations et qui sont garanties par les dispositions des conventions collectives. C'est là un sujet de désaccord entre les parties. L'employeur a tendance à faire ressortir tout le coût du travail tandis que le syndicat met l'accent sur les gains qu'il obtient à la table des négociations. Ceci conduit inévitablement à une interprétation différente du coût des avantages sociaux selon que l'on se trouve d'un côté ou de l'autre de la table. Quand il s'agit d'en apprécier le coût horaire, le cahier des charges est toujours plus élevé du côté de l'employeur.

Les syndicats considèrent que les sommes versées à la sécurité sociale, à la protection contre le chômage et les accidents du travail sont le prix que doit payer l'employeur du seul fait qu'il est employeur, peu importe qu'il doive ou non traiter avec un syndicat accrédité. D'autre part, sans contredire en principe le point de vue des syndicats, les employeurs déclarent que toute augmentation d'où qu'elle vienne fait partie intégrante des coûts pour l'entreprise. À ce propos, il convient de noter que, dans l'établissement de lignes directrices en matière de salaire, le Comité des conseillers économiques du Président (Présidents Council of Economie Advisers) n'a pas jugé bon de retenir le coût des différentes mesures de sécurité sociale auxquelles les employeurs contribuaient. Le coût de certaines mesures de sécurité sociale ne se laisse pas facilement évaluer. Quand il s'agit de l'établissement ou de la révision d'un régime de retraite, le rôle du médiateur devient d'autant plus délicat que les parties ont recours à des spécialistes, actuaires, comptables et fiduciaires, qui sont enclins à se montrer plutôt prudents lorsqu'ils ont à se prononcer sur le rendement des capitaux. Une erreur d'une demie de un pour cent dans l'appréciation du rendement du capital,4 3/4 p.c. par exemple, alors qu'on avait prévu un rendement de4 1/4 p.c. seulement, exigera des déboursés de 12 pour cent de moins pour assurer à ses bénéficiaires le revenu convenu. Voilà qui peut, en certains cas, représenter un beau magot. D'autres facteurs impondérablesexercent également une influence, comme la retraite prématurée, l'importance de la main-d'oeuvre féminine, etc.

Un autre problème qui se soulève, surtout quand il est nécessaire d'apprécier le coût des vacances payées, des congés payés, des absences rémunérées, c'est le choix du nombre moyen des heures travaillées au cours d'une année. Selon que l'on fonde le calcul sur 2,080, 2,000 ou 1,980 heures par année, on arrivera à des résultats passablement différents.

Dans la deuxième partie de son travail, l'auteur se demande : pour qui les avantages d'appoint. La réponse qui vient le plus naturellement à l'esprit, c'est de dire qu'ils sont pour les employés. Mais on peut se demander si cela est entièrement vrai. C'est là une question à laquelle on peut donner plusieurs réponses. Ceci ressort même du vocabulaire utilisé pour les désigner. Suivant les circonstances et les milieux, on parlera de coûts sociaux, de revenant-bon, d'avantages d'appoint, d'avantages de sécurité sociale, de salaires sociaux, de suppléments aux salaires.

Certes, on peut présumer que les salaires indirects visent à améliorer les conditions de vie des employés, mais certains sociologues sont d'un avis contraire. Il faut considérer que les employeurs veulent aussi y avoir leur compte, recueillir leur part de la récolte : se donner une bonne réputation, éloigner les syndicats, attirer la main-d'oeuvre, profiter d'avantages fiscaux intéressants, conserver leurs meilleurs employés. Ce ne sont là sans doute qu'explications fragmentaires, mais on ne peut les ignorer. Au fond, les partisans d'avantages d'appoint plus intéressants s'inspirent des mêmes motifs que les avocats des mouvements en faveur de l'humanisation du travail et de la valorisation des emplois. Deux buts sont recherchés selon qu'on les reçoit ou qu'on les accorde : apporter aux travailleurs certains avantages et stimuler la motivation au travail.

Tous les auteurs ne sont pas d'avis que les avantages d'appoint constituent des éléments valables de motivation au travail, ce qui ne signifie pas qu'ils doivent être diminués ni supprimés, mais tout simplement que, sur ce point, les négociateurs doivent regarder au-delà des gains en argent. S'il y a une suggestion à formuler, c'est que les différentes formes d'avantages sociaux soient adaptées aux besoins des travailleurs au fur et à mesure du déroulement de leur vie professionnelle. Par exemple, pourquoi un régime de retraite identique pour les jeunes travailleurs, les célibataires et les personnes qui sont sur le point d'abandonner le marché du travail ? Les besoins du père dont la famille comptent trois bambins ne sont pas les mêmes que ceux du père de trois grands adolescents. En bref, ne faut-il pas s'efforcer d'individualiser les avantages sociaux de telle sorte que les travailleurs se rendent compte que leur situation personnelle signifie vraiment quelque chose.

En ce sens, ne serait-il pas possible de discuter les questions relatives au salaire indirect à une table de négociation spéciale. Les parties, libérées de la recherche du gain et de la hantise du coût des avantages sociaux, pourraient discuter ces sujets avec plus de sérénité et plus d'ouverture d'esprit. De même, il leur serait plus facile de faire appel à une commission d'arbitrage en cas de désaccord.
