À travers le cas représentatif du Maroc, ce mémoire propose d'apporter une diversification au produit balnéaire dominant dans le marché touristique des pays émergents et de rajeunir leur image grâce à l'exploitation des représentations dynamiques et valorisantes évoquées par les nouveaux loisirs sportifs de montagne. Our article studies citizen participation in the Moroccan legal order through the case of petitions presented to the head of government between 2017 and 2021. Following a realistic jus positivist approach, it is interested in the conditions and procedures that allow the exercise of this right and the Asymmetrical relationship that is established with the same head of government. The right of petitions belongs to Moroccan citizens enjoying their civil and political rights and registered on the general electoral lists, however, the holder of the executive power rarely responds to his request. We will see that the frequent inadmissibility of petitions transforms citizen engagement into a means of speaking and accountability of the head of government whenever important causes receive negative responses or result in disqualification of their authors. We will also demonstrate how the processing of these petitions leads to contrasting uses of applicable law and how its consultative shift is asserted to legitimize alleged government actions. The effectiveness and efficiency of the right of petitions are an integral part of our analysis, which is used to unveil the practices developed in this area.

Dans ce mémoire, nous analyserons l’influence du droit international des droits humains sur la législation interne et la jurisprudence marocaines et tunisiennes. Nous tenterons de prouver que le droit international des droits humains a une influence sur le comportement des États et qu’il serait une cause de l’effervescence de la législation en matière de droits de la personne au Maroc et en Tunisie. Pour ce faire, le premier chapitre étudiera le système de réception du droit international de ces pays afin de comprendre comment ces conventions acquièrent force obligatoire et comment celles-ci s’intègrent dans l’ordre juridique national des deux pays. AbstractLegal Pluralism and Immigration : The Case of Moroccans in BelgiumLaw case in Belgium involving Muslims and affecting personal status have multiplied over the past few years. The practical interest in Belgium of Muslim family law derives from the persistence of the rule on conflicts of laws in article 3, paragraphe 3 of the Belgian Civil Law Code. This provision authorizes a liberal treatment and the recognition of foreign personal status. It leads to difficulties in harmonizing a law that fundamentally remains very dependent on its coranic origin, with the prescriptions of the secularized Belgian code. Going beyond the technical details of the conflict on law codes, authorities and jurisdictions, this study focuses upon an incompatibility. This incompatibility is not limited to the law codes. The inadequacies of the law are seen here as an exemple of the problem of communication between cultures.
