RÉSISTANCES CONTRE LE DISCOURS DOMINANT SUR LES DROGUES : USAGES THÉRAPEUTIQUES ET RELIGIEUX DE L’AYAHUASCA DANS LE MONDE GLOBALISÉ

Résumé

La légalité (et donc la légitimité) des pratiques reliées à l’ayahuasca est établie dans les États de là où elles viennent. C’est surtout lorsque ces groupes (et leurs pratiques) s’impliquent dans la mondialisation, en dépassant leurs frontières d’origine, qu’ils doivent affronter l’inquisition du discours dominant sur les drogues. Le terrain juridique est sans contredit le plus foisonnant et le plus investi par les porteurs du rituel de l’ayahuasca puisque son analyse en révèle beaucoup sur la façon dont l’État comprend cette infusion psychoactive, sur le discours qu’il formule à son sujet et ultimement sur son rôle dans la construction sociale de l’ayahuasca. De plus, nous pourrons constater que les porteurs de l’ayahuasca investissent d’autres terrains de résistance afin de faire entendre leurs voix et de défendre la légitimité de l’ayahuasca : utilisation de médias, implication dans la recherche, lobbying. Nous souhaitons offrir un tour d’horizon général (droit international, États-Unis, Europe, et attention particulière sur le Canada) sur l’état des relations entre ces voix marginales et l’État, en tentant de voir si cette relation renforce la légitimation de la vision hégémonique sur les drogues ou si au contraire elle permet aux marginalisés de se faire entendre.

Cet article se déclinera en deux parties. Dans la première, nous reverrons d’abord rapidement les principaux concepts théoriques qui guident ce travail (l’hybridité et la résistance), pour ensuite brièvement nous pencher sur la construction sociale des drogues et mieux définir l’ayahuasca et son rituel. Divisée en deux sections, la seconde partie est consacrée à une étude de cas sur la façon dont les porteurs du rituel de l’ayahuasca sont confrontés à l’État et au discours dominant sur les drogues dans le monde globalisé. Nous y verrons d’abord la façon dont les groupes faisant un usage religieux de l’infusion psychoactive font valoir leur légitimité devant l’État. Ensuite, nous nous pencherons sur différents cas récents impliquant l’usage thérapeutique/médicinal de l’ayahuasca lors desquels l’État est intervenu, afin de jeter un regard comparatif sur la légitimité octroyée par ce dernier selon l’usage qui en est fait.

Abstract

The legality (and therefore, the legitimacy) of customs related to ayahuasca is determined by the States in which these practices are found. As they partake in globalization and cross borders, ayahuasca users (and their practices) are often faced with the inquisitorial and popular anti-drug discourse. Without question, legal doctrine is the most widely invoked by participants of the ayahuasca ritual. In fact, its analysis reveals how State actors grasp psychotic infusion, how the State formulates opinions regarding it and ultimately, what the State’s role is within the social construction of ayahuasca. As will be demonstrated, in order to defend the legitimacy of ayahuasca, consumers invest in other means of resistance. These methods include media outlets, research and lobbying. The present dissertation aims to offer a general view (International Law, United States, Europe, with particular attention paid to Canada) of the relationship between the marginal group of ayahuasca users and the State. Additionally, the paper will attempt to determine whether the relationship reinforces a hegemonic view of drugs, or on the contrary, if it allows for the marginalized group to be heard.

The article will be divided in two parts. In the first, a brief review of central theoretical concepts that guide the analysis (hybridism and resistance) will take place, in order to then describe the social construction of drug use and better define ayahuasca and its ritual. The second part will be devoted to a case study of ayahuasca consumers, as they confront the State and a popular anti-drug discourse in a world of globalization. To begin with, the paper will examine the way in which groups involved with psychoactive infusion defend their legitimacy before the State. Subsequently, State intervention in recent cases of therapeutic/medicinal uses of ayahuasca will be analysed in order to compare State-granted legitimacy with the actual use of ayahuasca.
