Résumé
Cet article interroge le rôle que peut jouer le droit du handicap dans la lutte au changement climatique. En nous appuyant sur la Convention des Nations Unies relative aux droits des personnes handicapées, nous précisons les obligations des États envers les personnes handicapées dans le domaine des changements climatiques. Nous expliquons également que la vulnérabilité accrue des personnes handicapées dans la crise climatique résulte de l’interaction entre les incapacités des individus et les barrières institutionnelles, économiques, comportementales et environnementales auxquels ils sont confrontés dans la société. Nous présentons ensuite les résultats d’une analyse systématique de la protection des droits des personnes handicapées dans le contexte des politiques climatiques adoptées autour du monde. Enfin, nous terminons par une présentation des contentieux climatiques liés aux droits des personnes handicapées. Nous suggérons que des solutions climatiques inclusives du handicap sont non seulement essentielles pour protéger les droits et la dignité des personnes handicapées, mais qu’elles pourraient permettre à une plus grande partie de la population de contribuer à l’émergence de sociétés sobres en carbone et d’améliorer leur résilience climatique.
Abstract
This article examines the role that disability rights can play in addressing climate change. Drawing on the UN Convention on the Rights of Persons with Disabilities, we outline the obligations of states to persons with disabilities in the field of climate change. We also explain that the increased vulnerability of people with disabilities in the climate crisis results from the interaction between the impairments of individuals and the institutional, economic, behavioral, and environmental barriers they face in society. We then present the results of a systematic analysis of the protection of the rights of people with disabilities in the context of climate policies adopted around the world. Finally, we conclude with a presentation of climate litigation related to the rights of people with disabilities. We suggest that disability-inclusive climate solutions are not only essential to protect the rights and dignity of people with disabilities but could enable a larger portion of the population to contribute to the emergence of low-carbon and climate resilient societies.
