Any State's capacity to lay down rules, policies and a regulatory framework for governing a vast range of societal activities, which in this paper is qualified as « State potentiality », is one of the fundamental attributes of sovereignty. The author maintains that NAFTA affects State potentiality in Canada. This assertion is illustrated by an analysis of NAFTA impact on state activities in four areas : investment, culture, energy and agriculture. In this analysis, the author assesses a working hypothesis that some limits imposed by NAFTA on State potentiality in Canada have a quasi-constitutional nature.
