La Loi modifiant la Loi sur le patrimoine culturel et d’autres dispositions législatives, aussi connue sous le nom de loi 69, a été adoptée en avril 2021. Cette loi prévoit que les Mrc ont l’obligation d’effectuer un inventaire des immeubles patrimoniaux d’avant 1940 sur leur territoire. De ce fait, elle crée une nouvelle catégorie juridique d’immeubles patrimoniaux, soit les immeubles inventoriés, qui sont dorénavant soumis à des normes pour assurer leur entretien et le contrôle de leur démolition. Après une vague de démolitions municipales dans les dernières années, ce nouveau cadre juridique offre des solutions susceptibles de mieux protéger le patrimoine bâti du Québec.

Abstract

In April 2021, the Québec government adopted Law 69, thereby modifying the existing law on cultural heritage and related legislative matters. According to this new law, Québec’s Regional County Municipalities have an obligation to carry out an inventory of their heritage buildings dating from before 1940. This implies that a new legal category of heritage buildings has been established, meaning that there will be an official list of buildings that will be subject to regulations regarding their maintenance, as well as controls dealing with their demolition. Coming after a wave of recent demolitions in many municipalities, this new legal framework offers solutions that should better protect the built heritage of Québec.
